The following link Form M-480 says that:
A person have resided in the district or state in which he/she is applying for citizenship for the last three month.
My understanding that going to Mexico invalidates this requirement.

Can someone explain the 90 days rule of continuous presence in the USA before an eligible green card holder can apply for citizenship (N400)?
My wife's eligibility is coming up on 12/5/14 and we were hoping to submit the N400 on 9/5/2014.
However we are travelling to Mexico at the beginning of August and will return to the US on 8/15.
Is she eligible to apply on 9/5/2014 or will need to wait until 11/15/2014?

Hi all,
Back in September 2013 we applied for the condition removal (i751) as my wife's and her 2 daughter's temporary green cards are set to expire on Dec 5th (2 years wait). We got the 1 year extension letter before the government shutdown and now are awaiting the interview or the new cards.
I want to start planning for applying for US citizenship for my wife and possibly her daughters. I am very confused about my wife's kids eligibility for applying for US citizenship. Especially I want to know if the kids are eligible to apply for US Citizenship together with my wife (after 3 years).
Next year the kids ages will be: 12 and 15, which according to some sources enables them to apply together with my wife, however the eligibility requirements on the INS site state that the person must be 18 years old. I also read about filing form N-600 to apply for the certificate.
I have not legally adopted the kids, therefore I am not eligible petition for them, only their mother will be able to petition, after she becomes the US citizen (possibly 2015).
Can someone familiar with this process shed some light on this? Any advise would be great.

What is wrong with coming to the USA to have the baby delivered? I suspect the chances of complications during delivery are much lower in the USA than in India. So we should encorage that.
After reading few comments in this thread I begin to think that people put too much thinking into why the future mom (congrads!) will be denied entrance at the POE. What is wrong with the wife traveling to the USA with her husband? My wife often travel with me and I would encorage her to come more often. Do we have any statistics covering cases when an immigration officer refused an entry into the country to a pregnant woman because of a suspicion she will give birth on US soil?
Also, the other discussion that seems to be quiet misleading is related to potential hidden immigration agenda. I have a neighboor from Chile - she works as a clerk at city hall. Her son goes to city college. He was born in the USA. The mother does not have a green card, her tourist visa expired years ago. She has a driver license, SSN and a decent paying job. He has a great meaningfull life here (California).
Or simply look at Obama's uncle. He is undocumented, but has a job, broke the law by driving drunk, but still remains in the country.
I doubt you will have any problems. Again, congrads and hope you make the right decision that is best for you and your family.

If my wife were to install a keylogging software on my latop to track my online behaviors I would leave her immediately. Anyone who does that is sick. The "healthy family" would have come to the end the moment such demeaning idea would cross my mind. I am socked at what people on this forum suggest is to leave her. She is your wife and its is your responsibility to ensure your family life is healthy and meaningful. Sorry pal, i suspect the problem is with you. Have you thought of that?

Why so desperate for a B2? Because I want to see my daughter and be at her wedding. Without a doubt, my mother would feel desperate as well if her first visa application would be denied. Such "stupid" advise to just walk away.

My 54 years old aunt just got a visa at the USA consulate in Moscow. No real ties to Russia other than an apartment and a low income job as a teacher. For every question related to the why she is going to the USA she replied "shopping". She was honest and that, of course, worked.
As per the original post, perhaps your family political posts got something to do with the denial?

We got same letter last Novemember. I spent hours looking for my birth certificate (in Russian) and the immigration officer did not ask for it.

While back someone posted a reply to my question on whether we should get married in the US, while my fiancée was staying with me on B2 visa. The volume of answers we got suggested not to get married here, as it can potentially complicate things in the future (now the past). Since my fiancée was required to return home regardless of us getting married, we decided to wait and have her fly back home and for me to apply for the k1 visa.

So what if Sophie0129 was in San Diego or Seattle and walked across the border on the 90th day and came back in 15 min? Would that be sufficient to satisfy the VWP requirements?

