  1. You keep it. It is needed for filing AOS. If you have an AOS interview, they may take it at that time. Otherwise, you have a keepsake.

    It is not JUST for a marriage countdown. It works the same as any other I-94, and you can accrue overstay when the I-94 expires. However, when you file for AOS, you enter a period of authorized stay and any overstay time will be forgiven when your AOS is approved.

    But the girl at the border, which didn't know really know anything, because I asked what to do with it, and she said, send it or ask whoever you are doing your AOS with, so I keep it? I don't send the original and make a copy and keep that? Ok so the whole I-94 is just so I do all the AOS steps under that period of time and they make sure I do, because they record it and are the ones who planned it?

  2. Hello everyone. How are you? Happy New Year! Ok so you know when you receive your visa, then cross the border and they give you like a I-94 form? Ok well that form is usually used for when you have a limit to stay in a Country. Well this time it was made/given to limit the time you have to get married, ect. But as its used for the 1st option and when you get back in your country you give it to the officer there, but this time around, there isnt that option, so who do you send it to? Do you mail it to the border, where I crossed? I crossed into Plattsburgh, New York. Bordering with Canada, Quebec.

    you can but you need wait the 10 days or so for dhs to updated your info in the computers system or ssn office will say they cannot find you. And you can do it after you get marreid as well if you want it in your married name. only diff is bring a copy of your marriage certificate with you. i waited til after we were married and got the card in mail so i could go to the bank and open up my new accounts.

  6. you can get a SSN before you get married, but you do have to wait at least 10 business days after your POE to apply for a SSN , it takes a little bit of time to get your info updated in their system. You will just have to go back to the Social Security Office after you get married if you change your name.

    So I gotta wait 10 days after I entered the U.S. to apply for the SSN?

    Ok can someone explain to me, the whole 1-693 form? Because I didn't know I was suppose to ask for an official copy to where I did the Medical for the Visa, which Im going back to see if I can get one, I did read in the guides that if you don't have it all, you will just need to do the extra stuff to a civil surgeon.

  7. You should really check out the guides. They are stickied at the top of the forum and they go through every step of the process in detail. You can also read reviews of POE which will give you an idea of what the process is like.

    Remember that no one cares about your visa more than you do- it's good to ask others for information, but it's also important to do on your research since you don't know what false information others may give you by accident. It can take awhile to do all the necessary research but you are immigrating, after all, and it requires some work :) VJ is a treasure trove of useful information, if you just look for it.

    Edit: I'm pretty sure that receiving your SSN is different for CR1/IR1 visas and K1 visas. I -think- K1s have to actually apply for it whereas it sort of comes automatically in the mail for CR1/IR1s. This is an example of why it's important to do your own research- although we try to be helpful, no one is an expert on every nitty gritty part of the process. Someone correct me if I'm wrong, I'm super busy right now and haven't done thorough research on the process beyond POE. :P You have to particularly watch out for the differences in CR/IR1s and K1s.

  8. Hi there - I had my interview on August 3rd. Unfortunately our lawyer said that we did not need a specific document, but we did. This resulted in a 221g (is said "Visa Refusal"). I was able to get the necessary documents the same day Unfortunately they wouldn't take them at the consulate and requested that I submit them via courier. I sent the documentation from the Montreal DHL (in Dorval) since I was already there the same day. I tracked the package and it was received by the Consulate in MTL the following morning.

    I received an email from the MTL Consulate after I inquired about the status of my Visa since every time I called DOS they said I was "in admin processing". This is what they said:

    Good day,

    Please note that all mail addressed to the U.S. Consulate General in Montreal undergoes thorough security clearance procedures at an offsite facility. This creates additional delays for the mail to actually reach our office. The date you claim the mail was delivered is not the actual date our office has received your mail. You may expect your case to be reviewed within 4 weeks from the date that the mail was sent.

    I ended up getting an email from DHL (Loomis Express) the evening of August 29th. My Visa was ready for pick up the next morning. It says it was "approved" August 26th. So in total it took 27 days from the time I sent the additional documents in to have the Visa in my hand.

