  1. I've already posted this, but didn't get an answer. I thought I had found one myself, but I think I was mistaken. Now, before I mail everything and get an RFE, I'd like to ask you all.

    My husband's mother is our joint-sponsor. She currently go by her married name (even though she is currently divorced). In the I-864, I've included her W2s and well as tax papers for the last three years. Everything has her married name. However, her birth certificate is in her maiden's name. She doesn't have her marriage certificate. So, I am wondering if this is something that will require an RFE or if, because they have her SSN, it's something that they can confirm on their own?

    Again, sorry for double posting. Feel free to delete one of the two posts. :)

    We were in the same situation with my mom. I think that's pretty normal for the birth certificate to be different from the W-2s, etc. since people frequently get married. I wouldn't worry about it.

    Well the expedite worked , Just got email from USCIS that my stepsons I130 was approved and they mailed out the notice today :dance: :dance:

    Now its time to get ready to dance with the NVC ..... Hopefully this will be quick and painless

    Yeah I don't know about sending a new i-130. As long as OP has the receipt number for the original i-130, that should be proof enough that an immigrant petition HAS been filed on behalf of the immigrant/OP

    It's true. I think the previous posters' experiences would make me nervous. Hopefully a copy of the 130 & the NOA would be sufficient.

  4. This is not the way to go about this.

    You will have to prove that you did not intend to get married while in the US, but you did.. so you will be misrepresenting yourself at the border. Which is a huge, big, red BAD IDEA.

    No. The OP said he/she was going back to Norway to begin the visa process. The only thing you can't do at the border is say you're not intending to immigrate (i.e. live here permanently). They're not doing this on a tourist visa. What the OP is planning is fine.

  5. Is it an offence to go to another SS office after getting a Reference Number from one office.

    I've been to the social security office 3ce now and still i cant get a card. i went when i just came in before my I94 expired, it was not approved. The officer said she could not find my info with USCIS. I went after my I94 expired but EAD approved the officer asked me to come back when i receive EAD or GC. I was there again on Monday (2nd August) with my EAD he said he couldnt locate my info with USCIS that my I94 has expired. He however said i should give him till Friday that he would sort it out. He gave me his number to call him. I called today and after 35mins of waiting on the phone he said i'll have to wait for about 3 weeks when he would have been able to confirm from USCIS or i wait till i receive GC. My GC has not even been approved and nobody knows when it 'll be approved. I feel so terrible. It means the EAD is not useful then. Its been a sad day for me. I thot the EAD 'll make life easier.

    I'm not sure how coming from a K-1 visa affects it, but you should be able to get the SNN with the EAD. We did that, and we had no problems whatsoever.

  6. Sorry about the double post. I could not find the original post cause it was posted in the wrong section. Still not sure how i got there. Thanks for the reassurance. I am thinking though that she should not put in her 2 weeks notice until after we have our interview. That way we dont give them something to give us trouble about.

    Yes, that makes sense. At the interview, it's good for both of you (if possible) to be employed.

    My wife (USC) is concerned about changing jobs. My interview isnt until the 24th of Aug. I will be continuing on to higher education so we will have to move. Wife has not been able to find a job in the new location as yet but was considering moving anyway and then trying to find a job locally once we were in the area. Is this allowed or is this a breach of the I-864?

    I am not sure where she saw it, but she thinks that she needs to have continuous employment until the 40 credits that the intending immigrant needs to obtain has been reached. She does not want to break her contract to the government.

    The way I see it, I imagine that she is responsible until the 10 years is up and as a result we cannot get any assistance or if we do, we have to pay it back. Hence, it doesn't matter if she is without a job for a short while.

    So any advice on this would be appreciated.

    I just answered you in another thread, but you are right, not your wife. She's only on the hook if you receive certain government benefits.

    The I-864 is a contract between your wife and the government, but it only means that your wife is liable (meaning she will have to repay) the government for any means-tested benefits that you receive from the government, i.e. food stamps, etc. If you do not receive benefits from the government, the contract will never be a problem.

