  1. You make a good point, she could very well be living in the US and traveling to Mexico daily/weekly?

    But as you said I will never know, I will simply inform ICE that she abandoned our home 5 weeks after receiving her CGC, and is not living in the USA. They can investigate or do nothing I really don't care, Once we are divorced she will need to file a waiver with ROC form, there will be no proof of a bonifide marriage since she left right after receiving her CGC.

    Just take it one day at a time, it took me 6 months just to begin to write the letter to ICE, I probably would not have even written the letter if it wasn't for the support of a few good friends and reading the posts of other people on VJ who are going thru similar situations.

  2. correct, I plan on filing for divorce this year, I'm still recovering financially from the cost of the entire AOS process.

    Her 6 months out of the country is coming up fast plus she is working in mexico as well and has enrolled her two children in Mexican public school, this seems convincing evidence she does not plan to establish residence in the US, I think?

  3. so sorry to hear, same thing happened to me, my wife left within a month of getting her GC. I have not filed for divorce yet, the advantage I have is that she went back to Mexico and is not living in the US. I'm in the process of writing a letter to ICE of her abandonment and not fulfilling her permanent residency requirements.

    Just move on, it sucks but like everyone says Karma is a B****.

  4. can i schedule my fiances interview date with just her passport number? or do i need to have her kids passport numbers as well?

    Yes you will need the kids passport numbers aswell if you plan to schedule your fiances interview at the same time as the kids interview. If you plan to have the kids interviews at a later time then all you need is your fiances passport for now. When I scheduled my fiances interview, the system asks if you want to add family members to that interview and then asks for each childs passport #'s aswell as MRV #'s (payment receipt).

  5. Wow. K-1 multiple entries? Uhmmm.... A supervisor that has no clue at all about the visas they are supposedly trained to deal with? Great. :wacko:

    You can always have the bigger ceremony for friends and family later.

    I think you should still call your nearest deferred inspection site and let them know what happened and if you can get a corrected I-94.

    Thank you to all for your advise and support these forums are an excellent source of info.

    Just to update I went to the Deferred Inspection site at the Tucson Int. Airport and they corrected the problem, apologized for the "lack of trained CBP officers" (actually used stronger words to describe the officers) and called over to the CLX POE while I was waiting for visa stamps, and informed the field commander to please find all the officers involved in this ordeal and correct them.

  6. You should have asked for a supervisor.

    You COULD just get married before it expires and then file AOS when you can, but if you go that route, I would still get the I-94 corrected before filing for AOS. They made a mistake and they should fix it.

    A supervisor did show up because there had been a shift change and the original officer that was working our case since 3pm left (it was now 7pm) and the new officer was confused as to what exactly she was doing. The supervisor started explaining to us and her that we only had 7 days to get married and he even said that K1 visa holders can have multiple entries until they get married and then it is one entry only. When I heard this I knew something was wrong because there is no way a K1 holder can enter the USA multiple times. But by now it was almost 9pm, her boys were sleeping on the steel bench (K2 holders) we still had a 4 hour drive to Tucson and I had to be at work at 7 in the morning..we just wanted out of there!! Plus I could see that no matter how hard I tried to explain the 90 day rule they were not going to change it.

    Thank you all for your help, we have decided to get married before the I94 expires, I called the courthouse, arizona has no waiting period, so we will get our marriage license today, and the next available wedding time is friday 5pm which I already reserved. This seems like the less frustrating way to go and I'm not complaining it's just that this is not the wedding we were planning, the rings will not be ready for 3 weeks, all my family is in california so they most likely will not be here on such short notice.

    Oh well.. thank god we are finally together...

  7. Well after almost six months of having my fiance's K1 visa approved we finally activated it yesterday (apr 23) thru the Calexico CA POE. After much confusion and me politely explaining to them the instructions given during the interview at the Consulate in CDJ, they totally confused us.

    They claim that we only have 7 days from entry to get married because our K1 visa was issued in Nov 2011 and expires Apr 29, 2012 and we waited to long to activate it??? We explained that the Consulate in CDJ said we had 6 months to use the visa for 1 entry and then 90 days from entry to get married. We were ok because we entered yesterday Apr 23. I read the Department of State website again and the forums and no where does it say the K1 visa is valid for 6 months and the 90 days are included in the 6 months. The DOS page says " couple must be married within 90 days of entry into the USA"

    Can anyone clarify this? The worst part is that the I94 they stapled to the visa expires in 7 days they only issued it for the length of the K1 visa so it says valid till Apr 29, 2012 and this is why we must be married before Apr 29.

