My sister arrived in the US as a permanent resident. Her fiance arrived with her but he has a visitors visa. If they get married in the US before he overstay and she submit I130 for him, can he travel freely back and forth from the US to his country. He intends to not overstay. He has a visitors visa for 10 years but once he arrives in the US and they give him, lets say 3 months on his I90, can he come and go once he doesnt overstay?

Is there a penalty for coming to the US on a visitors visa and intend to marry a US resident? Do you need a waiver?

Usually if your case was transferred to CSC it means no interview, that's what happen with my case they send me a noticed on feb, 26 2009, that my case was transferred to CSC and by april 7 i got a welcome letter, and received my 2 years greencard by april 08:)

He's applied for a visitor's visa in the past and have been denied as "not enough ties". So the answer to that question would be "NO"? Right?

i found other posts so I believe I have to check Yes...If anyone has other opinions, please post.

Just words of advice...I tried to be patient while at the same time reaching out to whatever sources available so my case was getting some attention. I know (and I have a lot of experiences with immigration) there is nothing much one can do when it comes to visa processing except for making the inquiries and getting congressional folks invilved. Dealing with immigration is not easy....I had petitions for my brothers and sisters, which took over 15 years before they were able to obtain their green cards. By that time, all of their children had already aged out (attained the age of 21 years). Despite all, I'm happy to say my brothers and sisters have just received their Naturalization certificates..so good things do come out of it.

We put in a service request on 3/15 and got an email today saying that our case is currently under review and we should receive a decision or notice of other action within 60 days of the date of this letter. Does anyone know how long it may actually be? We were told a month ago our case was with someone...

I've received about five different responses from USCIS via senator's office, office the ombudsman...you name it. And, none say the same regarding the waiting time.

This is the response the senator's office received:

Our electronic records refelct that the petitionfor Alien Fiance (e) (Form I-129F)(EAC-########) filed by the petioner, C..... on behalf of the beneficiary, G.... was received on September 13, 2010, and is currently pending. VSC is presently processing I-129F/K1 petitions approximately 5 - 7 months from receipt date.

Processing times are provided on the USCIS website and are updated weekly. VCS allows 30 days beyon the posted date before the case is considered "Outside Normal Processing Time" (ONPT). An additional 60 days must be allowed for adjudicative review and processing before we can request expeditious processing based an ONPT request.

If the application or petition is still pending after 60 days, and once we receive your formal request for expeditious processing, your case will be forwarded to the applicable adjudicative unit for expeditious handling. Further record review reflect that on March 01, 2011, this case was brought to an Immigration Service Officer (ISO) for review and adjuducative processing. Accordingly, the petioner should hear from USCIS in the near future.

#3 Sent email to Office of the Ombudsman on 2/26/11

Received email to submit signed permision - sent via email on 2/28/11. No other response since.

#4 I called VSC on 2/25/11 and submitted a service inquiry

No response yet.

I'm afraid its looking like this can prolong for another 60 days!!!!

Six months since NOA1 tomorrow. Does that mean I'll hear soon.................am running out of patience.

Just called- theyve updated, now theyre saying theyre processing sept. 11th at vsc

I got our NOA2 on March 6. That's what the case status says and also the touch is for March 6(last updated thingy). It says the usual:

On March 6, 2011, we mailed you a notice that we have approved this I129F PETITION FOR FIANCE(E). Please follow any instructions on the notice. If you move before you receive the notice, call customer service at 1-800-375-5283.

But it only says that they mailed the notice, so maybe the case was processed on Friday and they gave orders for putting things in the mail for Monday. Plus, I remember that we've all been touched on October 3, 2010. That was a Sunday as well. It's rare, but it happens. YAAAAAY!

I have to add that we didn't call, not once! I kept telling: I'm giving them 2 more days. LOL, then I was: If we don't have it by Monday, I SWEAR we're calling everyone. Ha! Goes to show how powerful God is and God's time is always the best time!

Also people join VJ and add their timelines which could have an NOA1 that pre-date yours.

   Hi all
   I really would like to ask the girls out here,who are about to leave their home country and move to their lovely fiancee's country, that isn't it scary to u all to leave everything back here and move? I know we all love our respective fiancee,and we all knew from the start that this would eventually happen,but honestly when i'm finally doing this i am extremely nervous.So many questions are on my mind:
   1) Will this relationship work in the long run (since we never had normal dating period, for years, before settling down)?
   2)Will i be able to adjust to a new country?
   3) Will my fiancee love me forever and value the fact that i have left behind everything just to be with him for the rest of my life?
   AND MOST IMPORTANTLY
   4) Will i see exactly what i have thought of him all these months and he doesn't change colors (no offense to him, but this is what i hear from people around that men change after marriage).
   I really hope my relationship works out and we have a good married life,God willing.
   Nonetheless my fiancee is a great guy but when people around tell u that 'i hope u r doing the right thing,its not a matter of few hours journey that we can come to your rescue if anything goes wrong,u have no friends no family there and no one to share your problems..blah blah blah' it makes me numb and scare me all the more.
   I practically have NO ONE in the US,its only him whom i know and no one else in that huge country.Its dam scary.But i do trust him and God.Hope everything will be fine,finger crossed. I really love this man,and i hope he would love me the same or more for doing this all for him.

The most thanks has to go to my wonderful Fiancee, Crystal. Without her perseverance i think we would still be waiting now.

For those interested, we did the following;

• Put in a service request, the day after our five month mark
• Got both our Senator and Congressman's offices to follow up on our service request
• E-mailed VSC
• E-mailed USCIS Headquarters for Service Center Operations
• E-mailed the Ombudsman
• And if it had gone any longer, we were just about to get the media involved

There is no good reason why tax paying US Citizens should be waiting so long to get their NOA2. VSC need to put more adjudicators on the job of I-129F Petitions. And i am sure that in the coming months they will get caught up again. It was just bad luck that all of us here got caught up in the whole TPS thing.

We trust in God that there was a reason fo the long wait, and are looking forward to moving on from here. And at least now we get to have a warm outdoor wedding day.
