  1. Hello friends, hope all is well.

    My mother in law is here visiting the United States. On the visa that's placed in her passport, the expiration date is 3 months from the date of her interview. Yesterday, I checked the stamp on her passport and the stamp is 6 months from arrival @ POE. The question I have is which date is valid? The one printed on the visa or the one that's stamped by the customs officer? Thanks.

  2. Not to sound negative but you're fighting an uphill fight. Are you sure that your parents didn't get to America and not listed as a spouse? Go try to find old paperwork (1-94's) showing names listed and relationship to each other. Secondly, find proof of your fathers citizenship and something establishing you and him as son and father. Last, get a lawyer. Like i said. you are fighting an uphill battle. I know a few people who have been deported and some have panned out and looked at it as a second chance at life. At least their not rotting in a prison.

    I've only seen one person beat he system and get pardoned by a Gov of his state. That was a fella in Washington State. He showed that he have turned his life around and he deserved to stay here in America. He didn't have a long criminal record. He is one of hundreds that were on the list.

    There are plenty of documentaries on youtube and one on netflix. You basically need a judge to stop the order and give you a second chance at staying. They haven't stopped many orders. You committed a crime, went to prison, shipped to ice after and you signed your papers knowing that if they ever passed a law sending Khmers back to Cambodia, they would come after you. Only immigration lawyers can give you counsel and represent you properly just to be heard. Good Luck

  3. I took my wife in earlier then the appointment date hoping we could get the Bio done early. Gave the fella a "we're going to be on vacation" story. He asked if we brought a copy of the itinerary. I said we didn't bring it. He then said next time,bring the proof and he'd do it for us since it was slow. Nobody in there besides us. Were went for some sushi buffet after that. Should of went straight home.

  5. You may go in. You might even be summoned to answer a few questions since you're there. The interview can be done either in English or Khmer. Most of the interviewing officers speak Khmer. Make sure to bring everything they ask for. They wouldn't hesitate for a second to send you out and have you come back because of missing or incomplete documents. Good Luck.

  6. Your in laws in Cambodia will probably get someone to take care of the process there. They are essentially lawyers (snakes). Bring with you a letter from work stating how long, full time or part time and how much you make. I brought my tax info from the previous year and the lawyer basically did the rest. Freshen up on your Khmer.

  7. I got mines in the mail when I passed my interview. My mom on the other hand got hers on the spot. They usually try to put you in the next open ceremony. I got lucky and only had to wait a week since there were a few spots left. My mom had to wait a month.

    Give then a call to see what's with the wait.

  8. Hey there,

    Don't worry too much about it. I sent in an I-130 with a similar mistake. I called them and just told them to note the mistake. The person on the other end of the phone is human. Unless you have some crazy mistake that totally doesn't make sense, it shouldn't be a problem and they will understand.

    You have a lot of time on your hands and I suggest you prepare for NVC. Things will go fast when you hit that stage. Start on the packets for NVC and make multiple copies of it. If you don't already have the documents from Cambodia, have it sent here. ( I sent a copy of her birth cert and they didn't accept it) (wasted a month) It doesn't hurt to check and check and check again.

    Keep communicating. That's probably the most important thing to do. That and football season kept me sane through out the process. Also, when you do a video chat, do a screen capture and make sure you have it set so it shows date and time and names. I used yahoo chat and printed those out with the pictures I submitted. I didn't care how personal the chat logs showed because I honestly don't think the CO cared too much after the interview about my private life and I most likely would never see that CO again.

  9. I've started video chat, but how would I prove this using FB Video Chat or Gmail Video Chat without any activity logs. Or do you recommend Skype for these records?

    Every time you chat, do a screen capture. It will save the image that you have on the screen at that time. I did that every time I was online with my wife. I printed those out and included it with the pictures. Good Luck.

  10. Oh ####. She does not even have birth certificate. She just requested to have her local authority made one. She only has certified copy.

    You're going to need to call NVC to make sure. I had the extract of birth certificate I sent first. Then they needed the original which looked exactly the same except the paper is more thin. Call her and see what kind of paperwork she has. Email me when you get the copy and I'll send you a picture of my wife's so we can compare. Sammeach@gmail.com

    Should call NVC first to clarify and tell them the situation and don't forget to send the police certificate. You will only need to send one. They won't ask for a new one at the interview. No extra fee's or anything. Just go in with the evidence. That's what you want to do.

  11. Then explain this to the consular when the interview comes. Do you plan to attend the interview with your fiancee? No one has said you WILL be denied. What we are saying is that you MAY encounter some obstacles. It is highly recommended that symbolic ceremonies are held until after K-1 visa approval, just to avoid any confusion that may lead to lengthy AP or denial.

    I'm agreeing with this. I sat and watched 4+ hours of people being denied in Phnom Penh. About 5 out of 30 interviews that morning passed. 90 percent of k-1's were denied.

    The interviewing officer will be able to tell right away looking at the picture's if it was a wedding or engagement. They know the culture very well and will see that as a red flag. I don't know your age but since you brought up that law, If there's an age gap. They will really scrutinize her at the interview.They may see it as trying to skirt around that law. A question may be asked 3 times in different forms just to see if the same answer is given. If you're dealing with the Cambodian government, money talks. With the U.S. Consulate, you better have your stuff straight.

    If you have the money. Being there at the interview will help support the case. You would have time to gather more evidence. (Pictures, receipts etc) It might be an up hill battle if you're not prepared.

  12. Send PCC. They will hold your file up and everything will be pushed back. Make sure everything has a certified stamp. Make it less of a headache for when interview time is up in Cambodia. They will send you an email with a checklist of what they have and what they need (if they need anything else). Your job is to try and send them as much as you can so you don't have to bring much later. I had an issue with my wife's original birth certificate. I sent a certified copy and that wasn't accepted. Pushed back her interview a month. Good Luck.

  13. Pack it in your suitcase. Don't worry cause it won't spoil. I've brought cherries and plums when I went over last year. No problem taking it out of the United States, just don't bring any fruits back cause you'll have a hard time. As far as meats, I'm not sure but I can tell you that there's plenty of meats out there. Phnom Penh is a modern city with just about everything you need. I prefer the fruits from over there anyway but cherries are good. There are malls and supermarkets there so you don't have to fill your suitcase with shampoo and soap. They have it there. Before my first trip, I thought everybody in Cambodia was still riding "ah-teah koa". I was wrong even though I did see many in the countryside. Its modern and more hustle and bustle then many cities here in the U.S. Don't worry too much and practice your Khmer.
