    Hello Sulaiman:

    I was able to check with the USCIS and they informed me that according to U.S. Immigration Law, as long as the marriage is legally valid in the country in which it took place, the U.S. accepts it as valid. For purposes of the visa however, the U.S. Consulate must also make sure the marriage conforms to the provisions of the Foreign Affairs Manual. This case review can sometimes take a few weeks or even months. If you do not receive a decision on the case within the next 90 days, I can check into the status.

  2. When I said legal paper I meant 8.5" x 14" paper, not the standard 8.5" x 11" paper. I did that so I could fit more calls onto the paper. If you are concerned with printing just the spreadsheet, you can go to the skype screen on your internet browser and just click file "print" and that way it will show the other web site stuff on the print out. Also, if you want, you can print the transactions from Skype that shows each time your wife paid to charge her account.

  3. Yes, but it only goes 6 months back. So I would start doing it from now. But you go to skype.com, open your account. The tab "call phones" should already be selected and then click "view call history" and then at the bottom, it says "export call history file". Click on that and it will give you an excel spreadsheet of all your calls. Do that for each month you can.

    I know how to do that, but it just an excell sheet with no skype on it, you said you put that in legal paper, how do you do that.

  4. Hey, glad to see everyone's progress here! I am leaving for Palestine on Wednesday, and I am bringing some evidence with me to give to my wife for her interview. I would like to list it here, and if there is something else someone could think of, let me know.

    -Skype Call Records (over 250 pages on legal paper, and Skype would only let me go back 6 months)

    -T-Mobile call records directly to my wife's mobile number

    -Notarized/Sworn affidavits from my parents expressing their knowledge and support for our marriage

    -Notarized/Sworn affidavits from her parents expressing their knowledge and support for our marriage]

    -Notarized/Sworn affidavits from 2 friends of mine and 2 friends of hers expressing their knowledge and support for our marriage

    -Copies of e-mails sent

    -Pictures of our mobile phones displaying the text messages (as there are no phones allowed in the consulate)

    -I will give her my wedding ring which bears the same engraving (our names & date of marriage contract) as her wedding and an earlier ring she gave me in 2008 that has her named engraved.

    -100 informal pictures

    -25 engagement party photos

    -25 wedding party photos

    -One engagement party invitation

    -One marriage party invitation

    -Copies of my passport that show entry into Jordan/Palestine

    -Copies of her passport that show stamps with same date of leaving Palestine as I did (she basically traveled to Jordan with me to say farewell when I returned to the U.S.)

    -Pictures of her gold that was given as the dowry

    -My 3 year tax transcripts

    -My co-sponsor 3 year tax transcripts

    -Copy of my biographical page of my passport

    -Copy of co-sponsor's biographical page of passport

    -Transcripts from the university I attended to show the dates and hours I was enrolled in school and couldn't have possibly been working a full time job to meet the income requirements

    -Letter from Human Resources of my university that stated the amount of hours I was allowed to work a week as a student assistant (18.5) and the wage I was making (7.50), (again to show why my tax return was so low)

    -Copy of my university degree

    -Notarized employment letter of my current job, giving rational to my degree/major, and showing my hourly/wage plus over time as well as my span of employment

    -And my business card for good measure.

    I will organize it all neatly and give it to her. I will also instruct her not to give them any evidence unless they ask for it.

    I can see history of phone calls, but how I can export it to legal doc paper?

  5. So our case is on another review...need to wait another two weeks to see what they say....just to be safe, my husband is getting both police records again.... That way if there is a problem, I will just mail them out again....####### I am sick of this

    Hi, I just had the same problem, and when I called they said they want the inteligent report not the police report.

    Make sure he get's this from the intelgint agency in moroco.

  6. If you are married on or before Dec 31, 2010, you are qualified to file Married Filing Jointly (MFJ) for the year 2010.

    You need to file your 1040 MFJ by mailing it to Austin, Texas Address (online filing is NOT possible):

    Internal Revenue Service

    ITIN Operation

    P.O. Box 149342

    Austin, TX 78714-9342

    Her SSN column will be blank in 1040.

