    If a husband's previous marriage ended up on Khula then does he also need to get divorce certificate from Union Council? or family court documents are enough?

    I don't have experience with this. But, I think since it was a Khula the Union Council can't provide a divorce certificate, since only the family court deals with Khula. So, your family court document should be enough. You should probably submit a legal opinion drafted by a lawyer which states that since this was a Khula only the family court provides documentation and there is no need for a Union Council certificate since the Union Council can't provide any divorce documents in the case of a khula.

    Did you use that same attached URDU Union Council Divorce Certificate and filled all info and get the signature from Union Council? or you got it new Urdu certificate from Union Council and then filled all info.

    Hi,

    Basically, you can use the exact divorce certificate I provided. You should use it as a template, so have the Union Council use a blank letterhead and have them type in Urdu the Divorce Cert I provided. Make sure you fill in the blanks with the correct information - so have them type that information. If they can't type it for some reason, have them write it. So, the Union Council should make the Divorce Certificate. If you have any more questions let me know. The problem is that the U.S. embassy wants an URDU divorce cert, even though it seems that Union Council's provide English ones. So, that is why we have to go through all these problems.

The interviewer said they need an URDU divorce certificate from Union Council even though she had the original bilingual one at the interview. So, she can get this document without a problem. Now my concern is that on the blue slip they are also requesting and English Certificate from the family court??? But the officer only mentioned the Union Council Cert. So, what should we do? Does anyone have any concrete information?

    My wife's divorce was also through talaq, so do we really have to go through the hassle of approaching the family court.... this could take months.

    Any feedback would be helpful. Thanks.

  4. The NVC timeframe varies, but from my experience...once they have all the necessary documents, the case should be completed in a month.

    For Pakistan interviews- expect an interview date 2 months after the NVC case complete date, but if you're lucky it could be earlier. At NVC, they schedule interviews for Pakistan the second week of each month.

    i make a nadra marriage certificate after receiving they done so many mistakes n i give it back for correction And when they give me back again everything else is right but the age of my wife is wrong dey make her one year older so do you think we will get a rfe on this or should we fine with that...????

    I think if you didn't submit it yet, then get it remade with her correct age. It's better to be on the safe side.

  6. Status Update:

    We approached the Union Council and had an URDU Union Council Divorce Certificate made. The divorce certificate looks similar to the format I'm attaching below. The only difference is that in my wife's divorce certificate we only included one date - the effective date of divorce (which is the last date on the format). So, the sentences referencing any other dates do not appear in her divorce certificate. You can see the generic format below, I'm attaching it because it was very hard for us to figure out how the URDU document was supposed to look like. Someone from another forum was kind enough to email this format to us.

    As far as the Family Court, we got a legal opinion from a lawyer stating that the Family Court is not involved in cases where the Husband gives the Talaq. I will upload more descriptive information inshAllah once our case is resolved. Please pray for us.

  7. I am Sarah and i am the Beneficiary, I just wanted to get your comments all we will need the below mentioned documents for NVC process. I am seeing many approvals and inshAllah we will get ours this month or early next month .I know there are many guides and i have read them so many times, i am going to email my husband all these before he leaves for Pakistan end of this month . I want him to be prepared and get the I-864,tax transcripts ,IRS tax information before he comes here so we can process our NVC without any delay.

    What i willl need to provide :

    Marriage certificate (original)

    Police Certificate (original)

    Two Passport size photos from beneficiary

    Beneficiary’s passport biographic page (Photocopy)

    Beneficiary’s birth certificate (Certified)

    DS-3032 (Choice of Agent)

    DS-230 (Completed Part I & II and Only Sign Part I)

    From my husband we would need

    I-864 is known as the Affidavit of Support.

    IRS Tax information - 1 year is required, up to 3 years may help.

    Okay now i want to know do we need to get birth certificate from NADRA ? or marriage certificate attested from Nadra as well or the ones we send copies of with out I130 will be enough? Does my husband have to provide any details of his bank accounts or Assets ?

    One more question what if we get approval when he is in Pakistan? can we still Call NVC at 603-334-0700 to get NVC Case# ??

    Any help , suggestion , information will be highly appreciated .

    Hi, Yes, you should get the birth certificate from NADRA -it's bilingual (English/Urdu) then you need to get it translated into English - get the translation attested too. I think your marriage cert should be attested from Nadra too, but I don't know - because we got married in India. For my wife's interview in addition to the AOS, I also provided my bank balance letter- but the interviewer didn't look at it in the interview. Also take wedding pics- that's important.

    If he's going to Pakistan for your interview, then he should wait till you get an interview date from NVC. For Islamabad, the date is usually 2 months after the NVC approval date.

  8. My uncle had to get both documents, one from the union council and the other from the family court. He went through the immigration process in 2010 and even though he was adjusting status in the US, he had to get these two documents from Pakistan in order to establish the proof. Sorry as it might seem a painstaking process but as far as I know, there is no way around it. And personally I'd suggest you provide all the documents they have asked for because say you send in the union council one and they take their time to process that and then they send you another request to submit the one from the family court... that will not only waste your time but add to the torture. So try getting all the documents and send them all in. they should have informed you at NVC what was needed but I'm sorry for the trouble.

    So my wife went to the Union Council today and spoke to the person in charge. He said 15yrs ago they made the document in URDU, but now everything is in this bilingual URDU/ ENGLISH format. They said they can provide us a letter in URDU, verifying the divorce occurred, and referencing the ENGLISH/URDU certificate. Now, we are unsure what the embassy means by an URDU Union Council certificate, when it doesn't exist ? I hope Union Council's letter will be sufficient.

    I want to consult an immigration lawyer in Karachi, does anyone know a good lawyer, if so plz send me his info?

    Any thoughts?

    I was hoping that the US embassy would be familiar with divorce formalities in pakistan and a complication like this should not have happened....

  11. Yes, I understand that she sticked with the I-130. My issue is that mine were both approved on the same day. And a few days ago NVC assigned a case number to my I-130 and is waiting on my fee payment now. However, my lawyer is telling me not to pay the fee and wait to get the I-129f forwarded to the embassy instead. He says that I-129f will be faster. I'm getting a little worried because I don't want to wait a month only to find out that my I-129f has been administratively closed by NVC. In that time period I would have needlessly kept my 130 in limbo. So, far NVC hasn't received my approved I-129f.

    UPDATE

    My lawyer told me that he spoke with NVC and my I-129f was administratively closed. I have paid my fees online for I-130.

    I know the effective rule from Feb 1st. But my I-130 and I-129F got approved together in 23rd September 2010. NVC did not recive my I-130 approval yet but they already forwarded the I-129F petition to the Embassy on September 29th, and I received the NVC case # for my I-129F today.:wacko:

    What should I do now?

    - Should I wait for the embassy to contact my wife and continue with I-129F and forget the I-130?

    - Should I try to contact Embassy and asked them to stop the process of K-3 visa?

    - Should I wait for my NVC# for the I-130 and continue both in parallel?

    I am in a similar situation. I was married & divorced & my current wife also married before & divorced. We are now married. Their interview is is this month at ISL. I provided my divorce which is a court order from US. I provided my wife's divorce papers which are Union Council Urdu/English. This was done here when I send papers to DOS/NVC after the I-130 approval. They initially rejected my wife's divorce papers b/c they were not in the correct format. I had to get a differnt kind with translation & they accespted. I'm hoping/praying that they do not do any objections at the consulate now.

    Did you submitted these papers to NVC/DOS first to have them kind of approve it?
