Hey everyone! I received my bio letter -apt Jan 24th and my NOA1 was dated 12/26/12 although received about a week ago...Hope everyone is having a great weekend

PS I had the opportunity to hire a fellow US immigrant from a family based visa from India this week!! It felt good being able to hire her for her first job here in the US as I know first hand how difficult that can be!

Hi all:
OK so, I filed my own Canadian taxes this year (2011) after much research I felt confident in my filing. My result was a refund of $1300.00 CDN. When I brought our (my husband and I filed jointly) US taxes to a tax consultant she used my CDN tax info when calculating our US taxes. She said if Canada amended our taxes drastically and for example decided I was only due 300$ we should amend our US taxes as we would get more back, but if it was minor or we got more back, not to amend the US ones. I just received my CDN assessment and for some reason they were drastically changed but to the tune of a $3200 refund...!!!! My question is: do we need to amend our US taxes to reflect this difference and if we don't what/if anything would be the consequence?

Ok,so I may have an amazing opportunity with a US based company but they want to station me in Ottawa, Ontario by approx. Nov 2012. The issue that I can foresee is that I can only file for the I751 after Dec 15, 2012. IF I move to Canada in November working for a US company do I lose my ability to file for my 10yr green card? It is possible that after a few years I would move back into the USA working for the same company and even if not after all this hard work I do not want to disqualify myself in case we want to move back to the States down the road....I would hate to do this all over again.

Thanks everyone, I did apply and now they are questioning my right to work in USA....ugh...as if the Alien # from my green card on the initial application wasn't their first clue???? I'm sure it will work out in the end just annoying...

Hi all,
I became a US Resident in March 2011 (K-1), I was hired in June 2011 and have worked full time for that company ever since....well until this past Wednesday when my entire department was laid off. Am I allowed to apply for Unemployment? I know my husband signed something in regards to him being financially responsible for me for the next 10 yrs... so I wouldn't be allowed to apply for food stamps etc. BUT everyone I am speaking with tells me that unemployment is a bit different so I should be eligible...but they know nothing about the immigration aspect of things... I'm just not sure if it is against any of the rules or not. I don't want to mess anything up...

Since you were married within 90days of entry on the K1 visa the visa requirements were satisfied. The I-94 date is irrelevant. It would have only come into play if it ran out and you guys did not yet get married.Do not send the AP on its own without having a case number (NOA1) the chances that it will get misplaced/lost etc are EXTREMELY high. Just make sure she does not leave the country until you do receive an approved AP OR her Green card.

There is a number to call CRA if you have any questions...which is what I did about a week ago as I tried to E-file like usual and it did not work, once you live outside of Canada they must be mailed in and the address I believe is different for us 'international filers'. Just a note when filing your taxes for 2010 you are still considered a Canadian resident UNTIL you are granted permanent residency in another country EVEN if you POE'd Dec 27th then you are still a Canadian resident as of Dec 31st (I believe this is only true for K1 and not CR1 as I believe CR1s receive LPR status as soon as they cross but I,m not 100%). This changes how you file etc. I POEd Dec 30th and the CRA agent confirmed that since I only received my Permanent US residency this month I file as a Canadian resident for tax year 2010 even though I moved out and ceased to have a Canadian address as of Dec 30th. Hope this helps!

Since I got the green card the other day hubby and I decided to book our honeymoon! We are going on a cruise in 2 weeks!!! Soooo last minute but so excited We have never been on a vacation before unless it was to drive to one of our families for a visit.... WOOHOO

At the discretion of the CBP officer yes she can travel back and forth BUT she must be able to demonstrate strong ties to Canada so that the border guard doesn't get the impression that when she comes to visit you in the states she is just going to decide to stay and adjust her status from here vs. going back to Canada and following the Cr1 process.

If she does not want to be border bound in the US while paperwork is pending then K1 is not the answer as she would not be able to leave the US after the wedding before receiving either her green card or advanced parole (which in my case was a quick 2 months but it could be MUCH longer). Plus if you have already planned the Sept wedding there is no guarantee you would get this visa in time and for teh K1 the wedding would have to be in the USA and she would have to enter as your fiance and get married within 90 days of entering US on the K1 visa, since this is a one time entry visa she could not leave until like I said before she has her advanced parole or green card...
It looks like you would want to do the CR1 route, you get married when you want (not sure if it matters which country or not) and then you file the paperwork so that as soon as she crosses into the US (with proper paperwork) she is a permanent resident immediately and can come and go as she wishes (as long as its not for extended periods of time)

IF they are already married then they do not file I-129F as that is a fiance visa and since they are married they do not qualify.

I spoke with a US Border office asking the same question and he said as soon as they speculate that you are no longer living in Canada and therefore not just visiting the US they would start to monitor travel and most probably deny you entry into the US. Without a green card there is no way to live in the US and work in Canada...unfortunately as we were hoping to do the same thing. When I got my Nexus pass they warned me that if I started crossing regularly 4-5 times a week then they would flag it and it would become an issue.

The only thing that needed to be done before the expiry on the I94 was that you two got married so all is well jsut submit everything as soon as you can

Your new permanent resident card should be mailed within 60 days following this registration or after you complete any ADIT processing referred to in the welcome notice, whichever is later. If you move before receiving your card, please call our customer service center at 1-800-375-5283.
Well that was short lived, I've now gone back the way on the DECISION... Is this normal for them to do this?
I just got this same message about 3 hrs after getting the card production one...did you find out what it means???

I-485 card production has been ordered!!!!!!!!!!! No interview and approx 2months from filing date!!! Looks like we are going to have a honeymoon outside the US after all (we had to wait for hubby's vacation to recycle)
