  1. Hi,

    I need to obtain several Police Clearance Certificates but some places I have lived (e.g. HongKong) will only send the certificates to the Embassy or Consulate of the intended country of immigration, not to the applicant's address. This means I will not have all of them to send with my other civil documents to the NVC.

    Has anyone experienced this? Should I go ahead and advise the NVC that these will be sent to the Embassy in Sydney?

    Should I request Hong Kong to send it to the NVC (with barcode, etc...)

    Confused.....

  2. Hi Danielle,

    I'm at the NVC stage for a CR-1 and had mine done 2 days ago in Sydney, I followed the steps to the dot as per from the US Embassy guidelines at:

    - Complete Form P800 (Full Disclosure), there is a link to a read-write PDF copy on the website.

    - Make sure you tick the 'name, date of birth and fingerprint check' box, and your address as the address to send the certificate to. The Police told me they will send it to me and not to the US Embassy as I did not have a letter from the US embassy specifically asking for it. You may have to ask to confirm.

    - Go to your local police station for the fingerprints, pay $175. Credit cards are OK.

    - Fingerprints will be taken and sign the official-looking paper with the fingerprint images from the machine.

    - Your local police station will send the form and the fingerprints to a Police Office in Parramatta where the national police check will be done.

    - Expect the certificate in the mail 10-15 working days.

    Hello all! Hope everyone is having a great day.

    Tried to look for some information on this here but couldn't seem to find quite what I was looking for!

    My fiance and I are still waiting on our NOA2 (September filers). Can he go ahead and get his police check done now?

    Can any other Aussies fill me in on how to go about getting the police check done. How to set it up/what is involved/cost? Also, what documentation he needs to get from it.

    Any answers would really help me a lot!

  3. Our petition was approved on 14/09 (NOA2), and I am investigating the next steps. I found this on the USA embassy website for Australia with the heading "Once your petition is approved". Does this mean as per NOA2?? Can I approach the embassy directly from now on as per the instructions?? No mention of the NVC process anywhere - unless the approved petition refers to NVC case complete.

  5. I find phone tapping to be unusual. But with the government these days, you never know if they do random checks. I wouldn't mind if they tapped my calls. More proof to show that we are in bona fide relationship/marriage.

    Thanks for the replies. To us its more of a concern than a worry - we exchange credit card details, PINS to bank accounts, itunes passwords and payment details (free music, movies....?), all sorts of private stuff. I'd be surprised if an Australian is involved in hanky-panky stuff - very easy life here, plenty of jobs, all the world's problems are "across the water, over there", multiculturalism works, hardly any crime, its a holiday every day here. No wonder only 2,000 E3 visas are used annually out of the 10,500 cap. I worry about relocating sometimes.

    My wife thinks someone is listening into our phone conversations as she has noticed there are strange clicking sounds when she calls. Also, she mentioned her phone rang, my number showered up and there was no one on the line. I am certain it wasnt me calling as I was at work. Anyway, does phone tapping occur in this process? I suspect she's just stressed about the elusive NOA2. Your thoughts? Does someone know? I may have to tone down a bit if this is so.....

  7. Now how big of a deal is the money? I've been having trouble finding work for 6 months so haven't had much money but recently found 2 jobs so I'm working both to get some money together but it's still not going to look good when I go for my interview and I plan on staying in Australia till I've got the money required to go over there.

    I plan on telling them I have a car to sell.

    When I get over to the US I'm pretty much going to be set up till I find a job, my Fiancees parents are extremely nice and own 2 houses and they're letting us have one till I can get on my feet over there and start making some money so the housing and food isn't a problem. What are the chances they'll reject me on this?

    Also couldn't I just get someone I know to put some money into my account for me and then after they can take it out again? My only problem with that is it looks suspicious if I just get a load of money into my account. I'm pretty worried this might mess up my whole visa..

    Any help would be greatly appreciated.

    I understand its possible to use the beneficiary's offshore assets at 5 times the shortfall. Don't do the instant transfer - not worth the risk. My situation is similar to yours and I will be using my savings + the equity in my Sydney property to exceed our household's povery line. We are determined to avoid the co-sponsorship path. Here is some info. from an immigration lawyer regarding offshore assets:

    Q: I have no income and have no valuable assets in the U.S., but I have a house in China with a current value of US$100,000. Does it count?

    A: Yes. You may count significant assets outside the U.S. as long as your assets are readily convertible to cash within 13 months.

    Q: How can I determine that my assets are sufficient to meet the financial support requirements?

    A:The value of your assets less any offsetting liabilities must exceed by at least 5 times the poverty lines minus the sponsors household income.

