  1. You can't say she is too impatient. It's just that from USCIS website the timeframe for AOS is 4 months. And now most of the August filers have approved by now while she didn't get any interview letter yet. It's normal that she's feeling frustrated.

    To OP: I can't tell you what to do since I'm not knowledgable enough but there are lots of other people here who will help you. I really understand your frustration anyways. Hopefully you will hear some good news soon.

    Hello, that is exactly why I was asking. Taking a look at similar cases I realized many of them have been already approved. We will not get an interview, according to what I have been informed by our university (employer). We will just have to wait for a decision after FP. And thanks for your understanding! :)

  2. Thank you Kathryn! Hopefully we will hear something soon. My question was mostly based in what the University lawyer told us, most of the international faculty applying to AOS prior to us and under same conditions got their GCs few weeks after having done the FP. I know this may take much longer..

    Moderator hat off: I'm sorry you are still waiting for your AOS. One of the things you will learn through this process is that patience is a virtue and expecting anything from USCIS in a quick or even timely way is a sure recipe for stress. There are many reasons for a delay in processing, however the current actual rate based upon the data from our members appears to be around 5 to 6 months for an approval. This can change at anytime, and I have heard of AOS been approved in as little as three months - and when I was waiting, the majority were taking over a year. Mine took 22 months to be approved - and no, there were no RFEs or problems and I was approved without an interview. So, I do understand what you are going through :) .

    As long as you are still within the processing time as indicated by other members here who show that the majority of those who applied in July only started to get their approvals within the last week or so, you are still on track. Most of the August filers have not yet been approved - they are in the process of being approved and as your application was submitted near the end of August - you are still within the processing time frames and should hear something soon.

    Did you have any RFEs in the process? That supposedly bogs things down. I would definitely put in a service request/ do an infopass appointment.

    No, we did not get any RFEs. We did put a service request and planning an Infopass for next week. Thanks for the suggestion!

    I was wondering if someone is still waiting for that long like me...

    We applied in August 23 and the NSC is still reviewing our application, after 5 months! The regular timeline for them is 4 months so I called USCIS and they told me just that, your case is now under review and they said I should contact them again by March 4 (2 months after receiving an answer for my inquiry).

    We got AP and EAD approved and received already. Called FBI and name check went through the day after we did our FP on October 27th. Since then, no SLUD no nothing...

    Any similar experiences?

    For what I understand our PD is current and we are EB2.

  4. Just an update if you read the post... I had to Premium Process my application because I did not heard nothing of it before, and it's been 4 months! Finally, after sending the request last week, I saw a movement in my case yesterday. I will probably have a decision by next week. It looks that they will just do it for the extra $ 1,000. :(

    For those who have been reading the post, I have received today, October 22 the approval to my H1-B extension. After Premium Processing, it just took 1 week to have everything done! So if you are experiencing delays as I was, consider PP as the fastest and easiest way to accelerate the application approval.

    I am lucky and unlucky to have my boss I have. He is willing to Sponsor me but only recently confessed the last time he sponsored someone was 1978. So in short he has no clue. As far as speciality occuptation etc all boxes are ticked, it's a few tricky fundamentals I am worrying about:

    So I have two main questions:

    1) He is currently paying all his employees by cheques. My understanding is a prevailing wage is calculated by the medium of the other employee's wages? If they are not officially on a wage, is this a serious problem for me? what are my options??

    2) I understand you can either go premium process or standard which is considerably longer. If I take the standard process route am I still allowed to stay in the country while my application gets processed.

    I appreciate all the help I can get as my visa runs out in just over a week!

  6. Hello everybody,

    I am waiting for an H1B extension and it seems that the process is being delayed, exceeding the 2 months waiting period the USCIS indicates on its website. They began with the Initial review on June, 14th and that is all the info I have received. According to my university lawyer, there are other professors in the same situation I am, waiting for more than 3 months... (she should have told me this before and filed my case earlier.... but what could I do? :( )

    Any recent experience on H1B renewal? How long did you wait for its approval?

    My only concern is that I cannot renew my driver's license, which is already expired, until I receive the approval notice (I am in Indiana and they told me there is other license extension option).

  7. Lots of congratulations! and hope fully you will get finger printing date soon.

    I am still waiting for initial notice. As per my lawyer he already called uscis and hopefully will get notice in next couple of weeks.

