Got it, thanks. We will answer YES and provide a brief explanation as to why and that we disclosed all this information in the 601 waiver we filed years ago.

Finally it's that time we are applying for my wife's citizenship (or she is applying for herself more correctly). We are finishing up but I keep revisiting Part 12, #22 "Have you EVER committed, assisted in committing, or attempted to commit, a crime or offense for which you were NOT arrested?"
My wife was in the country illegally before we got married. We disclosed that from the beginning, and then received the 601 waiver and were able to process her k1 visa, LPR, lifting of conditions, etc (see my timeline). All the process since receiving the waiver has been smooth.
So my question is do I mark YES for #22? She was never arrested, deported, etc. She left the US willingly so we could start the process of the K1, etc. And again, we have disclosed all this info to USCIS many times before, so it is not secret. I keep thinking we should mark YES, but I just want to be sure. Thank you!

Hi Miguelzo. I can't advise on what you should do. My wife had to do a waiver but it was only for prior illegal presence, not misinterpretation. I do think it's pretty complicated. If you haven't already, I would check www.immigrate2us.net as they focus more on waivers than visas. Also, I would call around to 2 - 3 lawyers, you can find several who will do a free consultation on that same website I mentioned.
My wife's case was difficult and complicated. We were faced with the same dilemna of if I should just go to Mexico or try the waiver. After a lot of research, we decided to try the waiver and it worked out (but we were denied once), so we had to do two waivers actually. I would just get as much information as you can before you decide what to do. Good luck.

Thanks. I've researched this as much as possible and I'll just get the vaccine portion filled out. If they require the exam then I understand we will get an RFE and we'll handle it immediately if that happens.

Hi - my step-daughter has pretty much all of them since she is 11 and she needed most of them before she could enter the school system here. My wife, however, has had them done in the past as a child, so she might need some of them again. But they did the TB test and all that two months ago for sure in Juarez. Thanks.

Well I went ahead and scheduled an appointment for the full medical on Monday. I'm in the SF Bay Area and they quoted me for $150 each (my wife and step-daughter) plus any immunizations that may still be needed. Does that price sound about right?

Hi VJ members. I've been gone for a while, but we finally got I-601 approved and fiancee (now my wife) and step daughter are here with me now.
We have pretty much all the documents prepared and ready to file AOS. However, I am really confused on the medical exam requirements still.
They were at the Consulate in Ciudad Juarez in September 2012 and did their exam there. I don't have a copy of a DS 3025, we only had whatever they submitted upon their arrival at POE.
I'm unclear of what we have to do in terms of the I-693? Do we have to do a whole new medical again for each of them? Or do we just need the vaccination part of the form updated by a civil surgeon and signed and sealed?

How did it go with the kids medical exam? I have an follow-up visa appointment scheduled for my fiancee and her daughter on Monday 09/17, so I was wondering the same thing. If you do the medical on Friday, is it ready on Monday? If so, I may reschedule the appointment for Tuesday 09/18 just to allow an extra day. I hope everything went well as it looks like the appointmnet was yesterday, 08/28. good luck.

Hi all,
I've been gone for almost a year, but fiancee's waiver was finally approved! We need to go back to CDJ for a follow-up appointment. I had a question about the medical exam for my fiancee's daughter (11 years old). If we do the medical exam on a Tuesday, the results should be ready by Thursday afternoon, right? We don't have the visa follow-up appointment until the following Monday, so even if it's ready on Friday, then that's ok, but I just want to make sure. Thanks. And it's good to be back!

Here's my situation. My husband's interview was on March 8, 2011 in Cuidad Juarez. Then his waiver interview was at the end of April 2011. On May 13th we received an RFE. Sent that information off on June 14th. They have recieve all the information. The RFE says it will take 12 months to receive a decision on our case. My husband has been in Mexico for five months now & I'm getting impatient. Is everyone's wait this long? Do they really take 12 months? I've tried checking uscis, their last listing says feb 9, 2009. Where else can I check for updates? Thanks, for your help.

If you haven't already, you want to register for an account at www.immigrate2us.net. This website focuses more on waivers. The best way to check for updates is actually post on that site and ask others who also had waiver interviews in April 2011 if they are still waiting or what? That would probably be the best info available. Good luck!

my fiance was just denied and we are doing waiver through Juarez as well. You should have received your reason for denial, and a checkbox stating that you are eligible for the waiver. You'll have to schedule a separate waiver appointment. The wait time is about 40 days. For example, my fiance was denied July 15 and our waiver appointment is August 31st.