    If you don't mind me asking what additional documents did they ask for? Ours were around my husbands 2010 tax return and although it wasn't requested by the Consulate about 2 weeks after I submitted the requested documentation I sent my husbands recent job offer letter. I'm not sure if this helped, but I had the Visa in hand 10 days later!

    Good Luck! And, hang in there. You'll be approved, it's just a little more waiting and the average is about 4 weeks. Start packing and enjoy a few more trips to Tim Hortons!

    Hi and thanks and congrats! yeah it sure is a rollercoster of a journey lol. Its actually pretty funny on how my visa was delayed, all the chaos they did, wasn't shown or asked at the interview, they only wanted an updated Fiance Letter. Because the one dated in March wasn't good enough, talking about commitment like a piece of paper does that, they say they always know everything, then they should know how committed me and my Fiance are lol.

    But that life, it is what it is lol. Im just taking it with the punches, being determined, positive and patient. The interview lady said it will take no time, my Fiance, sent the stuff today. But its ok a month not that far, anyways got bunch of stuff to finish up, organize lol.

    I always end up to destination just a few U-turns,dangerous curves lol

    Thanks again for the info and advice and a spank to your Lawyer lol. I bet you were both mad especially after all the money and time and energy spent lol

    Life is not a breeze but whom we share it with makes it so much better, even after all the bullshit, hardships, the fact that he is by my side makes it so worth it and makes me more determined and stronger.

    They might be the Government and think they own us, but they don't. I know to be calm and collected and patient but at the end its our way.

    P.S. how is married life? and living in the U.S.? :P;)

  9. They will not issue a visa if you need to send in more stuff. They will hold on to your application and wait for you to mail the missing documents and your passport through DHL. It adds an extra 4-6 weeks as it will sit in their mail room for that long before they get to it.

    They told me it won't take that long, can there be that chance? I much hate this, as it was not my error. But life is what it is, gotta take it with the punches lol.

  10. I don't know which originals your submitted so I can't answer that. All of them?

    Paperwork unfortunately doesn't end when you obtain your K-1 visa. In the U.S. you will have to apply for a social security number, trade-in your foreign driver's license, open bank accounts and take insurance (or be added to your spouse's). You will need your original birth certificate for most of those applications. You can research your state requirements online.

    Also, after POE you will have 90 days to get married. Once you do, you want to file for Adjustment of status (AOS) (to be granted your green card) ASAP and if you apply for work authorization (EAD-Employment Authorization Document) and travel authorization (AP-Advanced Parole) at that same time, they waive those extra fees for you. It's already $1070 for AOS so you better do everything at once. Typically EAD and AP are faster to obtain than your green card so most people people apply for all 3. You cannot work without either your EAD or green card and you will abandon your status if you travel abroad without either your green card or AP.

  12. Montreal is one of the busiest (and slowest) consulates. It's not unheard of that they lose things. Be sure to ask for your originals back because you'll need them down the road.

    At no point were originals asked for. They are listed on the Packet 3 checklist, but that's to bring to the interview, not to send through the mail.

    To the interview, bring copies of all the forms that you have filled out. As well as copies of the originals that you sent to the consulate (birth certificate, police check, etc)..

    So what documents do they need to give you back? They keep the original police check and affidit of support. And sometimes they ask for both and want both and some documents they give you back the copy or the original.

  13. Heh. You are either very relaxed or naive about the immigration process. You might end up sorry for relying on the fact they will have your stuff at hand at your interview. Sometimes, they do misplace things and loose files. You are in the position where YOU need to make a case. They don't have to go dig up anything for you.

    These originals you sent them are not just useful for your K-1. Especially your birth certificate. You will need them down the road for AOS and EAD/AP and probably to get your driver's license and open a bank account. If you can't get that back, apply for a new one asap.

    What is AOS? and EAD/AP? and what are the documents needed to get back?

    I'm neither relaxed nor naive. But I get where you are coming from.
