    If I were you I would call the NVC. Based upon the timeline you gave Rhea it looks concurrent to me. I also talk to a rep today by the name of connie, and she told me that once my husbands case arrives back to NVC they marry them together , and i will not need to pay an additional AOS, because it's son/dad. So, yes I would tell my husband to call and ask why He had to pay another $88.00 fee, and he is a US citizens. :dance:

My case was complete last April 6, 2011 then...and got interview date of May 11, 2011 and my daughter's case was approved at USCIS last April 5 and it was expedited..and we requested NVC to expedited it....maybe that is the reason why we paid AOS twice..coz mine was complete...and hers still at NVC...

    NO RHEA, are you a U.S. citizens? if your not then you have to pay a AOS fee for all cases that you are filing. I am a u.s. citizen, and I am filing for hubby and step-son, so i dont have to pay (2) aos fee's. I just posted the info form the NVC site.

  3. okay, am back with some info regarding the AOS fee. This info came from the NVC website. SEE THE BOLD:[b]I paid the AOS fee for one case; do I have to pay the same fee for my other cases?

    You must pay the Affidavit of Support fee for each case unless you are a U.S. citizen with petitions for your spouse and/or child(ren) concurrently in process at the National Visa Center. Note: payment by cashier's check or money order must include all fee bills in one return envelope with one check on top. [/b]

    This only applies to U.S. Citizens.

  4. None of your questions are dumb. This is not a easy process. So, I will try to answer your questions the best way possible.

    The AOS fee of $88.00 will cover you both. You do not have to pay this twice.

    The IV bills, you will pay TWO IV bills @$404.00 will come out to $808.00 visa bill for you and lil guy The medical examines: Yes! you and your son will need one. It is a requirement.

    You will also need to fill out separate forms for each applicant, you and the lil guy.

    The only question that am not sure of is if he needs to be at the interview.

    Lastly, go to the NVC website,and out your embassy info in , and they will give you a list of approved Dr's that can perform your medical examine. Also I think you will want to wait until they send you the packets to get the medical, because it's a certain form you will need. So, again no questions is dumb. THis is what this forum is for.   5. Oaky VJ family family I got some good news. I get home today , and open my mail box. I get a letter from USCIS, stating that they have "reaffirmed there previous decisions on the the above applicant" my husband. For those who remember I had to file a separate petition for my step-son. When i originally filed I do so under the k-3/k-4 which only approved my husband, because children are not a automatic deverative of their parents. So, I filed for my step-son in march with a request for expedite and the help of my local congressman. The petition for my step-son was approved in a little over 30days.However, I had gotten a letter from NVC that same week saying they had sent my husband' s approved petition back to USCIS for further review, but they could not tell me why, So you know I WAS HEATED, and wanted to jump through the phone. NOw what's funny, is they still can't tell me why..lol but what is was , was the different priority dates. my hubby had a different date Vs. my step-son, so now am just waiting to complete the NVC procress. :P:D

  6. :o:o This has not been a good week for me at all. On Saturday April 9,2011 I recieved the approved NOA for my step -son. This was done as a expeditie with the help of my local congressman. My husband's petition has been approved since 12/23/11. The reason both peption were not approved at the same time was due to the fact that I filed the petitions as a K-3/k-4, so my step-son was not automatically included in that process, so I had to do it as a separate petition. So, finally on 4/9/11 I get the good news that he is approved (step-son) :dance: On Monday I open my mail box to get a letter form NVC stating that they have sent my husband petition back to USCIS, and they put no explanation as to why. :( I have been on the phones ALLLL week with USCIS&NVC trying to get answers...NVC tells me to call USCIS. USCIS tells me they don't know and it will at least 120days. Someone please help me with this. :angry: The whole purpose of my step-son's petition being expediited was to have it united with his father's petition which was already at NVC. In fact, I had already paid the AOS fee of $88.00. I was waiting to pay the IV bill, and send all the supporting documents in til my step-son's had reached the NVC.

    Exuse my french... THIS -hit just make me want to holler, and throw up my hands. I don't understand.PLEASE!!!! PLEASE HELP ME TO UNDERSTAND WHAT IS GOING ON. I never receieved any REF from USCIS for any of the petitions.And as far as NVC goes, I never even got a chance to send in the supporting documents.   7. you needed to have filed a separate petition for the CHILD .. as stated in the instructions. listing the child on the application does nothing than letting USCIS know they "hey i HAVE A CHILD." That does help the immigrant would would later petition for the child .. so no surprises.

