  1. First of all, good day to all the generous people here on VJ. I seem in Limbo right now because after i paid my mother"s AOS online, ( it showed paid now) her doc in the Phils ordered her to have lungs xray as well (she has arthritis and it might be not just arthritis but tb on the bone) and it says there that she has something on her right lung and suggesting immediate medication.

    My question is, should i continue with the process? I mean the medical thing even if we already knew she has it? OR let her finish medication from her doctor to be cleared off then just resume the process later on? But i dont even know if i can delay the whole petition process. I am totally clueless. I already have all the papers with me to submit to NVC (the financial docs and all that) and i also ready to fill out onnher behalf the ds 260 IV form but i dont know if i have to submit it now after learning my mom has it.

  2. The birth certificate is needed as early as the initial filing stage. Gotta wait for it to be available. Are you a US citizen? Because only a USC can apply for parents, LPR cant

    I understand im going to submit my BC when i petition my mom , my BC is alright but my mom's BC is still at the NSO (still in processing for the corrected name to be released Aug-Sept) , when did you submit (or your parent) the BC to the embassy?

  3. Hello VJ co-members, hope youre all doing fine.

    Im back. I just want to know from those who have approved IV for their parents if i can file now the I130 for my mom in Phils even if her birth certificate (corrected the mispelled first name) is still in processing (the civil registry and NSO gave us an estimated 4months in process so it might be ready by Aug-Sept). Can i file now or just wait for the Birth Cert to be released months from now? When does the benefiacy need the birth cert to present at the US Embassy?

    I am also from Florida (just moved, havent changed my timeline yet sorry) My experience during the outreach, they let me do the ROM and passport renewal at the same time (outreach program Orlando). They might do it this year or they might not, ther's no harm in bringing all your documents both for ROM and passport renewal and as you know, our own government people are just "cool" and not really that super strict. Dont bring exact cash payment, have some extra :)

  5. Hello freedavid. Seems like the same situation with me but i dont have 2 birth certs just wrong name entry on my Birth Cert.

    This is definitely a DO IT YOURSELF thing IF... Please take note below:

    Get a copy of her Birth cert from NSO (in security paper) the one that HAS THE CORRECT BIRTHDAY because if you are going to correct just the incorrect first, middle or surname, NO LAWYER is needed. All you have to do is go to your Town or City Hall's Civil Registry Department, tell them you wish to correct it (Repubnlic Act 9048 as Greenbaum mentioned). I dont know how much there in Leyte. I live in Manila, i paid The Civil Registry Department P3,500 (almost $100) for the filing fee (excluding the fees of copies from NSO and some Valid IDs and documents needed to prove that her name on her BC is wrong. Example, if her name on her BC is ALMA But shes been using AMALIA, you need to get supporting documents with her name AMALIA on it. Documents such as NBI, School Records, Police Clearance, Work IDs etc..) Then see The CivRegistry again, and you need to contact a newspaper or tabloid publishing company to publish it (cost me P15,000 or $350 the most) then you need to buy the newspaper whenever they publish that Ad regarding the correction of her name, (They will tell you the date when they publish it) i believe they will publish it 3 times in 3 weeks (secure your own copy of the newspaper because you will also give copy to the Civil Registrar) after the 3 publish, The poublishing company will give you the Affidavit of Publishing and you will submit all the papers (incorrect Birth Cert, supporting documents, cut out copy of Ad on newspaper and the Affidavbit) to the Civil Registry and they will file it to NSO main and the waiting time (it may vary, i am not so sure But this is my expeience) is 4 MONTHS. After 4 months you need to get in touch again to your CiuvRegistry and they will tell you to come personally to NSO main to get the copy of the CORRECTED BIRTH CERT. They told me to go personally to NSO because it is the first time for me to get the CORRECTED one so the next copies (if you will request again, you dont have to go to NSO personally)

  6. I wonder if somebody here has the same experience. I renewed mine through their outreach program August 2014. I called the lady in charge of the passport (took me 3 days to finally talk to somebody) and said theres something goin on in the Phines that cause the delay. 7 months? C'mon.

    Did everything. Email. FB messenger. Nothing. NR. Can i just board on plane then point that it is my embassys's fault? Just kidding.

    But seriously.. This long?

  7. Hello my fellow VJ members. Happy new year. My situation is this,,,

    I am peitioning my mother from P.I. And on my BC, my middlename is "Sanbunaventura" (should be Sanbuenaventura) one letter short ("e") so it doesnt match with my mother's middlename too (she's still married to my dad). Should i correct it to the Phil.Civil Registry or just proceed to petition and just do an affidavit thing since all my papers (from passport, to baptismal) are spelled right except this BC which is the main requirement for petition. One more thing, my mother's maiden name on my BC was spelled "Sanbuenaventura" as well as her marriage. Certificate to her dad. Will the USCIS let me go on an easy route (affidavit) or need to correct the BC n the Phils.?

    I need inputs for all who has thesame experience or at least how can i get in touch with USCIS for this inquiry.

    We just have a question regarding Part 4 of n400 - information about applicant's residence for the last 5 years. My nephew is going to file n400 based on 3.5 yrs marriage to USC but he's been here in the US for almost 9 years (imcluding the married years) Some of those years, he was out of status (student visa). Our question is, does he need to put all his place of residence during his out of status time?

    Bubba gump, you were lucky. it just took u a month, mine was not. I sent it March for gramma's bday on April, She died 5 months later of cardiac arrest and did not even saw the bday card i sent her. And then another card for mother's day for mom, it's October now, nothing. Nada. I just told her dont lose hope. She might receive it next mother's Day. And also told her, pls dont die. LOL!