My feedback for the AOS interview in San Francisco (today).
We arrived early, 45 min before the interview. there were 4 us: myself, the wife and 2 kids. All had 3 separate interviews scheduled one after another. After registering with the front desk, we waited until an officer called our name. He took all of us at once.
He started with the wife by going over the entire application. Then he went to the computer and pulled POE arrival/departure records for each and every trip, including the most recent one.
Then he repeated the same for the kids. Usual questions including the names, street addresses, etc.
After verifying the i-485, the officer began asking "real" interview questions:
(me) When, where and how me and my wife met
(me) When you came to see your wife where did you stay
(wife) You visited USA multiple times. Why?
(wife) Who where the kids with while you were in the USA
(me) Where did you get married?
(me) You did not have a ceremony. Why?
(me) Do you have pictures?
(me) Who are the people on some of the picture?
(wife) Who are the people?
(kids) Who took these pictures?
(kids) Where is this picture taken?
(kids) When did you meet your step father?
(me) Do you have a joint account? Show bank statement
(wife) What is this charge for? (both were school related)
(me) What is another charge for? (both were school related)
(wife) Honeymoon?
(me) Home for New Year? Please show tickets.
(me) Are you aware your APs are not valid and you will need to go downstairs to get a stamp?
(everyone) you are approved.
Total time spent at the interview: 45 min
Went to get an infopath appointment.
Total time spent waiting for the stamp: 3 hours 15 min.
Regardless, the wait is over. We are pretty happy to be done with another important step.
My advise to have as many pictures + stories, but try to have as many pictures as possible spreading throughout your relationship.
Now my question: While we are waiting for the cards to arrive, how many years will the GC be valid for? 2 years for the wife, but what about the kids (K-2)?

The card seems to combine both EAD and AP. It says the card serves as I-512 advance parole. Anyone else having this card?
The other AP petitions (for the kids) were also approved and look like a letter.
Is it ok to travel with this card?

I know you found a link, but I can tell you that my wife's EAD/AP card arrived 9 days after we got the approval text.
the AP documents arrived on Saturday. Sadly only 2 out of 3 APs arrived. Not sure if the missing one got lost in the mail or something else, but it just sucks not to have everything on hand.

Super excited about the latest news from USCIS:
"On November 29, 2011, we mailed you a notice that we have approved this I131 APPLICATION FOR USCIS TRAVEL DOCUMENT. Please follow any instructions on the notice. If you move before you receive the notice, call customer service at 1-800-375-5283."
But how long does it take for the AP documents to arrive at the house? Does it take days, weeks or months?

I just asked when to expect the results of my wife's petition. They did not want to speak to me so I had to do a 3 way calling with my wife on the line. As I said it the conversation was less than a minute.

My understanding is that if you were approved on the spot at the intrview you get a stamp in your passport. you can use that instead of your AP to re-enter. If you did not get approved and if more security checks are required, then you can leave and re-enter using your AP. AP is valid for 1 year. Make sure you get in to the USA before it expires.

I just only submitted our marriage certificate as evidence in our AOS. My POE was on Sep 2 and we just married on Sep 15. Our interview will be on Dec 22 and I have got notification of my EAD and AP on Nov 23.
Timeline of everyone may differ from each other due to certain reason, I think. Your case may be same to those who got their AP and EAD together with their GC approval. You will get it on time. No worry... just be prepare for your interview.
I called USCIS and asked when the AP and EAD card will be reviewed / updated. They said the case is under review. at 3 PM PST I got an email stating that AP is approved and EAD is orderd.

I'm a Sept. filer too. The date on my NOA was 2011-09-27 (a day earlier than yours). My case is still under initial review. I received no other news or update since my walk-in biometrics, which was on Oct. 7. So, I don't know if this is normal waiting time but I can only assume it is..
ivana we are a bit more lucky. our AOS interview is in 2 weeks, so there is some movement and the USCIS website reflects that. However the AP and EAD are stuck in the initial review. I do not mind calling the USCIS and asking what is taking so long, but I begin to suspect USCIS flagged our case for some reason. Not sure we are called for the interview, but perhaps the interview is required for the AP to get approved. But then, you do not have the interview, right?
We were guessing why we were selected for the interview and the only reason I can think of is that we did not submit any evidence with the initial AOS package. Were we required to do so? Or may be there is something else?
Also, we have 3 interviews: the wife and 2 kids. Based on the appointment time it seems there will be three interviews. What questions will the kids (9 and 12 yo) be asked?

Expecting AP any day now. NOA1 date 2011-09-28. The AP was sent together with the AOS and EAD. AOS interview is on 12/12, but we were expecting our AP to arrive before thanksgiving and make Christmas vacation arrangements as soon as possible. For some reason the AP is not getting approved (at least I do not see any updates on the USCIS site). Shall I call USCIS and ask what is going on? How many september filers got their AP?

When did you get your NOA1? Usually when someone gets an interview before AP or their EAD it means their case is just moving quickly. It wouldn't be an evidence thing as pretty much all AP requests are approved unless you forgot something on the application (and then you would get an RFE). Even people with long overstays who can't use AP get approved.

I am sure this has been asked before. Apologies in advance.
I am applying based on 3-year rule, marriage to the USC and have two N400 questions:
- Part 8: Time outside the USA - Do I substitute 5 years with 3 years? I have arrived on K1 on 8/6/2011. The confusion is whether I need to list any trips before the arrival to the USA. The answer is probably no, but I want to check
- Part 9: Information about your marital status - I have been married once before and I am currently married. Do i put 2 in question #3?
