My case is the same as yours, i got the same letter saying the same thing, and i live in a different state too..

Guyssss. Go and check visa bulletin. If you are married to an LPR or USC. Youcan file for Greencard starting August 1 st to 31 st. I believe. Check it out. God is faithful

I applied my case in 2010.. I also received the letter saying that my case was transferred to NBC lees summit missouri for further processing that was last year and then this year in april they sent a letter asking me to fill a form I864W, which i did and sent out in april. Up to now still nothing!

I need your help as i have no idea what to do next. It has been since April since my vawa case was last touched.
Since then every effort to try and contact uscis for an update on why its taking so long, has been unsuccesful. i have tried to write to my congressman who in turn just got a reply that my case is still in review, i have tried calling but they wont give out any info over the phone, i booked an infopass appointment twice and both times refused any information, claiming the same thing they tell me over the phone. you would think that by me showing up with my proper identification would be even better than writing, but they refused. I was advised to write to them which i did. A reply came with the same thing my congressman was told, that my case is still under review.
am so frustrated! what are they still reviewing after all this time? I got a letter asking me to complete and fill out a I 864 W to complete I485. what is this form for? and does anyone have any advice that could help in my situation? thank you all in advance

Rachel I am sorry to hear about your situation but you CANNOT travel with a pending Vawa case. I am assumin you overstayed your visa and then you have a ban from reentering if you leave before receiving your green card.
Vawa Unit is adjudicating Vawa cases filed in August 2011.You will have at least 3 months ahead for your Vawa to be adjudicated.

Thank you so much for your reply. No i didnt overstay my visa. My husband and i separated after a domestic violence and when i left him, he withdrew his sponsorship and thus my K3 visa which i came with was revoked, and my greencard application denied. I dont understand whats taking so long, it is coming to the 4th year now.
am so frustrated.

Try sending them an email inquiry through the vawa l360 hotline.l cant remember how it goes but you can google it.l sent them an email telling them that my case was out of processing time,even thou they did not reply,they sent me a RFE two weeks later on feb 4.l applied about the same time as you in october 2011. sorry for the loss of your mom..

I wanted to know from the people who have gone through a similar situation as mine from my timeline. Is it possible to get a travel document to travel outside the country? if so, how is the process done and how long does it take? Any information will be greatly appreciated. Also, since my case was last touched in November of 2011, nothing else seems to have been done and am assuming that's because of the expiry of the VAWA programme?, but it has since been passed by the house and now awaiting the presidents signature. Any help at all on how to get a TD will be really appreciated as i lost my mum in Nov of 2011 and haven't been able to travel home to pay my respects. It has been very hard waiting and waiting and not hearing anything, even after writing numerous letters to them,stating that i need to travel home for my mothers funeral, they still didn't do anything. I also wrote to my congressman who in turn wrote to them, but got a response just stating that my case is still pending. I would think from what i have read from other VAWA applicants, that a congressman would be able to get more information other than the case is still pending..ooh am so confused and in dire need to travel back home. please anyone help me with information.

happy new year!!
Am a little concered, as you can see from my timeline, i have been waiting for an interview date for over a year now. it ha been 3 years since i filed my VAWA, and only recently i stumbled across this article, as i always try to be up to date with current immigration news. Any thoughts on this? i also heard from some fellow friends that VAWA has been closed, since it has expired and if so, what happens to our petitions? any info would be greatly appreciated.

It means they transferred it to process it faster, just like the notice says lol Why are you panicking over that?
LOL i know, i just might be panicky over nothing, but these things get scary at times. i am my own lawyer so i like to know every move they make with my case. I thought everything was handled by vermont.

Rachel! It means ur i360 was approved!!! U can start celebrating!!! U should receive ur approval in a week or 2!!
Inpeace, but my I360 was approved before. look at my timeline. this is my I485 that was sent to another office.
Oh that's good news at least someone can celebrate this week ....Inpease and the rest of us I hope we too can have a party next week..,,lol
you too, will get there my dear, it takes time, but it pays off in the end..

I just received this notice update about my I485 case , that in order to speed up processing, the case has been transferred to USCIS-NBC for processing. Does anybody know what this means? Am feeling panicky. please VJ fam, anyone, HELP!!!!

I am sorry to hear about your situation and also the condition of your son.Like CASE2011 has said we all here to help one another with our walk in vawa process.You dont need a lawyer.I filed for vawa myself as a spouse of a USC for me and my 2 children that I came with from my country to come and marry my husband here in the USA.We been married for 5 years and we have a child together ,went through all kind of abuse.Never called the police was scared as I was threatend of being deported because he used that on me even though I came on a k1 visa and married him within 90 days and never filed for AOS.I went to see a lawyer who told me ,I wouldnt be approved because I didnt have police report though he said I have all documents to prove marriage and good moral character.Wend back home disappointed then I told myself i can do it.I typed a 12 paged statement which took me 5 days,my 2 friends who witnessed the abuse wrote me statements .I Started with how I met him,how we fail in love,about the plans we had for the future ,how he came to my country ,how I came to the USA,when problems started and how .I documented every detail and dates ,What he said ,how I responded ,how I was affected as a result of being abused.I ended explaining why I never left the house to seek help at the shelter because he had threatend to use that against me if we went to court for child custody he would accuse me of abandoning my child as he wouldnt allow me to take him to the shelter with me because he has his own house,he had even offered me money to surrender our child to him.I explained that I said 4 yrs because I wanted to see and be with my child thus enduring the abuse.I was approved ,if you have any questions feel free we here to help one another .Vawa forum is a forum that is on my heart becuase I understand what someone could be going through for I know exactly what they are going through becuase I experienced it .

First, am really sorry you have to go through this with your child, it is hard, i can only imagine. I agree with the ladies above, you have all our support and advice, all you need to do is ask, i found so much love and support from people i dont know and probably never will, but the support system is amazing. Just keep your head up, and Its all going to be alright. I seeked an immigration lawyers advice, before i did anything, and after doign a lot of research and reading from other VAWA victims, i had the courage to do it all on my own, and without having to pay for a lawyer. just be honest, and provide as much evidence and proof as possible, even what you think is not important, might be the key to the whole process. As you will soon come to find out, most cases if not all, always get a notice for request for more evidence or RFE, so go back mentally into when it started and gather up all the evidence you have, it will greatly help in your case. all the best my dear, and am sorry you have to go through this. good luck.

You need to get yourself a lawyer. I don't understand though, after sending VAWA your husbands, ssn and drivers license that they would still question his citizenship. Mind if i ask, but is your husband originally from another country and is now an american citizen or how is he a citizen? I ask, because when they asked me for RFE i sent my husband's picture, date of birth and a copy of our marriage certificate. i didn't even send his ssn, but they found his info and proved his citizenship and hence my approved I 360.
I don't understand the part about you being in court and the judge asking him if hes a citizen, and the judge taking his word based only on his acknowledgement. Your husband has to prove his citizenship, by either a birth certificate or passport and other documents. I also dont understand when you say the DA will provide records to prove his status.It just doesnt add up, or am missing something in what you wrote.My dear, you need to book an INFOPASS appointment to talk face to face wth someone in that office about your case. making a phone call, and leaving a message for them to call you back, WILL NOT WORK!!
Of course they will help you, don't stress yourself too much. I understand your case because it is a bit similar to mine. It all depends with your case and the evidence you provide. Are u sure your husband is a citizen? Please make that appointment and they should be able to clear out whatever glitch it is that's causing vawa to request proof of your husbands citizenship, even after providing all the info you had to them. I went through the same thing, i had no physical proof of his citizenship other than my word. what i did was, i sent our marriage certificate, his full names, his date of birth, and i also wrote to vawa explaining why i cant provide proff of his citizenship. his pictures will also help. they have ways of getting the information themselves, but you have to provide as much information as you can about your husband. eventually mine went through, with only my word, pictures and the info i just wrote above. I hope this helps, also always seek advice from a lawyer. I did for advice only, but did the whole application myself.all the best and good luck.

No, i went there and the lady i saw said they dont do walk ins at Elizabeth, so i waited for my app date. I guess it depends with the location a,d the "mood" of whoever is in charge..good luck to you ...

1. get yourself a lawyer.
2. Make an appointment to your local embassy to see if they can help you with any kind of information.

Yes ofcourse you can get a GC through VAWA, based on an approved I360 petition. but you will be called for an interview.

Yes, you are eligible to apply for a new work authorization based on your approved I360. Then if you paid for the previous on your ex, please attach a copy of the receipt notice of your previous payment for i765 on a pending i485 or you can call USCIS Customer service and ask that you be transfered to the next level customer service agent. Mine was approved last month. Do you have a pending i485 or are you planning on applying for a new AOS?
Thank you for your reply. unfortunately, my husband confiscated every document of my initial application and all the notices are with him. i only have my expired work permit card to show as proof. should i just make a copy of it and send it together with the application? also i was told i can request for a fee waiver? i am doing my medical this weekend and as soon as i get the results i am sending my I485 together with my I765. any advice?

Am beginning to worry, my I 360 was approved on dec 09 2010, and the automated email said they had sent the 797 notification to my address. to this day i havent received anything yet. can anyone let me know if they have had or are experiencing the same problem? i dont understand. i wrote back to vermont and requested they send me another copy since i had not received the original one. they only touched my case and sent me another automated email that my I 360 was again approved and notification sent out on feb 24 2011, today is march 07 2011 and still nothing in the mail!!. i dont understand what is going on please help. now i just have to wait. i cant file my I485 or I765 til i get that 797 notification. i called the 800 number and the person i spoke to told me to file a form I-824!! where are they sending the 797 notifications? this really sucks!!

wow i thought i was the only one who's case took longer than the usual 5 months, mine took 12 months in total to complete...i will be putting my timeline soon, after i figure out how to do it

I am wondering how long it takes for a work permit to be issued once a vawa has been approved? Since my vawa petition, i havent been able to work, because my permit expired and they wouldnt renew it after my ex dropped his sponsorship. I did not include the wp application with the vawa because at the time i didnt not know i was supposed to. Do i need to send an aplication for my work permit to be renewed or do i need to fill out a new application process.
anyone doing the same thing, please let me in on the process...i appreciate any advice.
