I am close to send the papers for an AOS.
I just got married and had my medical vaccination exam.
I am now signing the forms and making sure that I have all the documents required!
I made a list, please let me know if I missed something :
- G1145, E-Notification of Application/Petition Acceptance
- Payment in the amount of $ 1010.
- I-485, Application for Ajustment of Status
- I-765, Application for Employment Authorization
- G-325A, Biographic information
- I-131, Application for Travel Document
- I-693, Report of Medical Examination and Vaccination Record
- I-864, Affidavit of Support
- Certified copy of marriage certificate
- Birth Certificate
- one Copy of the I-94
- one Copy of the Passport (biographical page)
- 6 photos for I-485, I-131 and I-765 applications
- one Copy of the K-1 visa from Passport and entry stamp
- one Copy of Copy of Notice Of Action for I-129F approval
- last year tax return for the I-864
- one copy of pay statement for the I-864
Is this list exhaustive of did i forget something ?
do we need to provide the 1099 form with the I-864 ?
I also have questions:
1/my wife (she is the US citizen) is a contractor fur a non governemental organization. she works 4 days a week.
in the I-864, Part 6. Sponsor's income and employment, does she have to tick the box:
- a. employed as a _______
or
- b. self employed________
she ticked self-employed but she hesitated, I wanted to have your opinion to make sure that I will not have a RFE for this.
2/ My wife will have a new job on january 31th. it is a better job and she wanted to add with the application a copy of her future contract. Is it necessary ? the last year tax income shows that we are above 125% of the poverty line (a couple of dollars above). I dont want to complicate the application. And as long as we are above, it's ok no ? what is your opinion ?

Read the form instructions carefully. The answers you seek are there.
If she's not employed then she should check box "d" for question 22, and enter the date she became unemployed. If she's never had a job then put the day she was born.
For question 23 she should enter "$0". For question 24.a she should enter "$0", and for question 24.b she should enter the amount from your step-mom's I-864A. Question 24.c is the total of "$0" and the amount from mom's I-864A. Check box 24.d since mom is submitting an I-864A (make sure mom includes tax returns or transcripts and proof of her US citizenship or LPR status).
If she has not filed tax returns then do not check any boxes in question 25. She needs to provide a letter explaining why she wasn't required to file. Being unemployed is a good reason.
Do NOT put a "1" in the box for "married". Look at the heading for that section. It specifically says "Persons NOT sponsored in this affidavit:". You are already included in the section titled "Persons you are sponsoring in this affidavit:".

My fiancee may not have the sufficient requirement to sponsor me because she has just finished studying also. I wanted to put another sponsor, her sister. Her sister will have to fill I-864A form (and not I-864 ?). Is this correct ?

Good afternoon everybody,
I am under the K-1 process. I had the visa and I will be flying to the USA on january 12th. I have some questions before my departure.
1/I will be flying from France. The ESTA website is for the travellers flying through the Visa Waiver Program (exemption of Visa). Do you confirm that I don't have to fill the form on this website ?
2/I took a return ticket flight as it was cheaper. Did you guys do the same thing ? Will it constitute a problem for the US border that I have a return flight I will not take?
3/ I have very good contacts with companies in the US which are willing to hire me. Unfortunately, They cant hire me with the EAD. They say I need the green card. As you know, I dont really know when the green card will be delivered. I work in the aerospace engineering.
I was wondering if I should join a letter along with my AOS explaining this. that even if companies are interested in me, it is very difficult for me to have a job without the green card, and request if this could be taken into account in the process of the green card delivery.
Can you give me advice please?
4/ I have a driving license here in France. Am I obliged to re-pass the driving license once in the US, or can I have an equivalence from the one that I have in France? If yes, I have to go to the french embassy to ask it ?