I had something similar but luckily nothing sent to nvc or any other government emails. Change passwords on the email account immediately and make it difficult, not an easy password to break into. Hopefully that works.

Great, thanks Edgar. We are doing ASC this afternoon so we will do the pictures while we are there anyways. I have my fiance and her daughter so I guess I should expect to pay about 240 pesos. We did already do DHL and have all forms complete so I will be sure to ONLY get photos. Thanks.

Hi Edgar. Great review, thanks! I'm here in Juarez now going through K1 for my fiance and K2 for her daughter. I have one question from your post. You said that your fiance's photos were the wrong size. What type of photos were they? like the style they give you for a Mexican passport? also, where did your fiance end up taking the photos at? I'm thinking maybe we should take photos just to be safe, but I'm not sure where and I'd like to avoid the dirty coyotes if possible. Thanks a lot for your post!

1) copies are fine, I just had my interview and did not need any of that. However u bring EVERYTHING you might need and copies are ok.
2) I dont really know if it matters. I did not staple them. just put them all together with a paper clip.

1) do my W2s need to be originals, or are copies fine?
2) should I staple the forms that are more than 1 page (i.e. the DS 156)? Or just leave them as is?

You will take the original birth certificates to DHL along with fiancees ID (like electoral card...since she won't have passport they have it at DHL) you can not go into DHL with her, she needs to go in alone but you can wait outside)
when you put your finacial info together put your tax from 2010 right under the I-134 afidavit of support...then put 2009, then work stuff. They keep all your finacial stuff & I think they just quickly look at what you earn...at least that is what happened to us!
The confirmation letter you are talking about is the confirmation email , right? cuz that is what we needed.
Go with you fiancee everywhere & wait outside or go in where ever they let you (like at Medical) They coyotes try to get you the first day outside the medical they are fantastically organized jerks, with shirts printed up to say they are with the medical places, they have ID & everything. TALK TO NO ONE UNTIL INSDE MEDICAL BUILDING!!!
I recommend two originals of birthcertificates so you can bring a copy here to USA for school or any other thing you may need it for.
Great, thanks! Yes, I used the discount for La Quinta, so we will save some $$$. Yes, the confirmation letter is the email I am referring to, so I have that as well. Good advice on the coyotes. It is my fiance and her daughter, so I am going with them everywhere, I don't care if I have to wait in the hot sun while they do they're stuff, I don't want them out there alone. Thanks!

I have filed for my husband for a green card and we are just waiting on the interview date in mexico, so far up to this point i have been able to do all the paper work myself. but he is where i get confused, do we have to wait to be told to file the hardship letter or do we just have that ready for when we have the interview? and second question is the hardship letter and the i-601 go together when filing? and others have been talking about an apology for being in the U.S, does anyone know what they are talking about? (or is that part of the hardship letter?)
Hi, you're post is a bit confusing but I agree with Sergi 9. It sounds like you did I-130 petition. Your spouse will eventually have a regular visa interview where he will be denied for whatever reason and then you may be allowed to file the I-601. You can not do the 601 until you have the first interview (which will be a denial of the visa).
You probably want to check out www.immigrate2us.net as they are more focused on the 601 process (especially mexico) and you will find great information there. It's also not a bad idea to consult with a qualified attorney about this. Some consultations are free, others might run $150 - $200, but it will give you a lot of good information. the above mentioned website also has good feedback on lawyers as well, so as to make sure you speak with someone who knows what they're doing, not someone who just wants your money!

Looks very complete to me!! The ASC wont give u anything, they will just put a sticker in your DS-260 and thats the one u will have to take to the interview.
and as nikolacolada said, dont forget the intent to marry letters, especially YOURS (the petitioner) and the Juarez intent to marry letter for ur fiance UNSIGNED. GOOD LUCK!!

that looks good to me... I'm not sure if it's required but there is a letter of intent to marry at the end of this document (http://ciudadjuarez.usconsulate.gov/root/pdfs/pk1iv.pdf).. I stuck that in with my fiances papers to bring to the consulate, I figure if they don't need it than they won't use it, but at least he has it if they do want it.

I'm trying to remember since I did it last week, but I think it was the following:
- Immigrant Visas.
- then click "Non-Immigrant Visa for Fiance of Citizen (K1/K2)"