    So lets see, I have no option other then just wait.

    I am in the same situation. My attorney applied my case in the start of September but so far no receipt number and checks are not cashed yet.

    As per USCIS if application is filled more then 30 days then they can help to figure out the status or can tell the receipt number.

    I called USCIS and lady there asked me about the exact date when application was filled but honestly I don't know that. Now I have to get exact application filling date from lawyer.

    Pls let me know if you received receipt number yet? or any progress.

    Yes! I receive the receipt date notices for me and my husband on Sept 30th, so it took more than a month since the date they received it to issue a notice! I sent everything to Dallas but was transfered to Nebraska. I filed by myself so when I call they could give the receipt numbers one week before getting them on the mail, exactly one month after sent. I know that the wait can be longer though so give it some time but try to get from your lawyer the exact dates so you can call. However, I know that if it was your lawyer who filed, he or she should call, I do not think they are going to give you any information to you if your lawyer is not present at the time of the call. Good luck and you also let me know how it went!

    For me no finger print notices yet, calling today to see what is going on...

You did nothing wrong, just wanting to let you know there is a more specific forum that might help you more. There you can find all the August or September filers in one spot and compare timelines.

    Your case is slightly different from the majority of the other people in this (correct) forum, but you are still in the right place! Good luck!

    Hey Mary, you can head on over here to the progress report subforum and compare your case with other recent filers. Most of the people on this forum (or at least this last summer) were filing based on a marriage, so they sent theirs to the Chicago Lockbox, and might not be able to advise too much (but hey, you never know). I am guessing that Dallas is more busy than Chicago, so it would take longer to get the receipts, but only hazarding a guess here. Good luck!

    I am also waiting for my extension to be approved (it is taking 3 months since paperwork accepted, so far...) and then I will switch to another employment under same company, but I also need an amendment like you. So, I think you have to wait for your visa extension to be approved to start the process and like the other person above, I also think you do not need to stamp it in your passport to do the transfer.   12. I am in the same situation

    my lawyer filed I-485 for my spouse as a derivative beneficiary on August 26th. It received uscis on August 27th

    I called uscis but they say its not in the system and the officer gave me a lockbox email address lockbox@dhs.gov. I have emailed couple of times (sent them reminders) but have never got responses back

    Thanks for your message! My husband called again and he was able to talk to a more reasonable guy who did not suggest, at least, they have lost the papers!! He said it is taking about 30 to 45 working days to issue a receipt notice, but I am still worried about this delay... there is nothing to do but wait! Until the checks are not cashed and they accept/reject our papers to review, there is no way to know what is going on!! Hopefully we will hear something soon. Which Lockbox did you send your spouse's application?

  13. Thanks Inky! It looks that it is taking longer now... :( As you see in my other posts, it's been a month and we are still waiting for the receipt notice...

    I'm sorry but forgot to ask... is that 4-5 months from the time you receive the receipt notice or the whole thing? My husband called USCIS and they said we should keep waiting because it may take 30-45 work days to issue the notices... Thanks again!

    So far, I have not received any receipt number, neither for me nor for my husband (we filed together). The checks have not been cashed yet, either.

    When I spoke with USCIS representative, she said we are not in the system!! so she was not able to tell me wether the paperwork got lost or what, and just told me to wait.... keep waiting... now I am getting really worried about what could happened with that application. The worst part is that in the case I keep waiting and they still not finding me in the system, there is nothing they can help me with... Should I re-apply?

    Do you know something about similar waiting time (a month and nothing!)?? Could you please help me have an idea of how to proceed under this scenario?? Thanks a lot! I am totally lost right now!!

    I sent my I-485 package and my husband's to the Dallas Lockbox and it was received on August 23rd. I am still waiting for a receipt number for our apps. Do you think this is normal? I am planning to call after 30 days has passed but I am seeing that everybody is currently waiting less for this receipts. Does anybody has a similar experience with Dallas Lockbox? I really appreciate your help!

    Hi H1a1, I might also be moving while my AOS is pending, I just filed it 2 weeks ago and I have not received any notification yet. We might move in December... Could you please let me know how you dealt with the moving notifications? Did you complete the 2 documents required for USCIS? Did this cause any significant delay in your application?