    For example: Mr. Smith has an annual income of $2,490. If the federal poverty line for a 2-member household is $12,490. He must show that the value of his assets is not less than ($12,490-$2490) x 5 = $50,000.

    Q: What evidence of assets may I submit?

    A: Evidence of assets includes almost all tangible or intangible properties. Usually they are: a. bank statements covering the last 12 months; b. stocks, bonds, and other securities; c. personal property; d. real estate.

  8. I'll apologise in advance if I have hijacked the thread.....On the same topic, can a beneficiary request an expedite? My USC wife is in hospital again, some surgery may be required, its been 2 weeks now and she is in no position to write/fax anything to anyone. Hard times..... I am tempted to request one on her behalf. is this acceptable to USCIS?

    Its when you recieve the NOA1 email with the Receipt No. WACxxxxxxxxx number, which you will need to create an account. We created an account a week after the NOA1 email and our application had a 'touched' indication 4 days after the NOA1 date on the email.

    Sit back, relax and enjoy the looooooong (length is at least 5 months) flight between NOA1 and NOA2. No entertainment on this flight though...:-(

  10. That's an éasy'denial, at least you know why and what is required. I would be getting each and every piece of communication record and presenting it - all 10-15 kilos of it. I had close to 1500-2000 text messages/month, about 6 A3 printouts per month with my frontload, and there was more for the phone calls..... Relax, get composed and present what is required.

    It a different story if you don't have any records though.

    What do you mean by 'capable of providing for myself'? Will your income stream continue when you move to the US? Or do you have a job lined up already?

    There is an option for a beneficiary to use his/her savings and assets in order to meet the required 125% above-the-poverty-line dollar amount. Its perfectly OK for a beneficiary to include their financials, taking into account the household size + the 1/3 calculation.

    "I have spent most of the morning and afternoon on the phone with USCIS, they said your financial information (assets) would only come in to play if you will be living with him when immigrating... and I will not be..." What do you mean by this? 2 households?? Have a look at the attachment to assist you work out your combined financials.

    I'd suggest posting to the Canada forum, I am not a VJ veteran unfortunately.

  12. You too Carolina, you can do better then that, go ahead take a deep breath and tell us how many weeks, days, hours minutes and seconds you have been waiting on NVC and all the times that they've said wait 15 days and how rude they have been and all that good stuff.

    Come on, I mean must we teach you proper whining technigue! :rofl:

    We are May filers....can we join the whining party please? Or is there a line here as well? We promise to wait patiently for our whining application to be 'touched'....hihihi.

    We filed the I-130 and supporting documents on 24th May and received email notification of acceptance. We are in 'Initial Review' on the USCIS website, and the case was touched on 28th May. However, we never received the NOA1 hard copy in the mail despite being on the lookout for the postman - or woman....;-)

    The question is - Do we need to have the NOA1 hard copy at all for the coming steps? Is there a way to request a 2nd copy in case we ever get asked for it? We do have the receipt number WAC xxxxxxxxxxx from the email.

  14. My husband just called from the Sydney Consulate after his interview and he has been APPROVED !!!

    His interview consisted of three questions:

    1) Have you lived in another country (Yes)

    2) Do your children have US passports (Yes, in fact the consulate interviewing him processed our children's passports)

    3) Did you get your Hong Kong police check done. (Yes, and it was sent directly to the consulate- they didn't have it in his 'file' they had to look for it in the back and they found it.)

    DONE.

    They told him they will process his Visa tonight and put it in the mail tomorrow as he stated he had his flight booked for Monday. (mail does not get serviced on Saturdays in Oz)

    I just want to extend my sincere thanks to everyone on this forum as the helpful information and knowledge has been invaluable. I want to wish all remaining on this journey much success and hang in there.

    Now he just needs to get through LAX.

    That's good news. It looks like the Sydney consulate people are very understanding.

    May I get some guidelines from you about getting HK police clearance? I worked in Honkers in the late 90's and I'd like to save time on my police clearances by chasing them while waiting for our NOA2. Is it possible to request the HK clearance before the official request from the US consulate? I have OZ, mainland China and Indonesia to clear as well.....

    Just wondering - I looked at your timeline, did you received the RFE on the same day CSC received your I-130? If so, then it is a fresh case i.e the 5-6 months as advised by USCIS. Without knowing what the RFE is for, it appears there was some very obvious omission so much that they could not even start on your petition.

    Anyway, other 'more experienced' members may comment differently.

    Silly question time (again...you ask?!)

    After all the RFE posts in the past week, I checked our I-130 submission and discovered that we left my wife's (late) Dad's name field blank - as he passed a few years ago. Is this a potential RFE coming our way? If so, is there a way around this - say, forwarding the missing details to USCIS? We are between NOA1 and NOA2 as May 2011 filers.
