  1. Hi everyone,

    We submitted our AOS package and included AP and EAD applications too. Thing is, I only supplied 2 photographs. Looks like 6 were required.

    Does this mean RFE? We got our txt messages the app was received, but I'm guessing when things get processed, we'll get some sort of letter asking for them?

    P.S. The AOS guide should more clearly state (more photos necessary if filing I-765, etc...)

    Your wife's visa expired the moment she entered the US; the only condition/deadline she had to worry about is getting married to you within 90 days of her arrival (which you both have done).

    The document that will now establish her legal status is her I-94, which is pegged at 90 days (the time she needed to get married to you). Even then, there are members who have filed AOS after the I-94 runs out...there are no set deadlines for filing AOS, however it is highly advised that she does so as soon as possible so she can receive her EAD and/or AP while her green card is being processed.

    Once the AOS is filed and you receive the NOA1, she will remain in legal status until the USCIS completes the processing of her AOS application.

  3. Yes. Still some grey area however. We wanted to apply direct with her new married name, but they said they could only apply the first time with her name as it appeared on her passport. Fair enough. But then she said we would have to go through homeland security to get the legal name change. Maybe she was referring to the AOS process??? Then she said after that, we could go back to change the name on the SS card.

  4. OK, so as it turns out, there WAS a work authorization number on the back of the I-94 stapled inside Shamim's passport. I never saw it, so shame on me there.

    So, today we go back to the SSA office in NH and get a different woman. She doesn't even ASK about the work authorization. As soon as she looked up Shamim in the computer, the SAFE system already had her in there as work-authorized (temporary). Had the first woman lifted a finger to help us, we could have saved a trip and a lot of headache.

    Bottom line, SS card is coming in 2 weeks. :)

  5. No she can't work till she receives EAD and you will apply for that when you adjust status AOS along with AP after your marriage in January.

    She can apply for an SSN before her I-94 expires and as seeing she arrived here 6th November she can apply for that now as it has been a few weeks and she will be on the system.

    OK, but they would not even let her apply today, and they KNEW about section "C" when I showed the printout. It's not the need to work, but rather the health insurance that is a concern.

    The SS woman said her computer would not let anything even go through without some work authorization number. (Stamped on VISA or EAD).

    So, I guess its ~$1000 for the AOS and another $380 for the EAD.

  6. My fiance came on a K-1 visa and is eligible for work based on that visa. They did not give Employment authorization on her visa upon entry. The SS office said we need that stamp from immigration, or get an EAD ($380).

    There is an I-94 right inside the Passport. This is all the VJ SS Guide states we need. Maybe something has changed?

    Don't we need the SSN when we do the I-485? Or adding her to my health insurance plan?

    How long does it take to get an EAD?

    Something seems backwards!

  7. Yes, they did call it inactive. We'lL know more when they open the packet at the interview, but in my fiancee's followup call, he said it was inactive, possibly because there was no sputum to test, just signs of something in one lung on the xray.

    She is starting antibiotics now per their recommendation. I just hope they allow her to come and finish treatment here under the watch of qualified doctors.

    Sorry to hear about the AP. I've been watching your timeline because you have been filing at almost all the same times we have.

    Our interview is Oct 25, and I am going to travel there to go with her. I'm a bit nervous already now that I saw that they gave AP to your fiancee, and we have our own additional issue (my fiancee has inactive TB on her medical report).

    Keep us posted when you get out of AP, and I will do the same.