    Ricardo, I did file a separate I-130 for the baby. I followed your directions. It was approved!!!! on 4/6/11.I was saying that now they have sent my husbands petition back to USCIS after it was approved.. which is real funny.

  8. usually, the derivative petition is married up with the main petition at NVC, not at USCIS.

    So, this 'backward shipping' to USCIS seems really bizarre.

    Exactly, Darnell.. and mind you know one can give me any info. NVC sent my husbands back to USCIS. I would like to think that USCIS is also holding my step-son's there to. As I stated I never recvd a ref while my husbands petition was pending.I paid the NVC $88.00 AOS fee. I know it has nothing to do with the embassy, because it never maid it there. I was waiting til my step -son's petition was approved, so I could pay both IV bills and send the proper paperwork in at one time. :blink: Am just sooo frustrated with this process, I had to come home early today.

    Are there specific reasons why they will expedite an I-130??

    I know when we did our K-1 I read that only US Military or petitioners who are very ill could get an expedite...

    Yes, if you go on the USCIS web site they will tell what qualifies as an expedite. However, it all in how you write and what you say.That is how I handled mine.Words go along way!!! inbox me :innocent:

    I have read a couple of threads where people have stated that they asked for an expedite of their petition at the NVC stage.

    Are there certain requirements for expediting the processing of a CR1 case at NVC??

    How does one go about requesting an expedite?

    I did a expedite, but I did it at the USCIS level for the I-130. It was for my minor 4 year old step-son. I wrote letter, which I have shared with other VJ family members,and I had my local congress rep to help. Yes it did help. The petition was approved in less than 30days. So , it did help, but now NVC sent my husband's approved petition back to USCIS, and I am assuming they need to marry both cases together. Princess all I can say is "it's a long-way down" just when you think you are moving ahead, your actually in pause mode.

So , they approved my husband's I-130 and sent over to the NVC which I paid the AOS fee. After finding out that my step-son was not a deveriate of his father, my husband, I sent in a petition for my 4 year old step-son .... which also increased in price $420.00. When I petition for my step-son I also requested a expediite, and had my local congress man to help wit the plea of expedite. IT WORKED !!!!my step son-son petition was approved in less than 30days. I received the NOA on this past Saturday. SO, with that being said I logged on to the NVC web site to pay my husband's VISA fee, and I was locked out, and it stated that i needed to talk to a rep, so I did. The rep stated that my husband's i-130 had been sent back to the USCIS, but she did not know why and I should contact the USCIS. So, I did so , and they could not give me an answer. I called my congress man , and spoke with his rep, his rep informed that because they are family members that will migrate together, they are assembling the packets into one packet because the child is traveling with his father. Although his information wasn't 100% correct I still need a correct answer. Does anyone in the VJ family know about this? I really stressed because my husband has been approved since 12/30/10, and I have already paid the AOS fee and I never received any REF. If you have any info to this situation please help.     Thank you so much for the information. When I spoke to the officer at USCIS they said they could not give me any information because they had not received the information form NVC. NVC sen the package back on 4/8/11. I also received the letter form NVC today as well, but it does not say anything as to why my husband's petition was sent back to USCIS.NOw what is really funny. The Petition for my step-son was approved on 4/6/11, an dI received the NOA on this past Saturday 4/8/11. Also, Mistertoe I purposely put off paying the VISA bill for my husband because I wanted to wait until my baby's petition (4yrs son) was approved. As of this date, The NVC has not received my step-son's petition. I am really hoping that they sent my husband's back to USCIS because they want to marry the packages together, which is not a problem, but .... say that !!!!! I sorry am just so frustrated with process.There are so many miles stones that my husband is not able to share with because turtle in the process.Not to mention that I can't even register the baby for school.... so am UGH right now. You said talk to Sue. Who is she , and how can I reach her? Also I paid the AOS fee. it's that a one time fee for family? At the NVC I spoke to a customer service rep named Sarah, all she said was that my husband's petition was sent back to USCIS, and I needed to contact USCIS, which I did, and there I spoke to rep who then transferred me to a Officer, who said they had no info yet, and I also called my Congressman, who will help, but he said I needed to wait for a letter as to why, so he would know what he needed to address, so I called on my VJ family... I AM SO TIRED OF THIS PROCESS. HAd I known from the beginning about the k-3/k-4 I would not be going through this, in fact I think they would be here by now :crying:

I've seen what I would term a noticeable increase in what I'll term "RFEIE" 's (Requests for Extensive Initial Evidence) being reported here on VJ and elsewhere. I've also seen a less marked increase in "Standard Interviews" prior to petition approval. It would seem (only educated speculation) that USCIS is upping its game in the ongoing turf war with Consular Services.

