Is your mom a LPR or a US citizen? when i petitioned my daughter i wasnt a citizen yet. i became a citizen not too long ago. under cspa, her category was automatically moved as daughter of a US Citizen in which she had to write to the DHS MLA to opt-out. with your siblings case, check when she petitioned them and refer to the cspa info online. I, myself is not clear how to calculate it and i dont wanna give wrong info.

My daughter had to "opt out" too because on the day of her interview, she was advised by the CO to write a letter to stay in the F2B category since I became a US citizen a little over a year ago. It has been about two weeks now and there's no update yet. She's done with the interview as well. The only thing that caused her delay was th "opt-out" letter. How long does it take for them to update and issue the visa? Thanks!

    I know someone that had to do a Humanitarian Revalidation. If you are able to show that it will be a hardship on you and your family to not get the visa and the degree of the situation, you're more likely to get approved criss. Is there anyone helping you right now? Try to do it on your own and if you think it's too complicated, seek help from a lawyer. Goodluck to the both of you!

  4. I have the exact situation. Due to the economic crisis we are in right now, I was laid off about a year ago and few months after we received a notice from the NVC that her priority date is now current. Since I only get the Unemployment Benefits and it's not 125% above the poverty line for 3 people (me, my daughter, and her son), my daughter-in-law helped me with the I864. It's perfectly fine, it basically just say that they will be responsible for the persons on the form because the government wants to make sure they will not become a public charge.

  5. My daughter has a priority date of March 15, 2001. She had the interview already but the consul asked her to bring back a form I-797 Notice of Action. I guess what they want to see was the one that says " your petition has been approved." I can't locate that form and I wrote them a letter and had my daughter print out something from uscis.gov that say her petition was approved but they didn't take it. She was told she could get a letter from the NVC stating that her petition was approved. I called the NVC 5 times and none of them wanted to give me a letter. Pls. help. Do I need to consult a lawyer now?
