Best wait for filing. Signing the k1 application is saying you are both free to marry. Even if the divorce or correct papers come thru before your app is processed, it will not look right because the date of filing would be before the divorce papers date. I was going to do the same by filing k1 before my fiancee annulement was complete but learned otherwise. Play it safe.

It is. Better have good walking legs when going from gate to gate. Very long walk from one end to the other but you cant possibly get lost. Good luck.

Ok thanks guys. Well as of this post i am on my way to LA then on to Philippines to visit fiancee again for 10 dsys and her graduation from college. Maybe this visit will tie me over til k1 is done at VSC. I am at 5 months on april 5.

I ask a similiar question a while back and got this reply;

This is a common topic, the consulate WILL extend the validity of the petition.

This is very common with consulates that dont interview within the 4 months, for example China, K-1 petitions get hung up in customs for up to 3 months, and then it can take 2 months to exchange the P3 and P4 paperwork.

If you do get worried about this you can send this form letter to the consulate requesting an extension.

I talked to friend of mine yesterday that has a k1 pending and is now 6m 27 days waiting in VSC. He called once again for service request and was told they are working on sept 11 dates.. His was a sept 2 date, and according to them it will not be 30 days overdue until they began processing oct 2 dates, which sounds ok at face value, but when you think about it sometimes they may spend several days or a wek or so on a particular day. If this is true then by the time they get to the oct 2 petitions, the actual day could really be 1 or 2 months further out than the day they are actually working on.

If this is true, then now we know why so many are past the 30 days but uscis only counts the actual days they are working on as the late date. This sucks big time! Anyone heard of anything similiar?

FYI a friend of mine called for a service request at Vermont today. They informed him that normal processing times are now at 6 months, not 5. They would not take his request til it reached 7 months. His petition is sitting at 6 months 24 days. This is what he told me at lunch today. He is not a VJ member so i am giving the scoop here based on his phone call.

Ok, I called today and asked the agent. His response was that unfortunately there is no way to add additional stuff to the file until an RFE was generated and sent to me. I guess maybe whatever is to be sent in had to have an RFE number or something to track it to my case. No volunteered extra info allowed.

Yes i did. I am starting truck driving school march 21 for 6 weeks and the school places new students in jobs with affiliated companies. Once hired, i get paid with on the job training for 6 weeks then given my own truck. Maybe about this time period i will get noa2 and be well on my way. My fiance is excited about traveling with me on the road.. Thanks for advice!

Can I update or add anything to a K1 package that is at Vermont under processing? I think I may get an RFE for a timeline issue that may be questioned and I can correct it now before something triggers it.

I would like to send a letter of explanation and further evidence. Is this possible and if so, how? Would it replace my K1 in que if there is no RFE and they pull it out to add the additional stuff? I just past the 4 month mark and do not want to disturb it unless I was sure it would not mess it up before a possible RFE. Anybody do this before?

It probably is, However, you never know what the IO will ask for. I think I'd want to be prepared to have at hand anything on the list you can get. Better than being sent away to return another day with more evidence.

Well, I really not drawing any pension monthly, I'm not old enough. I just been taking some here and there and paying the 10% penalty on it since I am not working. So really I have no steady amount coming in each month, other than what I choose to take myself. For all of 2010 i took 3000 month. For 2011 so far I have taken 30,000 out in a lump some and really did not plan on touching it again. Will they look at these withdraws as my income if not working? I guess what I am trying to know is if the officer is going to look for a steady stream like a job or is my withdraws be looked at as ok to support her, even if not working at the time of interview.?

Heres my problem. I left a 30 year job in 2008 and took a pension buyout, meaning to create my own business. But due to circumstances I could not control, it never transpired into a positive way. So as of now I have been living on pretty much the pension money, so my taxes filed for 2009, 2010 is well above the required income. 2008 was w2 from retired job.

However I am yet to have a steady paying job, though I can still show money coming in from my pension, I prefer to be working again, buts its tough out there. My fiance is getting very nervous seeing we are coming up to the 5 month soon and she is worried we cannot prove enough income. Will the consulate consider any assets in lieu of income? I have many. I believe I have 3 times more than the minimal required. Also In Manila, they will not take a co-sponser, so that is not an option.

I may be working in April at a trucking company that another VJ member lead me too so graciously, but it is not positive yet? Any suggestions will be appreciated.

Also, did you answer honestly in question #11?

If so, you should have told them about both petitions. If you left one out, you could end up with some issues for not providing full/accurate information.

Yes I answered honestly with an attached paper containing the past names, dates and places filed, though no case numbers as my records from the past 10 years on these have been misplaced..( true!) Is it possible to inquire about a past case status without any case or alien numbers for reference?

Ok I have a question concerning number of k1's allowed. And please respond with regard to my question, no judgement as to why all this happened, it just did.

In 2000 I had a fiance from China on a k1. All was approved and she ended with a 10 year green card, but unfortunately it ended a divorce. Then in 2005 I partitioned another k1, it was approved and sent to NVC but the process was never completed beyond that point, we decided to break it off. I never did cancel it but I am sure it was closed after the time limits. Now I have k1 in progress with NOA1 received expecting NOA2 by April or so. I read on here in another post about a limit on K1's. Is this true? Is a waiver necessary? Does my second K1 count since we never followed thru? If a waiver is required does it come back as an RFE?

It was much faster and easier in 2000, only 4 months from filing to the time she stepped off the plane in USA.

Does the officer at the POE gate still have the authority to stamp the work authorization in the passport or has this changed? I had a friend who's fiancee asked the officer for the work stamp at check in the airport and received it there, because it was a K1 and immigration was expected. Of course this was about 8 years ago. Used to be you could get it at POE if you requested it. If you didn't you had to file for it the normal way.

Thanks. Although I want her here asap, I have known her for over a year and waiting as long as I can to actually schedule the appointment will benefit both of us. I believe it will solidify our approval more readily than rushing in there with less than solid evidence of support under our circumstances, which we thought would be no problem until recently.

Hi All, Like many here, still waiting for NOA2. I was Nov filer so I know I have a while yet. But at this time it would be monetarily to our advantage to actually wait till the last remaining days possible to schedule the interview in manila, due to me starting new work and other things, I'd like to have as much time as I can under my belt til the interview. Now my question is this; The NOA2 has a 4 month validity date on it. Is this the time we have to SCHEDULE the interview and can actually have it scheduled beyond this date, or does the interview need to fall WITHIN this date? I think Manila is running 45 days for a scheduled date, and it would be to my advantage to wait til this 4 months is almost gone, then schedule the interview if possible.

I use this often to send to Mindanao with no problems.

If applying for a i-130 for a spouse, the current time frame is about 5 months or so. Applying for a relative other than the spouse, such as family members take much longer, I believe, several years as I understand it.