Out of interest (and without knowing your medical contraindications) an MMR vaccine can be given again after the first dose as early as just one month.. so I'm not sure why your doc wrote 2020...
To avoid an RFE you would be wise to see a CS to fill out Part 1, Part 2 (vaccination table ONLY), and Part 5. Usually this will cost about $50 (hopefully less, definitely shouldn't be more but some docs rip you off). Even though I KNEW my shots were 100% complete, as my form was marked incomplete, I went and saw a CS and had my vaccinations transcribed just to be safe...
And no, they won't ask you at the border about it.

1/When you say the CS has to file part2 (vaccination table only), this means that he leaves blank the rest of the Part 2?
2/Should I make the shot before seeing the CS ?
3/If not, will I have to go twice to the CS, one for the prescription, one for the shot and I-693 filing ? so twice 50$= 100$ ?

The people at the border are highly unlikely to know anything about anything.
If you are required to have another MMR vaccine, you will only have to have the civil surgeon give you that one vaccine and fill out parts 1, 2, and 5 of I-693.
You may not need it though, as it might be considered complete as it says to have the next one in 2020. As it is possible for K1 visa applicants to not do the DS-3025 until they after they immigrate, it might be that you only need to submit it if you didn't initially. On the one hand, medically you could have the second MMR by the time you file your I-485; on the other hand the doctor wrote 2020 so you might be fine.
The 2020 date is not written on my DS-3025 but on my health book.
Do I need to file I-693 because my DS-3025 is incomplete (because I only have one shot of MMR)?

Dear all,
I have a question concerning my DS-3025 vaccination form the panel physician filled before my appointment to have the K-1 visa.
I received my K-1 visa.
But I had a look on the DS-3025. it is incomplete because I had only one vaccination for the MMR in my life (I made it just before my medical appointment).
It is required to have this vaccination twice in your life. My doctor wrote in my vaccination record that I have to make the other one in 2020. The panel physician could not my the second one because you need several months between the both vaccination.
1/ My question is, when I will be filing for my adjustment of status (i-485), will I have file a I-693 ?( so to go to see civil surgeon)
2/ Will they tell me at the border that I need to do it ?

Is it sufficient to provide only one photocopy (I-94, passport, visa, NOA, birth certificate...) for the whole package? or is it necessary to attach a copy each time it is requested by a form ?

1. Yes - since you came here on a K-1 - it is understood you may need to travel prior to the GC.
2. Correct - once you have the GC - you no longer need the AP - however, if you leave more than 1 year on the GC, you will need a re-entry permit - prior to leaving the US.
3. Not sure what you mean - the AP is good for one year, multiple entries. If you need to extend that - you can.
4. I would not put dates - I would put "TBD" - but no matter - once you have the AP, you can come and go as you see fit - it doesn't have to be in those dates. (as long as you meet the criteria to use the AP).

I am filing for an I-131 along with the I-485. to justify the advance parole, you need to provide explanation concerning your trip. VJ provided with a guideline as a word document.
Last section is:
[Describe in sufficient detail the trips you plan to take. If you plan to travel more than once list each trip. Listing more than one trip will indicate to the USCIS that you need a multi-entry AP]
what do I really need to write ?
If I write something like:
I plan to return to Toulouse (in France), where my family lives, to spend Christmas with them. This trip should last 3 weeks, departing 15 December 2011. I would depart from Washington D.C. (as well as for the return).
1/ Is this sufficient ? do they provide you an AP with any kind of reason ?
2/ once the green card is granted, you dont need anymore an AP unless you dont go more than one year, right ?
3/ so I dont need to plan a lot of trip for the next years (unless I am not lucky and I dont have my green card in the year) ?
4/ with the provided dates, will I only be able to travel at this time ?

My EAD (filed under c9 category) is valid for one year
It says 7/22/10 - 7/21/11
Not that I need it now, because it arrived the same day as my green card.

Clearly the best way it to take one or two weeks to very well prepare the application are triple check it and send it, then all we can do is wait 3 months.

il faut mettre qqch de bcp plus formel ou ça suffirait (bien sur je le tournerai un peu mieux car là je me suis pas foulé) !
Egalement, dans le I-131, le I-765, il est demandé de remplir le A-number. c'est quoi ce numero ? c'est bien celui qui sera écrit sur le I-94 ?