    I'm seeing this increased activity in cases that fit fraud profiles, the same kinds of cases USCIS is seeing sent back to them with recommendations to revoke petition approval after a Consulate has denied the visa. I've also seen more second denials after reaffirmation lately than I've seen before but that's a less marked increase as well. (not statistics, just observations)

    My conclusion is that USCIS is tired of getting their petitions re-adjudicated as to the classification, 201(b) "Alien Spouse of a US Citizen" followed by NOIR reviews, notices, rebuttals, reaffirmations and second visa denials. As a result, they are getting more pro-active in their adjudication of quite a number of cases that will go to high fraud Consulates and that fit common fraud scenarios. They are doing this with RFEIE's asking for pretty much the kitchen sink of evidence we would call "front loading" including full evidence and explanation of each and every potential red flag. They do tend to give more like 90 days to respond to these RFEIE's than the normal 30 days for an RFE.

    Opinions? Observations?

    Pushbak, it is really funny that you said that.I orginally filed a petition for my husband/step-son under the k-3/k-4, which no longer exist.So, the I-130 was approved for my husband first.After finding out that the k-3/k-4 no longer applies, I had to do a separtate petition for my minor age 4 step-son. When I filed the petition for my step-son I did so with an expedite, and I had my local congressman help with the case as well. My step-son's petition was approved on 4/6/11.I had already paid the AOS fee for my husband. I went on the NVC website today to pay the VISA bill for my husband, but I was not allowed to log in ,and it also stated that I need to talk to a rep , so I talk to a rep , and she informed me that my husband's petition that has already been approved was forwarded back to the USCIS, and there is no info at the time.... WILDDDD #######. Now, maybe that is not the case. I would like to think that they wanted the case back to assemble the packet into one (husband&step-son) I can not think of any reason why they would think that this is a fraud case, or something fishy..... Does any one have any input? If please give me your feedback. :unsure:

  14. I am SOOOOOO happy today I received the NOA for my -step son. I am sooo happpy and grateful for the VJ family and all the help you guys gave me. For the VJ family members that do not know my case it goes like this; I did the petition for my husband as a K-3,k-4 which no longer exist, so that meant that my step-son could not travel as derviate with father, so I had to file a seperate petition, which was done as a expedite on 2/25/11 (exactly 40 days). So, I get home from work and open my mail box with the lucky letter inside and it reads you are " APPROVED", so now am waiting for his info to be sent to NVC with his father who was approved on 12/30/10. I want to thank all the VJ family for your support, and a special Thank you to DARNELL &RICARDO regarding the expedite process. ONE LOVE, The AMERICAN DIVA.

    Now my next question. Will I have to pay another AOS fee, which I already paid for my husband. Also, which affidavit of support forms will I need to submit for my step-son/husband for CR/1 filing, all my income is through work, and I do not need a sponsor. Also does anyone know if my step-son, age 4 will need to attend the embassy interview? Lastly, what form will his biological mother need to file or sign for my husband and I to take to the US? She has already verbally approved him coming, but I know it should be some paperwork for her to sign. : :unsure:

  15. Good Monday VJ family, I have a question. I sumitted a I-130 package on 2/26/11 for my step -son with a plea of expedite. In the package I enclosed a copy of my husband's approved I-130. The USCIS has recieved the package, and I also recieved the notice of action as well. My question is;how long does this process tak since I requested an expedite? I followed all the instructions from VJ members: Darnell & Ricardo. For those of you who don't remember my case. I originally filed under the old K-3/K-4 method, which is no longer an option. So the i-130 was approved for my husband on 12/30/10, so , additionally I had to file aseparate petition for my step-son, Because he does not have devration stauts with his father.So, basically my husband's petiton is already at the NVC waiting for our little our son to get approved.My reason for asking is because I told that request for expedite can get approved in as little as 14days. besides, dad is already approved,they have checked me our, and what more info do you need on a 4 year old. :innocent:
