  1. Hey all,

    I Am waiting for an interview date for my AOS.

    I have read online that if you have had a medical examination over seas within a year of filing the i-485 then you don't have to retake the medical.

    However i'm worried i may get screwed over a technicality with this wording.

    I had my medical on the 16th March 2011 (Just over 11 months ago) and i filed my AOS within 5 months of that (within a year)

    I'm worried that when i eventually get an interview date i may get there and find out the medical has to be completed within one year of the interview and so i'll be over...

    Does this make sense??

    Can anyone clarify for me?

    So a few days ago i received a letter from the USCIS saying that because i had not called to reschedule i had abandoned my petition, my green card was denied, all subsequent work authorization and advanced parole was invalid, and i was now in the US unlawfully. FREAK OUT COMMENCES!

    I had been one of the few who had done everything legally (like everyone here) paying the $$$$$$ being apart from fiancé for ages, doing more interviews, scan, fingerprinting etc etc than i can remember, not working, Basically doing everything right, and now because i was ill and didn't take the sickness that was causing me constant vomitting and diarrhea into a government building, at the last step, i am now illegal. Was feeling pretty angry.

    I called the USCIS and told them what had happened, explained i did call to reschedule and had a confirmation number to prove it. The Agent on the line took me through all the security steps to get into the account and then told me that a denial was not on my petition, but rather the most recent action taken was back in January when they first scheduled my interview. Then as we were talking she said the system was saying a letter had just been sent to me (not from her) RE my application to reschedule. Proving again that i did call. She said i should send back both the coming application letter and the denial letter to the USCIS so they could decide what to do.

    OK.

    So i got the mail today and the USCIS letter was there. only it doesn't say application for reschedule, it says "we will reschedule this appointment and a notice will be forthcoming" meaning they are already going to do it.

    So my question,

    Do you think i should mail in the letters like the Agent on the phone said.... or just wait for the appointment notice and go to it, ignoring the denial letter.....?

  3. I would go to the interview, wear a mask if coughing, do not reschedule. Tell the IO you are not well.

    After all this i wish i had lead down in the back of the suburban, got my wife to drive us there, stumbled in wearing my PJs and Gown, and thrown up multiple times in the office making everyone else ill too, just to make a point that the system could possibly be flawed... although then i'd probably be charged with bio terrorism.

    Too late now, just got to wait for what happens.

  4. Hi All,

    I was supposed to have my interview today at 9am, but for the last few days ive been getting sicker and sicker, i left off calling to reschedule hoping i would get well enough.

    As of this morning i'm still really Ill. i called the number on the appointment notice (before the interview) and one of the handlers put in a request for interview reschedule due to sickness.

    After doing that i have now read that this can most of the time lead to denile.

    I'm now feeling really frustrated.

    What happens if my AOS is denied?

  5. So i got married on a K1 Visa within 90 days, and now i'm sending off AOS, EAD, and Advanced Parole.

    For the AP i-131 form, question 7 says to explain how i qualify for AP.

    My Grandmother has been diagnosed with Cancer in the UK and i would like to be able to go and visit with my new wife before she dies. What am i supposed to write? is it just that line or is there some sort of numerical and letter code im supposed to use?

  6. Hi everyone.

    So, i've been away for a few months adjusting to life in america, getting an apartment, sorting out potential employment opportunities for when i have my EAD...oh and getting married lol.

    now i need to send off my AOS packet and one area has me confused, the medical.

    I've read conflicting reports on what i have to do from various sources online. I had a medical in london for my K1 visa at the beginning of this year. now some places say i dont need to do anything and should ignore the medical part, some places say i need to just send in my vaccination history from london saying i have all the upto date shots, and some places say i need to fill in part of the form and go to a civil surgeon... which is it??

    If anyone from england who has done this could shed some light that would be great!