1. Hard to say. It may be faster, but probably not by much.
2. Yes. You will only be authorized to work until your I-94 expires.
3. Phoenix or Dallas lockbox, depending on where you live. You only send it to the Chicago lockbox if you're sending it with your I-485, or after receiving the NOA1 for your I-485.
4. Yes. In fact, after filing under (a)(6) you can only seek a replacement for the (a)(6) based EAD, or a new EAD based on (c )(9).
5. No, not generally. An RFE for the I-485 should not normally delay the processing of the I-765.
If you decide to pursue an (a)(6) based filing there's a good possibility there will be a gap in your employment authorization. Most people don't get an approved EAD before their I-94 expires. My wife got hers five days before the green card interview, which was more than 2 1/2 months after filing the AOS packet. Still, if you marry and file REALLY fast, it might be possible.

I just received my K-1 visa and I am starting filing every forms I-485, I-765,.. to be ready and send as soon as possible the applications.
I'am not in the US yet (so not married).
I am currently discussing with a company for a job. I was not expecting to find a job before coming but, now here I am, there is this job so I try to find what is the best solution for me to be able to work as soon as I arrive.
I have found on VJ that the stamp on the I-94 does not work.
I need to apply for an EAD.
When filing I-765, I saw that there is two ways to ask for an EAD:
- as a K-1, section a6
- with the adjustment of status, section c9
I was expecting to file with section C9, in the same time as the I-485 application. this should take 3 months (or 73 days) from the time I send the application. my question is how long will be my EAD ? 2 years ? 3 months ? until the green card is issued ?
If I file with section a6:
1/ Will I receive the EAD faster than filing with section c9 ? how many times will it take to receive it ?
2/ WIll this autorize me to work only until the end of my K-1 visa ? (90 days) ? or until when if different ?
3/ Where should I file/send this EAD ? internet, chicago lockbox ?
4/ will I be able to ask another EAD under section C9 wif this one will expirate in 90 days ?
5/ If I file the I-765 along with the I-485 form, and if I have a RFE that only concerns the I-485 (for exemple if i need an I-693 medical form), will this also delay the EAD ?
If the company says me that it is ok to hire me, what solution should I choose ?
I am worried that, if my EAD under section C9 is not approved and sent within 3 months (for any reason, delays, request for evience,...), the company would not have trust in my application. So the faster I have an EAD, the more confident they will be.
I hope that I have well explained my case.

Mouarf, pas cool, j'ai fait juste un shot pour le MMR. Et le docteur m'a mis "complete", pareil le docteur ici n'a rien dit.
Pour le I-693, c'est compliqué... Bon de toute facon, t'es "incomplete", il faudra que tu repasses chez un panel physician ou civil je sais pas koi ici donc. Pour la deuxième injection, moi je crois que je la ferais ici sur place, en même temps que la visite, ca va te couter un peu plus cher que si tu le faisais en France mais ca va éviter des prises de tête.
De toute manière, si on est pressé par le temps et qu'on veut être sûr de pas avoir de RFE il vaut mieux faire remplir le I-693.
Je voudrais pas être rabat-joie, mais c'est très difficile d'avoir une bonne estimation de quand on va avoir l'EAD, j'espère que l'entreprise avec laquelle tu négocies est cool. ^^

ben j'ai regardé les estimations sur VJ, et en général c'est 73 jours, pas plus pas moins (ça peut aussi dependre). mais en général on l'a assez vite puisque cette autorisation existe pour pouvoir travailler avant d'avoir la green card, qui, si on rempli tout comme il faut, prend moins d'un an.
je sais qu'on peut pas trop garantir j'ai assez confiance que le EAD prenne 3 mois, il faut que je fasse tout pour etre pret pour l'envoi.
D'ailleur avez-vous vu qu'on peut demander un EAD sur la base du K-1 (a6 à la question 16 du I-765, et non c9 adjustment of status) ? ça doit permettre de travailler pdt ces trois mois du visa K-1.
j'ai une question aussi, faut-il joindre en doubles les documents demandé à la fois dans le I-485 et leI-765 (par exemple, 2 photos, la photocopie recto verso du I-94,...) si on remplit tout en meme temps ? ça voudrait dire 4 photos d'identité (voir plus si le SSN ou le I-131 en demande aussi), 2 photocopies,...
qu'as-tu fait toi EasternDE ?