    Include her completed and signed W-7 form with supporting documents such as her passport copy etc. along with 1040.

    Don't forget to include her foreign income in 1040, if any. For MFJ, worldwide income must be shown.

    I am in need of a suggestion here.

    I have been filing my tax past three years as "Married Filling Jointly" through one of the CPA in my area. I have my wife's ITIN # from last year. As you all know that a visa interview has been scheduled for Feb 15 and as soon as she receives her passport back with visa she will be flying for USA within a week. Again I also hope that she will have her SS # sometimes before April 15.

    This year I am trying not to pay $100 to CPA and want to do my tax "Married filling jointly" electronically using one of the Tax software available in the market.

    My questions are :-

    1. Can I use ITIN for my wife in electronic filling or do I need to have SS #?

    2. Using ITIN instead of SS makes any difference? specially in return?

    3. Should I go ahead and do it using her ITIN or should I wait until she has her SS# sometimes in March?

    4. If so which tax software is reliable and user friendly?

    Hoping to have a reliable answer from my fellow VJ'ers :D Thanks.

    I am in the same situation except I do not have ITIN. what do I need to get my wife this.

    and what doc do they ask from me to give them, giving the fact my wife is overseas.

  8. With IV packet (DS-230) you have to send the beneficiary's original birth certificate and petitioner and beneficiary's original marriage certificate, beneficiary's police certificate as well as copy of all civil documents. Just read what binny has sent with her IV packet. Good Luck.

  9. You all must realize that marrying your cousin is not a grounds for denial. I have gone over this very clearly with my lawyer as it is my situation. The K-1 should have been fine so long as the state in which you intended to wed in allows first-cousin marriage. Because I live in Texas, a state which forbids such matrimony, I chose to go the CR-1 route, which recognizes a marriage so long as it is legal in the beneficiary's country.

    The only problem that should arise is 1) the state in which you intend to wed and 2) proving that your relationship with your "suspected" family member is, indeed, valid.

    I would really be sure and clear that the reason for denial is because you are suspected to be cousins. Because like I said, first-cousin marriage is not a reason for denial unless the above stated are part of your situation.

    It might be something else...

  11. Yes. Lots of other documents. Following is a listing of what I sent in. My case was simple and straight-forward. You may need to include more items like military records if such applies to you.

    Original or certified copies:

    • Bar-coded cover sheet
    • Cover letter
    • Two Passport-sized photographs of the beneficiary
    • Completed and signed form DS-230 Part 1, by the beneficiary
    • Completed and unsigned form DS-230 Part 2, by the beneficiary
    • Photocopy of the biographic data page of the beneficiary's passport
    • Original marriage certificate of the beneficiary and the petitioner
    • Original birth certificate of the beneficiary
    • Original police certificates (Police Station) of the beneficiary

    Copies:

    • Photocopy of the biographic data page of the beneficiary's passport
    • Photocopy of the marriage certificate of the beneficiary and the petitioner

    My husband has Green Card and 2,5 years till he can become a citizen,we got married 9 months ago and since than I come in and out of US in order for me to stay legal(I have a second 10 years visa on my passport and I also worked for 7 years in US).

    After doing a lot of reading on the USCIS,I finally decided to apply for reuniting the family for the I-130,I just need,somebody advice ,who pass this if this is the right way for us to do it.

    I'm just afraid this will damage his chances on getting his citizenship ,but at the same time I want to stay with him here and be legal.

    I did a lot of reading on the USCIS and I found out that they change the waiting time to 5 months,for wife and kid's.

    My visa will expire in January and I'm thinking to apply for I-130 now,in the waiting time,is my status pending..or I will be count as illegal?

    Hello, You do not have any problem. Apply for I-130 as soon as possible. you can stay even if your visa is expired, but try to extend it if you can.

  15. My IV application status is PAID! Apparently, I have to submit the DS-230 online...not like electronic processing but tehy call it the DS-260. I still have to send in all my originals and copies of supporting documentation but I guess I just print out the confirmation page after I'm done and send it along with the cover sheet. Interesting.....