  10. nor for any other visa--I once played host to a visitor (B-1--as he was supposed to attend a church-conference) who apparently entered with a total of $0.00 (and he was an absolutely horrid guest, who I was gladly rid-of when the conference started).

    My now husband entered on a tourist visa, and was detained for 3ish hours at JFK b/c he didn't have any money on him. I was traveling with him and had everything....nightmare.

  11. So, I got this notice today on the website. Never once have I received an email or text, even though I have it selected in my profile. Go figure. Anyway, back on the 23rd the site said EAD card production ordered. So, what could this letter possibly be?? The dot also changed to post decision.

    On August 4, 2010, we mailed you a notice that we have approved this I765 APPLICATION FOR EMPLOYMENT AUTHORIZATION. Please follow any instructions on the notice. If you move before you receive the notice, call customer service at 1-800-375-5283.

    For approved applications/petitions, post-decision activity may include USCIS sending notification of the approved application/petition to the National Visa Center or the Department of State. For denied applications/petitions, post-decision activity may include the processing of an appeal and/or motions to reopen or reconsider and revocations.

    We haven't received the card, but our interview is only 2 weeks away......eeeeek Gettin' nervous.

    They mailed the card on 8/4. I don't know why they have the system this way b/c everyone gets confused, but you get different notifications when it's ordered and when it's mailed, and the dot goes backwards on the status. Silly USCIS....

    I only got 1 notice.that was aug 3 says that on aug 2 I got my EAD approved and card production ordered.

    today when I checked the uscis website it is updated"aug 05,2010, this is all it says

    does this means that this notices were sent to me with the card already? thanks by the way for the quick response!

    Yes, that's the third update. When it says we mailed you a notice, it means, we mailed you the card. You should get it shortly. We got my husband's 2 days after we got the last notification.

    i read up on the law of 1 year for asylum.

    I would have to file a defensive asylum. Before I camt to eh U.S. I was married to a muslim in Pakistan too and then was granted a vistior visa to london where i stay on and off 1 year and visted 3 times. Then I came to U.S. I was exposed to western culture and wanted my life to be that way. I learned english well While in the U.S. and have had many restaurant Job opportunites. I have a future here with my husband. My husband is chritian and once my ex husband found out I was married here a radical group killed him in Pakistan. If i go back I will be killed 100% or tortured. I didnt file in the one year thinking since our marriage is real and we live toghether and are soon planning kids that its legitimacy would shine through. We both have a squeeky clean record in the U.S. The only proof i can get is that my ex-husband was murdered, i have recieved one or two calls in my early days (3 years back) of death threats but thats tough to prove. My case is just that. Theres nothing more I can prove. ANy toughts?

    Get an attorney. To get asylum status, you have to prove that you were persecuted on account of your religion, race, nationality, political opinion, or membership in a particular social group (there is law re: which group will count). You may possibly have a claim for asylum on the religion grounds (if you're saying you'll be killed because you married a Christian person, but it's unclear why your ex was killed and what that has to do with anything), but you need someone to work through your case with you closely and carefully. If you're in Connecticut, look for legal aid groups that can help you for free, if you can't afford an attorney.

    I've worked with asylum applicants before, and the best thing I can advise you is to get an attorney. This is not like the AOS where you just file forms. You have to make a persuasive argument grounded in the law that should be protected, and this is incredibly difficult to do without an attorney.

Hello guys!here I go again wondering if it's usual to have this touched on EAD after they told you that your EAD Approved and card preoduction ordered.I've been approved with the EAD last AUG.2,got the email notification on AUG.03,2010,today I just checked my case says POST ACTIVITY.is it normal??

    Do they really have to mail first the notice that you got approved or do they mean that they sent me the notice with the card in it?

    Assuming that the EAD process is the same, regardless of which visa you are adjusting from....

    you should get at least 2, maybe 3 notifications from USCIS.

    1 - notice of card production being ordered

    2 - same (maybe)

    3 - notice that it was mailed to you.

    That's totally normal. Congrats on getting the EAD!
