  1. During my fiancee's interview (which I attended with her) the subject of visitor visa's came up. It came up because my fiancee was denied a visitor visa during our K1 process. He said a denial "makes sense" when applying for a visitor visa while in the middle of a K1. He said it is almost a guaranteed denial when I asked a little more about it, but he did not elaborate anymore than that.

    I suppose there is always an outside chance of getting approved, but it will be extremely unlikely.

  2. I am also the male and the petitioner. I feel as you do. I read VJ a lot to be prepared every step of the way. I would read through many parts just to read others experiences. Trying to be as prepared as I possibly good kept me insane. Now, since the interview is over, the thought of going back and getting her at the end of this month is keeping me sane. Everyone finds their own thing, but we can all relate.

  3. I didn't have a problem getting the area code I wanted, but it is a US area code. I never tried to get a Canadian area code so I don't know if that is possible. You may need to assign a US phone number to each Magic Jack. I heard of sons/daughters buying Magic Jack and sending it to family overseas so they can call the US for no additional fees, but it has a US area code. I do not know if Canada will be different.

  4. I use Magic Jack. Free calls to US and Canada and only like $50 for the entire year. Plug one end into your computer, let the software install, then plug the other end into any phone and you are set to go!

    When I visit my fiancee in Ottawa I take the USB part with me and plug it into my laptop and I have even plugged the hotel phone into it and I was able to call the USA no problem. I have even heard of people taking it with them on trips to Asia/Europe and having it work no problem. I cannot attest to that, but it did work in Ottawa. To be fair, sometimes the quality is poor and I have to hang up and call again. But for the price it is amazing in my opinion.

If you're worried about it, a letter from your employer stating you'll be back to work on a certain date always works. I used to work for a non-profit moving between countries constantly, and these always were given to us; letters from employers are gold.

    But between two 1st world countries and with Australia being such a low-fraud country, I'll think you'll be fine. Happy Holidays!

    It seems to be fine for the petitioner to visit the beneficiary with no problems, but it doesn't seem to be entirely true in reverse. We just had our interview Dec 1st in Canada and spoke to a man (beneficiary and Canadian Citizen) whom wanted to extend his stay in the USA and was denied due to being in process of a K1. During our (I say our because I was there with my fiancee) interview we told the interviewer that my fiancee was denied entry for a visitor visa in August of this year. My fiancee also had a letter from her employer (amongst a host of other evidence she would be returning) but she was still denied. He said "That makes sense since you had K Visa pending". I said I thought that would help since we have the NOA2 to present to show we are going about everything legally and that we wouldn't want to screw up our K1. He didn't go into detail, he just said "it is basically an automatic denial if you have a K Visa pending".

    I know I have read on here about Beneficiary's visiting their Fiance(e) in the USA on the VWP and not having difficulties. I have also read in a couple instances where they have been denied at the border. By wait the interviewer said it seems like if the beneficary actually applies for a visitor Visa that most will be denied. "Automatic Denial" was the phrase that rang in my ear.

  6. This will be kind of long since a lot of stuff happened. It will be a mixed post of the interview review and just some other things that happened to us while in Montreal.

    Our case is slightly different than most on the Canadian forum. I am the petitioner but my fiancee is a filipino that has been working in Canada for over 3 years. Due to this I believe our interviewer was a little more skeptical of us than what he would have been toward a Canadian citizen. More on this later...

    Our initial interview date was November 28th. They put us in some sort of review and cancelled our initial appointment after I had already bought airline tickets/hotel stay. I emailed them to find out why and never did get anything besides which seemed like a canned response. Either way, our review was over a day later and I was able to book a Dec 1st appointment which allowed me to keep my travel plans. I live in California and flew to Michigan to spend Thanksgiving with my family before leaving on Saturday to spend time with my fiancee. She lives in Ottawa and we drove to Montreal on Tuesday to pick up her medical results and look around the city. My flight was for Dec 2nd at 6am out of Detroit. So having the appointment Dec 1st I knew I would be tight on time to drop her back off in Ottawa, drive to Mid Michigan (around the Flint area) to drop the car off and be taken to the airport (75 minutes away) in time to make my flight.

