  1. You sound really educated on this and have been through the process yourself. Manila does not like the acceptance of a co-sponsor but sometimes it is done by an immediate family member. What is different here is that the Petitioner has No Employment and living with his parents. (The Cousulate Red Flagged this immediately)

    The petitioner maybe allowed to re-file after finding employment. (I'm not sure but the currant Petition is probably Void) Maybe he can find immediate employment but I doubt that will be accepted. What was his 2010 taxes? What is the currant income for 2011? Theres no paycheck or means of support.

    I wonder how much time the Consulate gave to provide documentation of income and support.

    3 mistakes: 1. Booking a Flight before a physical Visa in hand.

    2. Planning a wedding when they already knew it would be dis-approved due to no real support.

    3. The assumption of the Philippines accepting a co-sponsor.

    Warnings: Sounds like she has a Passport and the flight is already paid. I would strongly avoid her getting on a plane. The intent of the visit will be looked at when you have a K-1 pending. (and a currant denial pending)

    I'm glad my husband found this site and introduced it to me. This site help me alot with my journey to US, from our K1 Visa till I got my US citizenship and petitioning my mother.

    With regards to my friend, I've been telling her that not to book a flight yet, and planned the wedding but her fiance was the one who did everything. About the 2010 Income tax return, his father is the one doing his taxes i think I'm not sure he is only the dependent of the parent since he has no job. So what will happen now to their case, The fiance needs to get a stable job, until then she can be approve? and what if he can't find a job yet what is the alternative they can do. Get married in the philippines and then start with K3 visa, but is the co sponsor will work with the K3 visa? thanks again for any help

  2. Hi, visa journey peeps, it's been a long time since I last visited this site again. Hopefully you can give some advice again.

    Ok this situation is for my friend. She had an interview last June 15 @ the US embassy of Manila for K1 visa unfortunately, doesn't look like her interview went well. The consul was asking her about more sources of income for her US citizen fiancé. Her fiancé has no job in the present only worked for 3 months since the time he submitted the application last oct. 2010. He had his parent as his co sponsor. He lived with his parent. When my friend went to her interview, the first thing the consul told to my friend was they don't accept co sponsor for K1 visa, is that true? So what will happen now for the application of my frIend, what is alternative they can do. The consul told her to present more evidence of his financial or sources of income but if the fiancé has no job, then what??? She already have a ticket to US and about to leave next week but if she doesn't have visa yet then what? also the wedding is set already first week of next month. My friend is panicking and don't know what to do.... Please need your advise. Thanks again in advance.

  3. Update: my mom's received her 10 years green card after 3 weeks since she arrived here. And last Oct. 12 we applied for her SS# eventhough I checked the DS-230 to assign her # upon she comes here. Good thing we went to SS office and check her status only to find out that her name wasn't in their system yet. So the customer rep. just told us to apply for the new # and it would only take 1 week to receive her ss card.

    Crossing our fingers we receive it next week. Good luck to those who still in the journey.

    Hi sorry for the late reply. When my mom went to her interviewed only simple questions that were asked from her. Like who is the petitioner (ofcourse it's me), How many kids I have, how long I been in US, If I'm married... It's all about the petitioner and was fast. Hope this help.

  5. Hi, my mom just arrived here in US yesterday. At the port of entry immigration officer asked for her brown envelop from the US embassy where she had her visa issued, x-ray, passport and custom form. The immigration officer took her finger printing and picture, stamped her passport and told her that her visa is good for one year until her green card arrive so everything went well until when we came home that I found n my bag that I forgot to turn in her I-94 departure/arrival card which I filled up when we were at the airplane. I asked my mom if the officer asked for any forms aside from the paper I mentioned above and my mom said no, also I didn't remember the officer asked for her I-94 card. So my question is does she needs to turn in the I-94 card, should I need to call department of homeland for it. Please I need some clarification. Getting worried that it may delay the processing for her green card. Thanks.

