  1. Honestly....if you two decided to get married, in my opinion you are engaged then lol I hope you understand what Im saying...I dont think it is important for one part of the couple to actually "propose" to the other part...you know the whole popping the question thing...me and my husband did just as you did, we decided together that we wanted to get married, I dont even have an engagement ring lol since where im from the woman usually doesnt get an engagement ring i dont have a problem with it either...we wear our wedding bands, are married, love each other...even without one of us having proposed to the other...

so my opinion is...it doesnt matter if neither one of you has proposed to the other...what counts is you both want to get married (to each other of course lol)

  2. I've been reading around on here and it seems like everyone needs this approval. What if my daughter's father lives in another country and has only seen her once, for two weeks her entire life (she's 10 years old). How do I go about proving that? Or is it enough that I can prove that I have 100% custody, plus she has my last name and not his?

I'm starting to be a little worried about this because I don't think I'll be able to get his consent.

Sorry, forgot to say that my husband will be filing the I-130 (IR1/CR1 and IR2/CR2) for me and my daughter soon and we're gathering all paperwork these days.

Your daughters biological father has to agree that she leaves the country (unless you move to the country he lives in maybe?!?!). I don't know what form or sort of prove you have to provide for that though, sorry :(

  3. You can mail it to London as well. Then you just have to make sure your residency in the UK is proven well and you can prove your an USC. This can be done with the following

Proof of UK Residence: The U.S. petitioner must

provide evidence that he/she has permission to live

and work in the United Kingdom. Submit a copy of

    one of the following:

? Appropriate UK Entry Clearance Stamp(s); OR

? If Dual National, EU Passport – photo page; OR

? U.S. Military PCS orders assigning you to the UK.

? Proof of US Citizenship: You must submit a

photocopy of one of the following:

    ? Valid US Passport - biographic photo page ONLY;

    OR

    ? State-issued Birth Certificate; OR

    ? Naturalization Certificate

    Hope this helps

  4. I just have found this, maybe it helps...

    How to apply

The first step in applying for an immigrant visa is for the U.S. citizen (petitioner) to file an immigrant visa petition, Form I-130, with the U.S. Citizenship and Immigration Services (USCIS). A separate petition must be filed for each person immigrating.

U.S. citizens resident in the United Kingdom may be eligible to file the petition, Form I-130, with the USCIS office at the Embassy; U.S. citizens resident in the United States should contact their their local USCIS office for further information.

    and further

Who can file their I-130/I-360 at the London Field Office?

The USCIS London Field Office has jurisdiction for adjudicating I-130 and I-360 petitions from U.S. citizens who have permission to reside AND who do principally reside in the United Kingdom. See the I-130 Checklist for more details.

U.S. citizens who reside in the United States must file their petition with the appropriate USCIS Service Center in the United States.Be sure to include your U.S. address on the petition and submit the filing fee according to the instructions for filing in the U.S. which can be found on http://www.uscis.gov .

U.S. citizens who reside overseas where there is no USCIS Field Office may be eligible to file with the Department of State at the American Embassy. Please see that Embassy's webpage for local filing procedures at http://travel.state.gov .

I think this answers your question....

If you stay in the states you need to file with the USCIS office responsible for your area, approved petition goes to NVC, later everything will be mailed to London for your hubbies interview....

If you come back to the UK for a little while you can file in London, the petition is processed in London and the London Visa Unit will schedule your hubby's interview...

  5. I would agree with mllover...to do DCF you,the petitioner, have to go to the consulate in London, also proving that you still live in the UK at point of filing and have lived there for at least 6 months prior to filing. That's how it works in Frankfurt...I don't think DCFs differ alot from country to country because DCF is pretty much giving an US citizen the "privilege" of filing in their spouses country while they live there...just ask the consulate, describe your situation....that you are pregnant, would like to deliver the baby at home in the us while at the same time trying to file for your non-USC...maybe they will give you an exception if your husband has a power of attorney...you never know...call and find out or write an email

  6. Hi everybody!

After a few months of craziness I'm working on my immigration forms again... I'm still working on my Adjustment of Status thru marriage to a USC. The question I have now is regarding the I-130... On number 14 I answered "Visitor" since I entered the country with my B-2 visa. I'm not sure, however, what to write where it says: "Date authorized stay expired, or will expire, as shown on Form I-94 or I-95"... As I said, I arrived as a visitor but then I changed my status to F-1 (Student)... When my change of status was granted I received a new I-94 that had the same number as the one I received when I entered the country but establishing that my stay was authorized for the "Duration of Status"... I'm still in status so... Should I write the date in my old I-94 or D/S?

Any answer will be greatly appreciated...

    Thanks!

hmm... I don't know if my answer will help you any...but...if I were you, I would either attach a note saying what you wrote here or put the date your status ends...since you still have status stating the date from your old I-94 would be wrong in my opinion

  7. If you fill out the first part now and sign it with the current date (do not sign the second page yet!!!!) I don't see a problem with her stating her current age...what she could do though is fill and print everything out, just leave her age, date and signature blank and fill it in right before she sends it. and again, don't sign the second part! ;)

I cannot tell you anything about her name change, sorry

  8. Hey VJ members!

I have received my passport and documents package this Saturday! :)

I know one question has been asked here before...about the "missing" left upper part of the sealed envelope, so I didn't worry when I saw it ;)

I still have 2 questions though. The paper that covers the envelope....it is stapled only on the left side of the envelope...is that ok?!!?! Not glued on or anything? The envelope is sealed and my name is on it too...probably just worrying too much, but I'd rather ask...

and then, something that made me laugh a little...are there any college students out there???

