  2. I would say anyone should use whatever rights are available to them, whether they come from a communist country or not. If the Court says she has rights then she has rights; your perception is irrelevant. If you feel you have enough evidence to limit her rights or have them terminated entirely, then proceed in that direction.

  5. I called . they said they still wait for the DHS verification . the problem is i alreday recived my GC from them . so way the DHS late ?.

    USCIS/DHS are incompetent. My wife got her Greencard in November. Went to change her name on her SSN in January. SS person went to change it and said USCIS/DHS has her name in their database as her unmarried name, and haven't updated it to her married name. The greencard is in her married name. So the SSN office had to send a form and whatever else telling USCIS/DHS to do their job and update the name in the database to what is on the greencard...the same greencard they issued.

    In short, welcome to government agencies...where almost everyone is full blown incompetent.

  6. To all those that call repeatedly and ask for updates on timelines. The more time they spend on the phone with you, the less time they have reviewing the information and processing the forms. Stop calling and let them work. You are so close, and you will get it soon!

    Wrong wrong wrong....You do know they have a customer service call center right...they handle the calls, not the people who approve/deny petitions.

    Do you have an immunization/vaccine form that lists what you have gotten? If you do, the exam total for my wife was around $130 in 2011.

    If you don't have a record for what vaccines you have received...it could cost a lot more.

  8. Under the Dream Act, the main building block is that children brought to the US illegally must have to enlist in the military or go to college to have a path to US Citizenship (but first will obtain LPR or green card). Plus the penalty to paid.

    It is true that generally, only US Citizens and LPR or green card holders can join any branch of our military. However, under the EO issued 6/15/2012 relating the Dream Act, it IS possible children brought here illegally (as in the case of the youngman) to join the Army or any branch of the military and/or to enroll in college to have a path to obtain citizenship. My earlier suggestion was for him to explore that option.

    Dream Act wasn't passed. Deferred action was given via Executive Order. It is valid for 2 years with the "possibility" of renewal. It has nothing to do with citizenship or gaining citizenship.

    "Individuals who demonstrate that they meet the guidelines below may request consideration of deferred action for childhood arrivals for a period of two years, subject to renewal, and may be eligible for employment authorization. Deferred action does not confer lawful status upon an individual. In addition, although an individual whose case is deferred will not be considered to be accruing unlawful presence in the United States during the period deferred action is in effect, deferred action does not excuse individuals of any previous or subsequent periods of unlawful presence."

    I wasn't sure where to post this, so feel free to move my post!

    My interview is planned on January 14th here at the consulate in Amsterdam, and I'm planning to make my leave three weeks later. I'm currently researching everything about the SSN, the AOS and I was also looking at obtaining a marriage license in Texas, which is where we"ll be living. According to some information I found, in Texas you need a social security number to get your marriage license and therefore to get married.

    Does anyone know if this is true, and if so, what would that mean for us? I've read about so many issues with getting your SSN that it may just be worth it for me to fly to New York for my POE and get married there.

    No it isn't needed. Also you will want to check your county's website to find out what is required for a marriage license in your county. The USC will need a SSN more than likely, however, the K-1 holder just needs to bring the passport with visa & I-94.

    Similar to Texas, Maryland and Maryland County websites have said the same thing in regards to needing a SSN for both people. My county website also said it was required for both. Went into the County Courthouse to apply for the license and SSN wasn't required for K-1 Visa Holder.

  10. Theres a part on the aplication of the cr-1 that scares me..

    It says if she has ever gotten in trouble with imigration before.. and they list when and ask for docments on that.

    Now i thought you guys said it doesnt matter if she got deported or not?? if it didnt then why do they ask that?? I got half a mind just to put down No and get a new passport with blank pages and say she has livedin the philipines all her life.. I mean can they realy find out since it happend in denmarkk?

    Yes...they can. But do what you want. Just don't complain if you say no and get caught.

  11. I fear that if anyone applies for EAD/AP along with their AOS, their AOS case will get hosed.

    I think there is some priority they are targetting to make sure people who applied for just AOS get approved first.

    Idea is that EAD/AP allows for almost the same privileges as the greencard (Work and travel), and since it is valid for one year, CSC takes their sweet time to process the AOS case.

    What do you think folks? Does this sound legit?

    Highly doubt it. My wife just got ger GC approved yesterday and all that was filed for was the GC. No EAD or AP. CSC is just slow.

  12. Cultural norms. Is it normal in Peru for women to date men that are older? I know of a Brazil couple, who started to date when one was 21, other was 16. Filed for a K-1 when she hit 18. Process went fine, all the consulate asked was "Do you think you are a little young to get married" and he said she answered it just fine, consulare said ok, grats here is the visa.

    They are in the US now, married and happy and there was 0 problems. But then again it is more or less normal for girls to date guys a little older than them in Brazil.

    Just wait til she is 18 and file. Have the proof as needed and don't worry.

    A lot of cautionary information balancing on fear mongering in this thread and personal opinion which does not approve of such types of relationships since it is not U.S. norm.

  13. Agreed. Though as Jim said it does get hard at times, especially when people have the "I'm always right" attitude and keep posting the wrong information over and over in the same thread. Something to this is happening in a K-1 thread right now in regards to yes/no to working with a K-1 and SSN before EAD and a greencard. So I can see how people can get annoyed and be rude, however, I do know several of the rude persons on this site and how they almost always offer little to no useful advise and just bash/call out others.

  14. This Information is correct. And for a K1 Visa the SSAN Application you can check the Box Legal Alien Allowed to work. There is a statement on the Visa Journey website that is incorrect. Tha may be causing the confusion.

    WRONG. Quit spreading incorrect information. Yes, you do check that box on the application HOWEVER, when you recieve your SSN card in the mail, it is clearly stamped in red with something to the effect of "DHS AUTHORIZATION REQUIRED FOR WORK". What does that mean? It means EAD or Greencard. Once you have EAD and/or the greencard you can go back to the SSN office, and get that restriction lifted.

    I just did this for my fiancee several months ago, I know the process, it hasn't changed.

    AOS Cost $1070 to file. You can file EAD and AP for free with it. Total cost for Greencard app., EAD and AP when filed for AOS, $1070. Takes about 4 months for the greencard and 2-3 for EAD/AP.