    Due to the time restraints I wanted to make sure we were the first in line to be the first interviewed so I could get on the road. We stayed at the L'apartmente Hotel and it was right across the street from the Medisys and only a 15 minute walk from the consulant. We left the hotel the morning of the interview and got to the consulant by 6:35am. It was a cold morning and the wind was blowing pretty hard down the street. We were the first in line and no one else showed up until 7:15am. At 7:30am the guard opened the door and let us in first. There was a lady off to the left that checked Dodelyn's appointment letter and compared it to her list. We were not on her list. She stepped out a moment and came back and said she cannot let us in until she checks with "somebody upstairs" to verify we were suppose to be there and she cannot do that until 8am. Lots of other people are now coming in the door and being let up the stairs and we had no idea how many were K-filers so we didn't know how many spots we lost initially. About 40 minutes later there were about 6 people standing with us and after talking to all of them we were all K-1 filers that had rescheduled our appointment. After talking to the women by the door she let us know that they print out the lists weeks in advance because "they were not suppose to change". So if you rescheduled your appointment you might have this problem of not being on the list.

    Around 8am we asked the lady again if she checked with someone upstairs yet. She let us know "the systems were down" and there is no way for them to verify that we should be there since we were not on that list. It wasn't until about 9:45am that they finally let us in the building. After going through security, which has been accurately described as being like in an airport, but not needing to take off shoes, we were able to go into a side door. As a side note, don't bring anything bigger than something to carry your documents in. The guard was turning everyone away that had any sort of bag that was larger than a small purse. Clear bags that held paperwork were being let in. I watched the guard turn people away for 2+ hours, it is NOT a good idea to bring any sort of bag if it can be avoided.

    After the screening process we went through a door on the left side of the screening machine. You have to push the door and then pull to get it to open (there is a note on it telling you this). You walk down some stairs and come to a room with an elevator. This is where you can get Passport photo's taken for $10 if you need to. Get in the elevator and go to floor 23. You exit out of the back of the elevator when you get there so stand to the back left. When you come out of the elevator you can look at the ground and see arrows. This will lead you to window 14B where you pick up your number after presenting your appointment letter.

    We were called almost immediately even though we were C10. We went back together to talk to the first person and he informed us that the computer systems were still down and he wasn't sure if we would get an interview that day. He took our paperwork and told us to sit back down in the waiting area. At this time it was around 10:30am. Around 10:45am numbers were being called out of sequence and we were getting frustrated as some of the numbers called were for people that came in after us. After talking with some people there it turns out they were trying to convince all interviewees who lived in Montreal to reschedule as they still had to ETA on when the systems would be up.

    Around 12:30pm the systems came back up and Dodelyn was called to get her fingerprints done and to give them addiitonal paperwork (police clearances mainly and letter of intent). We were told to sit back down but we were now happy since the computer systems were back up and running. Around 1:30pm we got called for our interview window 17 (I think). We were interviewed by a man wearing a sweater vest with a full goatee and he was getting grey hair. He was very nice and made conversation at the beginning to try to make us comfortable.

    He asked us to wait a minute while he went through all the paperwork. he said everything looks great (made me feel good since I did it all) and then asked these questions...

    1. Tell me about your relationship. He wanted to know how we met.

    2. How does a relationship stay strong over such a long distance?

    3. He then specifically asked me where I work and what I do for a living.

    4. How long have you been dating?

    5. Have our families met?

    6. What do our families think of our relationship?

    7. What are our wedding plans?

    It seems as if I might be missing a question or two. I also thought that they only wanted to hear the beneficiary answer questions. I actually answered the majority of them. He seemed to look at me while asking the questions so I assumed he was directing them to me so I answered. My fiancee probably answered two questions only. He then pulled out the Welcome to USA letter and told us we were approved! I believe he was very skeptical of us at first but I believe there were two key questions we answered that won his opinion. When he asked how long we have been dating we both replied, almost in unison, "almost 3 years". He was noticeably shocked by our answer and even said "Really? Three years?". When he asked about our wedding plans I told him that we were intially planning a March wedding but decided to move it to January because we had family flying in from out of state for Christmas. If they flew in for Christmas they would most likely not be able to fly in for the wedding. Since we wanted everyone to attend we moved it up for them. So I think the length of relationship and family involvement in the wedding went a long way to our approval.