Je compte partir en octobre ou bien apres noel, suivant si j'ai un job ou pas (je suis en négociation avec une entreprise).
j'ai quelques questions pour le I-485:
- doit-on joindre le I-797C ? sur le step-by-step de VJ, ils n'en parlent pas. je ne sais meme pas ce qu'est ce formulaire, il n'y ait pas sur USCIS.
- doit-on joindre un I-130 ? pareil, VJ n'en parle pas, donc normalement non
- le I-693 : sur mon DS-3025 (le formulaire que le docteur rempli), il est écrit que mon historique de vaccination est incomplet : "applicant may be eligible for blanket waiver because vaccinations not medically appropriate (as indicated above). le AOS, peut durer de quelques mois à plusieurs années. mais à en lire les time lines il semble que c'est souvent faisable d'avoir la green card dans les 9 mois ou on a rempli le AOS.
ça depend de l'endroit ou on demande la green card.
certains ont reçu la green card ici ? combien de temps ça vous a pris ?
pouvez vous commenter cette estimation de la durée svp ? à l'ambassade ils te disent 2 a 3 ans, mais est-ce vrai ? si on est un bon dossier et qu'on fait toutes les procedures correctement, ça peut bien prendre moins d'un an.

Ca s'est super bien passé!
Premier appel pour prendre le numero..
Deuxieme pour rassembler les papiers. La dame etait tres contente avec moi car j'etais tres bien preparé.
La plupart des candidats avaient des erreurs de formulaire ou des oublis de pieces a fournir. Y'en a meme qui avaient des avocats et qui se sont trompés!
Je pense qu'ils savent avant meme de faire cet itw ce qu'ils pense de nous car ils ont dit que ma candidature etait nickel avant meme d'avoir tout donné.
Ims reperent a l'avance si t'es un faux couple.
Du coup j'y ai passe a peine dix minutes alors que d'autres peut etre le double. Et je suis passe un peu avant tt le monde.
Ensuite jai fait l'itw avec la patronne... Lol elle a ete tres gentille , m'a demande ou je m'ai rencontré, ce que je faisais et ce quz je comptais faire plus tard, elle s'inquietais de ma situation plus tard (si je vais trouver un job dans ce que je fais deja).
Ensuite jai juré et on m'a dit que c'etait bon et felicitation!
Ah oui ils ont mis la pression un peu comme quoi je dois remplir mille papiers, et que je suis obligé d'y rester 3 ans sans partir.
C'est vrai ca ? Jai lu que c'etait seulement le temps d'avoir la green card ( environ 1 an).
Jai egalement demandé si je pouvais travailler ou demander un permis avant d'avoir l'autorisation qui prend 3 mois.
Elle a ete incapable de me repondre. Qqun sait si on peut travailler pdt les trois mois d'attente du permis ? Certains ont deja travaille pdt ces trois mois ?
Jai pu lire qu'il fallait demande au POE un tampon, mais jai lu aussi que ca ne fonctionnait pas... Qqun a un avis svp?
Sinon je n'ai pas eu besoin de fournir d'autres preuves, le sworn statement ne servait a rien elle me l'a retiré du dossier.
Si on est bien preparé il y a aucun soucis ca va vite et ils ne sont pas mefiants.

thanks a lot everybody hopefully you told me! 1070$, and I need to file again i-485 form as it is a new version since nov 23.
do you confirm that a copy of the I-94 document is good and I dont need to send the original (I have found pages saying one and pages saying the other) ?
alright, I follow the k1 AOS guide and I think I'm good now.
I wanted to confirm confort with the VJ community, I am suspicious with everything, USCIS drives me crazy !!!
