Review Topic: Adjustment of Status

Had our marriage based AoS this spring. Office was nice and well-run; desk persons and security were friendly and tried to joke to take the edge off.

Officer was very nonchalant and to-the-point. No warmth. It was almost theatrical in the bureaucratic performance! Flipping through file pages at random with seemingly no rhyme or reason.

We were asked for our passports and to confirm our full names and address. He confirmed our employment and employer addresses. We were asked our wedding date. My husband was asked when he entered the country. We had filled out an inadmissability waiver in advance and he said “I see you submitted a waiver. What’s that about?” Husband answered and was asked to provide a copy of his original i94.

My husband (beneficiary) was then asked some questions from the form including about an arrest (charge dismissed) and IO asked for a copy of the record of non-suit, which he provided. Other questions were about weapons training, drugs, communism and he definitely hit questions about false claim to citizenship, if he ever registered to vote, or voted (all answers were no).

He asked for some photos of us and when brought a huge bag with albums. He just flipped through them at random. We said he could keep one and he said dryly “no, your case is already 4 files thick.”

Finally he asked us openly why he should approve our waiver. I answered candidly about information within from my doctors and sworn affidavits from co-workers and family and that a denial would cause me extreme hardship. My husband apologized for his actions.

He then confirmed the medical was there and we gave him a brand new one since the submitted one was old and we didn’t want to chance an RFE.

IO said he would review the waiver in about a week then if approved we should get letters in the mail and then a welcome pamphlet and the green card. Lawyer didn’t have to do anything at all!

We left pretty relieved considering we were so stressed given the complications of our case. We had been married over two years and submitted TONS of bona fides so we weren’t asked anything of the sort.

So I appreciated the officer’s frank, dry, and clinical approach. Much better than someone smiling to our faces with intent to deny!

We were approved in exactly one week. So our experience on that score was GREAT!