    We were out of there around 2:00pm. Things didn't go as smoothly as we wanted but the important thing is we got our approval! There is no way I could have done this without this website so Thank You to everyone that responded to my questions, Thank You to everyone that posted their experiences (good and bad) that helped us, and Thank You to everyone that asked questions that I haven't even thought about! Thank you so much!

  7. I am not Canadian, but I do need to vent. We received the letter letting us know that we can schedule an interview appointment. We did just that (with some trouble - payment was made and withdrawn but wasn't registered on the site) and we have an appointment for 11/28. It was great news for us! We made the appointment over 2 weeks ago and we have not received the confirmation appointment letter yet. I called DOS today to see where it was at or if it had been sent, it hasn't been sent. The lady, who sounded new and didn't seem like she knew what she was talking about, told me the case is in administrative processing. When I asked questions I knew I wasn't going to get answers to, she said that all case status shows administrative processing until the beneficiary is issued the visa. I do not know how their computer screen reads, but that didn't sound right. So I emailed the consulate and we will see what happens.

    I have already purchased plane tickets, made hotel reservations, and took time off from work so I can be there with my fiancee during the interview. I have no idea how long this administrative processing will take, since we are only a couple of weeks away from the interview. Now I am having thoughts of what to do if it runs long and we have to reschedule. I hope they will be able to get answer my email relatively quickly so I can make adjustments as needed.

  8. What if they are both met in person but did not consummated the marriage? What I read about that proxy marriage about consummated the marriage means they already had sex and make it a legally marriage. Does it mean they still choose spousal visa for en route to US after meeting?

    They will make an assumption that the marriage was consummated when 2 married people are in the same place at the same time. In this case, however, there is no questioning it was consummated. The OP is stating it was. Not only that but the OP is 6 months pregnant. The government can find out that her husband visited in May, which is 6 months ago, when the OP became pregnant. There is no trying to deny the fact that the marriage was consummated.

    Which visa was right for them depended upon what point the OP's husband called USCIS to ask. If he called before May, they probably told him to file K1 since the marriage would not be recognized since it was a proxy and not consummated. The OP took their advice and filed K1, which would have been right if he filed before May. He went to visit his wife in May, consumatted their marriage so now the marriage ceremony is legal and they can no longer file the K1 since the OP is already married. More than likely he didn't know that going to PI was going to make the K1 petition invalid.

    I agree with the poster that said find a good immigration attorney. This could lead to further complications and you two will probably need help.

  9. When the embassy received the petition they sent a letter out asking for proof that she is allowed to be in Canada legally. Although she is not a PR, she is there on a work visa. We mailed in copies of all the paperwork to them and there have been no more issues. So it doesn't appear as if you need to be a PR for the process to go through Canada as long as you can prove you live in Canada legally.

    What time is your interview on the 28th? Ours is at 1:45pm.

  10. My fiance moved to Canada in October of 2008. She is technically not a permanent resident. We have our interview on 11/28. I can say that up to this point there is nothing different about the process.

    I was worried that this might be a problem, so I front loaded the petition with as much relationship evidence as possible. During this process, we have accumulated so much more that we will also bring with us to the interview. I will post the results of the interview after.

  11. Well, I finally got it figured out...sort of.

    When we were scheduling our appointment online, the first page we came across asked for the MRV number. The first page only offered us 2 ways to pay. Either by Paypal or through Scotia bank. We choose paypal and did everything through it. This was confusing as the instructions said that the MRV receipt number is the MRV number. So we attempted to use that number and it was denied the many times we tried. After logging out and back into the website, the MRV number appeared in the account summary area. We used that number which advanced to the next page which again asked for payment, but we had more options this time; Visa/Mastercard, Amex, Paypal/Scotiabank. I picked the Paypal/Scotiabank and clicked next but it went back to the previous page with a message saying the MRV number is already in use or did not have enough funds attributed to it.

    There was a 'Contact Us' feature at the top of the page and it said if you have trouble with the payment screen or it is asking you to pay twice, email (i don't have the email handy right now). I emailed them on Friday and got back a response today saying "We don't handle this part, email the Montreal Consulate" and gave me the email address.