I am...and on the cover letter at "occupation" it states "students/children under 16" lol I am sure it is just a category they use for children and students in general, but it reads funny and I probably would feel better if there's any other college people out there that have the same written on their envelope...

    Thanks for your help

  9. Good idea to call. I don't think I can still get travel insurance. I had the option to get one when we booked, but it didn't cover missed connections or lost baggage or anything like that so we decided not to book it...

And who knows what's going on that day. I fly on a weekday, so it might be enough, who knows. I'm sure I'll see when I get there lol

  10. Generally yes they do allow the spouse to come with you, however you will be separated when you go through secondary screening.

    Good luck

    regulations...haha...gotta love them!

canadian_wife...do you happen to know if delta is "nice" lol i "only" have 3 hours between my flights in atlanta and i think it might not be enough lolol and i would be mad, if we had to pay for another flight because immi takes forever

  11. To add on to this topic... do they allow the spouse to tag along through the same line?

My hubby has only flown once to the states, before we were married, and he got very lost in the airport when he split us up at customs in Ireland. He gets easily confused with all the legal jargon on the forms too, so it'd be very helpful if I was there with him.

I think he will have to go through the tourist line as well. Just ask before you get into a line.

  12. Hey VJ-members!

I was wondering if anyone ever had to send something to their embassy after the interview?!?!?!

My interview was last week and we only had a copy of my military police certificate with us, which wasn't valid. So I have been told to just drop it there or send it in, which I did. My tracking number said it was delivered this Monday (with a name of who received and signed for it). We were told it's absolutely no problem timewise and I will receive my visa in time for our departure.

As you can imagine the waiting is really nerve wrecking lolol

So any guesses on how long it will take til the mail man rings on my door??

    Thank you :)

  13. After the petition is approved you are invited to an interview at your closest us embassy. You have to provide more documents (birth cert, police certificates from all countries you have lived in since age 16, affidavit of support, passport etc.). After your visa is approved you will get your passport with visa mailed to you including a sealed envelope that you need for entry but are not allowed to open or damage. You will also have to get your medical done at one of the embassies panel physicians.

Just check the embassy website for your country, they should have a how to apply page somewhere on it with all the info you need. :)

  14. Hey guys!

Maybe someone can help me with my questions about the entry to the US.

    1. At check-in, should I tell them I have a visa?!

    2. Will I have to fill out the green form (I-94w I think it is) like others from visa waiver countries or just the white customs form???

    3. and then what line am I getting in at POE (Atlanta)???

I leave in a month, but I have been wondering about these question for a while... :help:

  15. Be, thank for your response. I'm petioning for my fiancee in the Land of Smiles. Looks like Payxibka is assuring me that I have no concerns in that regard.

    regards,

    Neilsy

Oh! I'm sorry, I thought you were beneficiary  and you usually can't schedule the date for her interview...once they know you have all documents they want or you have sent all documents they want they will schedule you.

I was wondering. We applied for my CR1 through DCF. On one check list you were supposed to enter you preferred travel date. Do you have to do that somewhere too?? Because as far as the embassy here is concerned, they try to schedule interviews close enough from that...

  16. hello

on the i 130 it asks the last adress we lived together and i dont know how to answer that. ishould i put her parents adress ? We stayed in alot diffrent hotels in vietnam hcmc ,tra vinh . vung tau ,angiang but never had a residents together .what should i write on that ?

    THANKS

    WREATH

You write you never had a residence together, so you will have to fill this out with N/A

  17. On both visajourney guides James's shortcuts and LingChe shortcut it say that your spouse needs to complete DS-230 part 1 and 2, but they both say for the spouse to not sign part 2, why is that?

sdw is right. you have to swear at the interview that all information given on the ds-230 form is right and then sign. I was asked who filled out my ds-230, i said I did and the lady said if i swear I have filled out everything correctly and agree to everything that is on the ds-230 form i can sign it now and handed it to me through the window... :)

  18. Dear VJers,

I read many of your timelines moving steadily forward, I am very happy for you guys.

However, my case is seemingly lost/stuck in somewhere...

I submitted my N-400 on 6/29, receiving NOA1 on 7/15 (NOA1 dated 7/13). Afterwards, nothing shows up online or in my mailbox.

I read USCIS online saying that I should be able to received my biometrics appointment in 15 days.

Should I contact 1-800 number to find out where my case is at?

Is there anybody whose case is similar to mine?

    Thank you all~

    collectroses

I don't know anything about the Citizenship process, but since the NOA1 date is "only" 7/13 I would wait whats going on this week and the call if I haven't heard anything from USCIS. It's summer time and maybe they have more work load then usual.

  19. I have to agree with you. I just had my Visa approved today (one paper is missing, so Ill have to still send that, but Im good. :D ). And yes, illegal is illegal, doesn't matter where a person lives illegally...I also have to agree any illegal immigrant costs the people that work and file their taxes, citizens of any country or immigrants, alot of money, that could be spend on more "reasonable" things... I don't understand what's going on in some peoples minds, thinking they can get away with it...after all its not even worth being illegal...everyday you have to live with the risk being pulled away from family and loved ones...I don't understand and I never will.

Edit: And I don't see a problem with being checked for immigration documents, its an "id" card, just like all the other small cards you carry around with you...have it with you and you're fine :)