    Usually NVC release interview date every 2nd week of the month for the next month interview schedule so you are looking for October schedule. Did your parent start their medical exam at St. Luke's in Ermita? If not maybe it would be best to ask them to start their medical to find out if they need to undergo this dreaded sputum test as what "kulayblue" term. Goodluck!

  7. My sister in law's petition for I-130 (3rd preference) has been approved. It was filed by her mom in November 2005. Because she's Filipino, she's subject to per-country limits, which means that she'd have to wait at least 10-11 years before she can come to the USA (the current date is 01 May 1994).

    She is also eligible to apply for Japanese citizenship. If she becomes a Japanese citizen, would she no longer be subject to the per-country limit, meaning that she would get here about 8 years faster?

    I have the same situation too but for my sister. I am the US citizen and my sister who is a Filipino but residing in Japan for almost 18 years. She is married to a Japanese citizen and in the process of changing her Filipino citizen to a Japanese citizen. If in case she become a Japanese citizen this year or next year and I'm about to petition her as a sibling how long would it take for her to be approve and come here?

  8. I called again - they say they received the info on July 9th (so it took two weeks to make it onto the system) and to please allow 6 to 8 weeks for notification. Grrr!!!

    When I called NVC about my mom's case they said that too please allow 6 to 8 weeks to review the case. I think that's what they said to everybody's inquiring their cases. Just keep calling, that's what I did I called every week until I get my mom's case approval. Cheer up!

    How are you all getting on?

    We are waiting for NVC to forward our daughters case to the embassy - we sent in our DS230 in late June but nothing yet - and the log in at NVC is still active. So keen for her to get her it hurts.

    Did you ever called NVC and talk to the live operator? Usually when you send the DS-230 packet and all other supporting documents it takes less than 2 weeks to review the papers and then if everything is in order they usually give you an e-mail for the interview schedule or if there are missing docs.

  10. Thanks Joanne! The interview went well though my dad got into an accident in the 1970's and he had to go to court for that so there's a record of it at the NBI. Sure enough, it was asked during the interview and he showed documents (from the 1970's) that the case had been dismissed. They were told that the embassy will have to call the NBI themselves to verify. My parents were told by Air21 that their passports (I guess with visa - hopefully) will be delivered in 10 working business days. It's been 3 days so far so I'm very anxious...

    Where and how do they schedule that seminar? Thanks again! I didn't realize there's another step to do before the actual flight.

    You can make an appointment thru CFO website for their pre departure seminar but if your parent is 60 years old and up they don't need to undergo the seminar and just need to go their walk-in for the CFO sticker and pay only Php 400 for each

    No. The copy was already submitted when you sent your I-130 Application. Upon getting the email from NVC for the interview schedule usually they send checklist on what you have been submitted and what needs to bring in your parent interview. Goodluck.

  12. Hi All! I just want to update everyone on my mom's case. As you can see from my timeline, she already has her interview schedule this coming July 15, 2010! A loooooooong wait but all worth it in the end.

    I have a question for those who have made it before me, how soon can my mom receive her visa if she requests to pick it up from the embassy? I need to confirm her ticket.

    After the interview and when she pass, she has to pay Air21 I think for delivery of her visa. If your mom is 60 years old she don't need to do appointment at CFO since she is not required to go the seminar, otherwise you may pre register your mom's appointment thru the CFO website and reserve her seminar appointment.

  13. I have good news! Mom passed her medical! Yeheyyyyyyyyy! She will come back on Monday to do her vaccinations and to get her interview schedule. I wonder when they will schedule the interview? I hope the same week. I thank God for His infinite mercy and love! He has answered our prayers!

Okay, I log-in to the immigrantvisas.state.gov website couple of times and it always says "Sign in failed....Please be advised that the case that you have attempted to access is not eligible for further processing by the National Visa Center at this time. Please click on the Contact the NVC hyperlink if you believe that you have received this message in error." Does it mean my mom's case is complete? Yay! (L)

    That's a good sign in a couple of days you will received email for your mom's interview, probably in August since their interview schedule is mostly out 2nd week of the month for the following month. Hang on there!!