  8. hi there i soon will be in your shoes to...also going to juarez there is a lot of storys out there but if you have read the reviews from juarez i think that should calm your nerves and thoughts..just like any where in the world there is danger but sadly in juarez the media shows the worst..dont go ddown there to hang out u might be at the wrong place at the wrong time..from what i have read police are every where also districto federal agents wish you the best of luck.. :thumbs:

    I was in CDJ both in Sept (8 days) and Oct (2 days) and drove my vehicle with AZ plates into Mexico. Around the consulate area is very safe, plenty of security. If it was not for the news each night you would not even suspect the city is so dangerous. Just a reminder: DO NOT listen to the coyotes outside the medical clinic, ignore them and continue walking to the gate where the guard is.

    I accompanied my fiancee the entire time, just to help out and be supportive, it really helps being together and I ended up having to be interviewed aswell by the consulate so it was good that I was already there. Read my post in consulate review.

  9. No longer a minor(18 1/2). Well the point of this post was to ask if what we had was proper id.

    We kind of had the same problem picking up our K2 visa for minor, the consulate took the birth certificate and passport (which is inside package). DHL in Mexicali BCN said we had to present a certified copy of the birth cert. not a photocopy, so we went down to registro civil and got a new copy ($600 pesos for rush service) the same day, my fiancee only had to show her credencial de elector.

    Maybe you can call your DHL office and ask?

I guess if you don't have any kids (K2 visa) or previous marriages that might trigger the consulate wanting to interview the petitioner, as in my case (you can also see my review) it is not necessary for the petitioner to be at the interview. I just got back on monday (oct 24) from our 2nd trip to CDJ and I felt very safe around the consulate area. It does help not being alone, my fiance confessed that she would have fallen for the scam the coyotes pull on you outside the medical clinic.

  11. Is this still the case? If we get the letter in the US can we scan it and send it via email to print in Mexico? Is it needed for the interview?

    Yes, this is what is called your invitation letter, you will need it for medical exam, CAS fingerprints and consulate interview. I made 3 copies here in US and gave to my fiance in Mexico, she never received anything in Mexico via postal service.

  12. Maybe this helps? I spent 8 days in Juarez last week and drove my car around the city, we went to several malls, supermarkets (S Mart is great) downtown to the cathedral and I felt very safe. People were out going about there daily lives, everyone was friendly, around the consulate it is very safe, no problems, except the coyotes. Yes I watched the news every night and on average 6 murders per day, 20 on the weekends..I never went out at night, just use common sense, you'll be fine.

  13. I just got back from K1 interview in Cd Juarez on monday, all they took was my I134 with a copy of my employement letter and 6 recent paystubs, they did not even ask for tax returns. They did not even look at my birth certificate (I'm petitioner) or my divorce decree (I was previously married) or letters of intent to marry. But then Both me and my fiancee were interviewed which I guess does not happen often to K1'ers. More on my story posted in consulate reveiw section.

  14. Ours was just the invitation letter, we downloaded packet 3 off the CDJ website.

    When you schedule your ASC and interview they show you a calendar with available times and you pick, usually as soon as 10-15 days if you so choose. This calender kind of reminded me of the SRE website to schedule an appt. to apply for a Mexican passport.

    Primero, su amiga esta tramitando K1 o CR1? Dices esposo, ya estan casados? Si estan casados no pueden tramitar la peticion K1/K2.

    Yo solo tengo experiencia con K1/K2 tramites. No confundas la peticion con la visa son dos cosas diferentes. Primero se hace la peticion K1 y pago de applicacion, los ninos van incluidos en la misma peticion haci que no se les cobra solo benificiaro/a. En la NOA1 que recibe del USCIS solo vienen los nombres del patrocinador/a y benificiaro/a con numero del recibo de pago.

    Despues cuando ya tengan aprobada la peticion (NOA2) se manda al NVC que lo manda al consulado donde van a tramitar la visa, es cuando se los cobra $350 por cada uno, mas todo lo que pida el consulado en su pais.
