  1. Everything else being equal, that is correct. Bring copies of your entire AOS application packet, including the marriage cert, as above. Lots of people use AP documents with no problems at all.

    You don't want to stay out too long though, and you want someone responsible collecting your mail, in case you get an RFE or interview notice from USCIS while you are away. You will need to be able to find out if you get any mail from USCIS, and what it says, as soon as humanly possible, in case they send you something you need to respond to immediately, or an interview notice. Depending on the timing, you may have to return to the US early. Be prepared for that.

    But yeah, if you have an AP document you should be able to go to for a week or so and come back with no problems at all.

    Not necessarily. If you have issues such as a previous overstay in the U.S., CBP can deny you re-entry. In fact, CBP can deny entry on the basis of anything that the consulate asked (or could have asked) in the visa interview.

    Therefore, be sure that you're squeaky-clean before you leave the U.S., if you hope to achieve re-entry by using the AP document.

    Furthermore, if you plan to use the AP document, be sure to take a copy of your marriage certificate with you, to present at the POE along with the AP paper.

    Happily, the green card ensures a much smoother re-entry than does the AP.

    I never had an overstay in the U.S so i guess it helps

  2. It's not so much a matter of time, but of documents. In order to get back into the US after you leave, you will need either an AP document or a Green Card.

    The AP document will typically show up 6-8 weeks after you file for it [which you do along with your AOS], which should be done as soon as possible after you marry. If you can prove that there is a major emergency that requires you to travel as soon as humanly possible (and the only excuse they usually accept is a dying relative back home) you can arrange to get an AP document in 3-4 days by taking proof of the medical emergency to an InfoPass appointment. But that only applies for real emergencies.

    The GC will typically show up 4-6 months after you file for it. The GC replaces the AP documents when you get it.

    Do not leave the country without at least one of those documents in your hand.

    So, with the AP document I can leave the country for some days and then comeback without any problem?

  3. Why shouldn't they whine? 10 months is ridiculous. I've said it before and I'll say it again...your "friends'" case is not the norm, stop pushing it on people like it is.

    Feg, I know the process sucks. This fall, CSC completely stopped processing I-129Fs and none of us knew why. It's so hard to wait but your NOA2 IS coming and it'll be even sweeter when it does arrive. Once you get that, the rest of the process moves a lot quicker.

  4. I just have called USCIS and i spoke with a very nice gentleman who advise me that if I have not received a notice by dec/23 to give them a call back !!! If you beleave your five months are over call them to see what they can do for you ! I will wait to DEC/23 to give them a call back !!! Good Lucjk !!

    It is a good new, Hope on dec 23rd we can get our NOA2!!

  5. you know how it works?if your service center has got backlog,your petition is put on hold for five months,right before you hit five months they bring up your case and go through it,if not,you get forgotten like terezee and myself.

    the reason both CSC and VSC got backlogged in the first place is Haitian petitioners.their cases are considered " humanitarian "

    Can you explain me please, why they are taking in the first place haitian petitioners?

    Did not we all deserve attention too? We are many people waiting for the visa to be with the people we love and why we must expect more of the indicated time just because they are giving preference to the Haitians?

    I can't undertand this preference!!

  6. I'm sorry to have given a wrong answer, when we sent strategic application in the USCIS website was saying that we had to send directly to Vermont, that is why we sent there, that was in July 2010.

    I did not know that in these months that instruction had changed.

    I just review again and now says : Mail the I-129F Package to the USCIS

    You should mail the completed form(s) to the USCIS Dallas Lockbox. Mail the package with return receipt requested / delivery confirmation. Send via USPS.

    It was not my intention to give a wrong answer, I just answered according to my experience

  7. sorry. i know this has been addressed before. but i can't find it. my fiance is getting a little stressed out again about our filing of 129f. we will be working togehter on it in china in early january. But seeing how i live in rhode island i know my service center will be in vermont.Should i put the address of vermont on all of our documents?or maybe just on the cover letter? pleas advise:-)...thnaks so much todd

    My fiance live in Houston and he sent the I-129F application directly to VSC and we receive our NOA1 after 7 days! You don't need to send your application to texas!

  8. :blink: were you actually planning to have the visa in Jan? we got our NOA2 in 3 months but got delayed a month at NVC and then 8 months of AP.. so dont make plans for any specific time frame... the DoS has a way of ruining plans...

    I just wanted to take advantage that my family going to be on the US on vacation, they are going for christmas, new years and other events!!! Hate this waiting :(

    Did anyone receive NOA2s for July??

    I129F Sent - 7/23/2010

    NOA1 Received - 7/28/2010

    This is the 5th month, so hoping to get something...!

    We sent our I129F on July 22nd and recived NOA1 on July 29th and still waiting for NOA2.

    It seems that VSC has not given any NOA2 in November, Hope and We can recive our NOA2 this month because I'm going crazy with this waiting.

  10. We're still waiting too. I looked at the statistics and it looks like in June they went nuts giving out NOA2. According to the people on Visa Journey, not too many people have received their NOA2 for VSC since June. I looked at November and it appears only a hand full were given out. No one from Vermont has received an NOA2 in December.

    Anyone knows what gives??? Like why the slow down?

    It’s really frustrating that if they drag their feet they’re really messing up people’s lives…

    I am looking for advice regarding medical exam and vacs specifically for the Lima embassy. From what I have read, the Medical exam is $95 and does not include vacs. Some of the vacs may require 2 or 3 doses....is it possible to have the vacs done before the medical or does the same doctor for the medical need to determine what vacs are needed? I read the vacs are good for 1 year, so we should be good if he gets them now. My fiance does not have access to any prior vac records. Of course I am trying to avoid extra months of waiting for shots! Can anyone offer advice or experience with this in Lima?

    You or your fiance/fiancee have to wait 'till the medical exam to know if need any vac.