    I found a contact number and called it. I spoke to a lady and I explained the situation. She said that they have been having trouble with the website recognizing paypal payments. She was not able to help me in this capacity and gave me the same Montreal Consulate email address as the the email reply gave me.

    I emailed them and received the auto reply. About 30 minutes later I receive another reply that said, we do not handle these types of inquiry's, please email ***, which was the original email address I emailed. I am sure you can all relate to having something similar to this happen and feeling your frustration level rise.

    At this point I decided I am just going to pay the fee again to get the interview scheduled. I didn't want to miss out on the opportunity to get an interview in 35 days. So I call the customer service number to pay by phone since I heard an option to 'Pay K1 Visa Fee' as I was trying to get to customer service representative on my last call. I got to the point where I was able to input my credit card information but it did not work. I think this was mainly due to using "Magic Jack" and I have had problems with some telephone prompts before.

    I went back to the website and went through all the webpages until it asked for payment again. This time I selected the Visa option and everything went through fine. I had no other trouble in scheduling my fiancee interview appointment.

    I am still trying to figure out a way to get a refund for the first payment made by paypal. I know there are several places I seen while trying to schedule the interview that refunds are not given. I am hoping Paypal might be able to help get the money back, however, I knew when I paid the fee again that there is a good chance I will not be refunded.

    Whatever happens, I am just happy the interview is scheduled and we can move forward with the process.

    I share my story in hopes it helps others by alerting them to not pay by Paypal. It is not 100% reliable and you could have the same problem I did. Pay by phone or Scotia bank is probably the best options.

  12. We logged out of our account and logged back in. Under account details it gives the MRV # now. We try to schedule an interview and go through the process. When we get to the screen that asks to pay we type in the MRV# that shows under my account. This is the first screen.

    "If you have paid the MRV through Scotiabank, PayPal or through the telephone service, please enter the applicable confirmation number in the "MRV Fee Receipt Number" field for each applicant.

    To Pay in Cash at Scotiabank:

    1.Click on the "PDF" link next to the "MRV Fee Receipt Number" box.

    2.Print the electronic generated deposit slip for each applicant.

    3.Complete the relevant information.

    4.Take the deposit slip(s) to the bank and pay.

    5.The "MRV Fee Receipt Number" is located at the bottom of the Scotiabank deposit slip in the "serial number" field.

    ◦Note: Each applicant requires a separate "serial number."

    6.You can schedule your appointment the next business day after you have paid your MRV Fee through Scotia Bank. Any questions regarding the status of your payment should be sent to contactus_en_CA@usvisa-info.com

    To Pay using PayPal:

    1.Click on the "PayPal" link next to the "MRV Fee Receipt Number" box.

    2.Print the transaction confirmation.

    3.The "MRV Fee Receipt Number" is the transaction ID.

    If you called this service, the MRV fee receipt is the payment confirmation number you received from the automated system.

    We put in the MRV number in the box and it then proceeds to the next screen that says

    We click on the scotiabank/paypal one and it doesn't prompt for anything else, it just says the MRV# is already in use.

    I am even more confused now.

  13. I was wondering if anyone else had this problem and what they did to correct it.

    My fiancee and I were scheduling her interview appointment in Montreal. A webpage appeared and said to pay the $350 fee and gave us options to pay via paypal. We paid via paypal and were looking for the receipt number to use to schedule for interview. There was no email sent and the confirmation page when away quickly. I checked the transaction on the paypal webpage and copy/paste into the box that asked for the MRV number. The website said the transaction ID is the MRV number paying through paypal. However, I cannot get it to accept the transaction ID number that appears at the top of the page. It says "Pin number XXXXXXXXXXXXXXXXX is invalid for Beneficiary.

    Anyone out there can help? Am I not looking at the correct transaction ID#?

  14. Did sign the form to get text messages/email sent? Did you check to see if the check was cashed? If you got an email/text or the check was cashed I wouldn't worry to much about it. I have seen many people on here say they never received any NOA 1 but their application was in the system. If you signed the form to receive email/text and your check has not been cashed, then it is time to contact them to check on it.

    You have received replies from personal experiences which is what I know you want. You may want to try posting in your region forum to see if you can get responses from peeps that have experience with your specific consulate. Posting this question in the regional forum will probably get you better answers as all consulates are different.
