  1. Hi, I've been told and heard that income at a level of 125% above the poverty line is required for the last 3 year's in order to be a single, solo sponsor. However, all paperwork from the USCIS reads that only the LAST year's federal taxes must be 125% of poverty line.

    Last year was my first year as a professional, and my taxes were well above the poverty line. My current income (got a promotion in February YAY!) is even furter beyond the poverty line. However the two years before that, I was a student and fell far short.

    We had co-sponsor application and everything for the Fiance visa. The associate at the Embassy shred the co-sponsor's application and said that my income was more than enough to sponsor my now husband alone.

    Are we going to get stopped with the AOS process because I only have one year's history meeting the income requirements? EVEN THOUGH ALL the literature FROM THE GOVERNMENT states that one year is enough???

  2. Hey Guys! I'm back! Let me invade this post again and would like to share my good news!

    My Fiance just called me after his interview! Guess what???

    He gOt approved!!! yay! I'm really happy right now. For all of you guys who are still waiting, I know it's really easy for me to tell yah this but just don't give up.

    Your interview was a month after your NOA2!!! THAT'S AMAZING!!!! I'm so happy for you guys! CONGRATULATIONS!!!! And Merry Christmas! Happy Holidays or whatever brings joy to your December!!

  3. PS Spoke with an Immigration Officer at the USCIS. He told me that the 864 Affidavit of Support docs ARE needed at the interview level--at least in Spain anyway. I know we had had questions about that earlier. Thought I'd let you know! He says that it isn't listed as a document needed, but that it is needed. Maybe have them prepared just in case?

  4. WAHOO!!! NOA2 email yesterday, 12/7!!!!!!!!!!!!! Exactly one week from the receipt of my RFE materials. They asked for proof of citizenship, proof that we've met in the last two years, and intent to marry. (I included all those things the first time, but WHATEVER.) So I mailed back copies of both my and my fiance's passports, letters from friends, coworkers and my pastor, emails/contracts for wedding related stuff, screen shots of photos w/digital dates from media card, and a pleading letter! Hahaha...Either way, WE GOT APPROVED! And now it's on to the next round!

    Some friend from work surprised us with plane tickets for my fiance to come for Christmas/New Year's/our birthdays (mine's the 23rd and his is the 25th of Dec)!!!!!!!!! They knew we couldn't afford a trip and got together and bought it themselves!!!!!! So my BABY IS GOING TO BE HERE IN TWO WEEKS, arriving ON my birthday!!!!!!!! What an AMAZING December this is shaping up to be!! GOD IS GOOD!

    Question--who receives the letter from the NVC? The US citizen or my foriegn fiance or both?

  6. Hi! I just joined this site and after reading some of the conversations I found out that some people were required to send a copy of their passport to be included in the I-129F application. I did not send a copy of my passport as proof that I met my finace last year. I did however send pictures of us together during my vacation. Will I receive a RFE because of this? I filed the petition last September 16, and I got the NOA1 on September 22. I've been waiting for 2 months now for the NOA2. Any ideas? By the way my petition is being processed in CSC.

    I got an RFE for this. Just sent all our info back to the CSC last Monday. They've been "working" on it since Thursday, Dec 2. Hoping to be in approval status at LEAST by next week!

    lol, can not, u better wait for the rfe, my fiance forgot the checks on our first initial petition and mailed the checks the next day after he mailed the initial petiton, and about 2 weeks after tht, he got the petition back, they didnt wait for the checks even though we sent it just the next day after sent the initial petition, and rfe cause a delay,can be a couple weeks and can be 2 months, in my case, just 2 weeks since we got rfe to noa2 :)

    Wow you got your NOA2 so fast after they received your RFE! Did they update your case to approved online? Or did your NOA2 just arrive in the mail?

I just told my fiance about it; he's irate with all the "games": waiting after 4 months of nothing to THEN send an RFE, expecting an RFE and receiving my birth certificate meanwhile our case says it's in suspense for an RFE...he just quickly said good-bye after ranting about why couldn't he have just come and gotten married and THEN did the paperwork. But we strongly advised NOT to do that by lawyers, and it doesn't matter anyway anymore. I just want someone to TELL me what is going ON over at the CSC!!! And WHY this is so f***** up when ours was a cut and dried case!

  8. Alright, all....Weird twist of things. On November 16th, the USCIS said that they were sending me an RFE. So yesterday I received (didn't pick up until today) an envelope marked 11/16 from the USCIS, but the only thing inside was the copy of my birth certificate that I sent.... :blink: WHAT DOES THIS MEAN????? There was no letter, no marking, no NOTHING with the birth certificate. Do you think more is coming? I just don't understand...I'm dumbfounded. :help: Why must they toy with us this way??

  9. Gap1, I got the email the same day I saw the touch (acco was upated to show touch at 2am mon night). So touch dated 11/15, acco updated saw touch 11/16 8am. Received the email/text in the afternoon 11/16 with RFE notice.

    Don't worry! Just cause you haven't gotten email, they are still working!!!! Either it's in the mail or will be! And hopefully it's an approval, not RFE!

  10. I can definitely relate to your fiance...I moved across the country so I could visit my fiance on a regular basis but I've been jobless, bored, and broke.

    And when A sent our petition in, he forgot to include a form and it took them 21 days to send the package back to us! I was really upset about that, because we would have been approved by now and waiting on P3 if he hadn't done that. :(

    But if you've come this far, don't let one little thing get you down. What we're all doing is admirable...don't forget that!

    P.S. I'm not trying to compare myself to you, was just letting you know I understand how hard it is.

    Oh, it's no bother to compare. We all do everyday! I understand how you were upset with your fiance; that's the same reason why I feel like I failed him because we got this RFE. Although I would like to say that my fiance hasn't made me feel that way..just me! It sucks so bad to have someone say 'I don't believe you." When in the meanwhile your face changes just at the THOUGHT of your fiance...how can they not believe me from what I've sent????? my only guess is that they lost something which pisses me offfffffffffffffffffffffffffffffff. So it's best if they don't ever tell me that something was lost. Don't screw me for your mistake. Sorry...I've been teetering between rage and determination and bliss this whole day!

  11. Don't worry, your RFE is going to be fine!! You mentioned it a few days ago so you should be getting it in the mail any time now.

    Thanks, JlovesA. It's not so much the RFE itself as the added time that upsets me. Every couple weeks throws it all off...and add up to an extra month. My fiance is MISERABLE in Spain waiting to leave, and I can't do ANYthing to speed it up. It's the most frustrating thing I've ever done! And he's been laid off from work because of the economy slowdown in Spain so he has NOTHING to distract himself with. His arrival will probably be the happiest day of my life without a doubt!

  12. No new touches. I did some reading back on this page and several people got one touch and then saw an approval in the mail. I know we all know that, but I still felt like actually seeing how many people it happened to. I didn't read every page of this thread but by like the 10th page, the one touch approval happened to about 5 people.

    Basically we know that lately, CSC hasn't been working on cases and then not doing anything. Every single touch mentioned lately has led either to an approval or an RFE. Right? No meaningless touches to be found! And that's what I am soooooo happy about!!!

    Yes, that seems to be correct. Nothing for FOREVER, then a touch, then an RFE or approval if you're lucky!

  13. Yes, I had like 5 photos w/every detail listed out about where we were, with whom, when for every trip we've taken both here and Spain. A lawyer looked it all over and said there was nothing missing. I'm going to have my pastor write a letter because we've already met re: the wedding. I'll get MORE photos together, passport photocopies and anything else I can think of.