    My USC/Fil co-worker/friend will petition her mother from the Phils. Her Father and Mother are still married but no longer living together for 2 decades now. in short, Father is "sumakabilang-bahay" (english >> went to other nest) (grins). No contacts at all with the dad. For them, He's a total stranger.

    Her Mother wants to use her maiden name on all the papers. Can they do that? Will it affect the whole immigration process? As i look at the requirements, they won't be needing a marriage certificate and she's not intending to petition the father any time or in the near future.

    On behalf of my shy but sweet co worker friend, thank you for all the response.

  11. Hello Kabayans. Mabuhay!

    Weeks ago, i sent an online passport renewal app form at the Phil. Embassy (outreach program). I sent my app form on my married name (my old passport was under my maiden name) and along with it are report of marriage form signed by both of us and our marriage certificate (i did not know anything about reporting a marriage thing until that day I sent the application). I did it because somebody here on VJ said that we can do the application (passport and ROM) all at the same time.

    Long story short, i forgot everything about opening my email after that. Spouse got sick, im working and my teen started school etc. Now i am out of town as in another state for an important matter. So I saw the Phil embassy's reply. JUST NOW. That i need to apply first for ROM ASAP because it will take weeks and then when I receive the approved ROM from the embassy, I have to present it on the day of my passport app appointment so they can change my name.

    So, I went to the website and I learned that i need to send them 4 copies of ROM app form, notarized and our marriage cert. How's that?.. I am way out of my town now and will be back 2 days before my appointment. #sadface

    So they will not change my name? anybody here who has the same experience?

    Married pinay here, permanent resident.

    I am about to renew my passport (expiring this November), is it okay to retain my maiden name? No problem to change it to my married name but it just takes a lot of processing like i have to submit a Report of Marriage and i don't know how long it will gonna take. (the outreach program of Phil Embassy on my area is this month) and i just need my passport to be done because im planning to have a trip this year. But i will sure put on my passport app form that i am married and will put husband's name so as not to violate RA 8239 (false statement in passport app form).

    My question is, is it allowed that i choose not to use my married name to renew, or by law, i am obliged to use my married name?

    One more thing, i will be filing my application for naturalization on February 2015 (will be a US Passport holder next year) so I will be using this Phil passport just one time because of an schedule big reunion this coming holiday.

    Last question, in the future, if i plan to petition my mother, i know that the proof that USCIS will be asking is my birth certificate that bears my mom's name as my mother, my question is, my middle name on my BC is mispelled (typo error) like SHERLY DAIS CARLOS instead of DAVIS. But the rest of the entry are correct spelled like mother's name JANE DOE DAVIS etc.. my question is, will it affect the processing if ever i petition her here in the future?

    Im so sorry, i know this is a different topic. I just cant find any answer online about this or any idea what web site i should look at. Thank you very much again.

    I just want to ask anybody here who can elighten me about changing name during the citizenship process. I am applying in the next couple of months.

    Note: The names used here are just sample names.

    Maiden name >> Sherly Davis Carlos

    Married name >> Sherly Carlos Donald

    When i apply for US citizenship, can i change my name to SHERLY DAVIS DONALD, (Omitting my father's last name CARLOS and put in my mother's last name DAVIS instead)?

    next question, my 10 yrs old son who is also LPR, i read in some immig sites that he'll automatically become a US citizen, because he is under 18 yrs old. Can i also change his first name to another name because his stranged dad (we were never married) give him his name and nobody can really pronounce it.

    I want to change it >> From KHRALGRUEHS JOHN >> To CHARLIE JOHN

    And one more thing, my husband (his stepdad) wants my son to use his surname, DONALD and totally remove the DANTES. Can we do that? Can we change it through the process of citizenship or my husband needs to go to the court to adopt my son?

    Here,

    Son's current name: KHRALGRUEHS JOHN DANTES (Dantes is his dad's last name. He let our son use his last name since birth eventhough we are never married)

    I want to change it to: CHARLIE JOHN DONALD (if they will allow us and no need to go to the court for formal adoption)

  15. Hello fellow VJ memebers. Just wanna know if there's somebody here has the same situation or just what you think.

    I am a GC holder (extended for a yr. Adjustment is still pending, I am a Janury 2014 filer) Husband is a USC. We would like to try to apply for a tourist visa for my mom who is on her late 50s but not really that healthy although she can still manage to help herself in her daily activities. She doesn't have any properties, any bank accounts, job etc. Nothing of any ties to her/our country except my unmarried adult sibs and her husband (my dad). Any chance of passing the embassy interview?

    Second Question, If ever US Emb denied her, will it affect any petition for her that i'm going to do in the future (Once I become a USC)

So, I submitted my "do-it-yourself" documents a week ago to VT center (thanks to the wonderful people here on Visa Journey who selflessly share how to do it and answered all the questions similar to my case) and i got today the notice that my residence is extended for a year and wait for notice for biometrics. I am positive that everything will be approved because it is really a love marriage and we even have a little angel :). I took pictures of the file/docs that i submitted and if somebody here is interested to see it, let me know. Thank you guys :)

  17. Oh im sorry. I was not clear with my post.

    Yes i am still married. No, it's not me. My husband who is a USC will file for him as his stepdad. My minor child entered as a B1/B2 visa when my papers got approved as a conditional GC holder then he overstayed his visa and now my 2yrs condition is about to expire on May2014 so we will be filing the i751 within 90days before it and we're also planning to file my child's i485 and i130. Will it affect my application to ROC GC or any?
