  1. We have been waiting only a month. For me the problem is that the stated processing time of five months appears to be meaningless. A lucky few are processed quickly. An unlucky many are way beyond five months. Someone else said it here that in the electronic age, the process should take at most a month. In another thread a former USCIS employee says the process takes about 15 minutes once someone picks up the file. There is clear evidence that K1 visas are processed much sooner at VSC. If it is true, and it appears that it is, the CSC is concentrating on I-130 petitions at the expense of others, then that is wrong. Any business that accepted a fee for a service and then decided to not provide the service because it wanted to provide other customers a different service could be not survive long in the market place.

Basically, if a petition arrives today and gets a number, lets say 7001, then the 7001st petition processed should be that one. I know there are petitions that require a RFE and some that so flawed that they cannot be repaired and processed. And there are some few that need immediate processing. Allowances, fair allowances, can be made for those situations. Other than that, it should be first come first served. And, by simply publishing the expected processing time of a typical petition and the number of that petition in line, a lot of the heartache could be eliminated. I think the five month number is a bogus number used to try to keep the USCIS from having to come up with answers when it not providing the service it has been paid to provide.

  2. I am trying to get an idea after Service Center Approval HOW long is it before National Visa Center is able to schedule our interview?

AND I do not have the case ID yet.. As my husband is in Bangladesh, he wants to appoint me the recipient of the package materials and I will fly to Dhaka when the interview is to be scheduled, but I have no idea what to expect from this... AND can not get through with the phone lines down.

Sorry but the best advice I can give you is just keep trying...

  3. thanks for the reply

but can you tell me how long he needs to stay in egypt to get married because my fiance has only ten days to stay in egypt

then he must go back to america for his job is this enough time to get married here ?

can i complete the rest of the steps or he must be here in egypt with me??

    needs an answer badly..

I am not sure if 10 days is enough to get married in Egypt, that is something you need to check with the local agency in charge of that process in your country. However, he will fill here in the states, so you could get married today and he can come back tomorrow and start the process. Just make sure that he has the marriage certificate along with all other documents before he leaves to avoid delays.

    Good luck

  4. is the very first step to apply for cr-1 visa is

to get married first in Egypt in the courthouse then start applying for the visa or he must filled the petition in America first then come to egypt to get married??

i am confused what exactly we need to do step by step pleaseeeeeeee

Hello, it is my understanding that you get married and then apply using form I-130, you can check this guide http://www.visajourney.com/content/i130guide1

    Good luck!

    Saludos!

  6. There are Latino gangs, white gangs, black gangs,etc... So NO, even if you don't want to agree with me, "IT IS NOT A LATINO ISSUE". People who join gangs do it out of ignorance, not because they are Latinos... Also, Puerto Ricans are not the only Latinos in the US, therefore they are not the only ones in gangs. While we are at it, Puerto Ricans CAN NOT be illegal aliens, they are American citizens.

Another thing, I am a native Spanish speaker, and have never gone to a job interview where speaking Spanish was a requirement, what kind of job is this person pursuing? Plus, having a private school education and all that was mentioned, one could think a place in a decent neighbourhood could be afforded... Anyway, I am sure that if I lived in a poor black neighbourhood I would have problems with black people, if I live in a poor white neighborhood I would have problems with white people... White picket fences in the suburbs are nice and quiet, I just hope once there you are not the one who gets applied a stereotype.

  7. No, but I have a relative who lives in Hoffman Estates/Barrington (I'm guessing they had a desi draw the city/township boundaries there) who earlier lived in Schaumburg.

This is NOT a Chicago problem, this is a problem that exists in every single city in the US. It isn't a Latino problem either, it is a social issue that covers every single race. I lived in Chicago for 14 years and never had a problem, now I live in NY and haven't had a problem either (knock on wood!).

  8. Hello,

My husband filed for my daughter in May (I-130 child under 21). We got NOA 1 very soon. We relocated and we also got mail that they have updated our address. It has been exactly 4 months today after NOA1 but we never got anything else from them

How long would it take to approve the petition? Website says average 5 months and I can wait another 1 month.

Can I call them after 5 months if we don't hear anything from them?

    Anyone filed in May?

Please let me know if anyone is in the same situation or how is the progress of those guys who filed in May 2010

    Thanks

Seems like things really slowed down this summer, there's a bunch of us who filed in May and haven't seen anything after NOA1. I know it doesn't help you (it sure doesn't help me), but there's a lot of us in the same situation and we just have to wait.

Sorry I can not give you a better answer.

  9. Employer provided health insurance is usually not a problem, but it depends on the employer's and insurance company's rules. Some VJ members have reported problems with being added to their spouse's insurance without an SSN. One member (that I can recall) reported a problem with the employer insisting on having proof of immigrant status (as opposed to non-immigrant status).

This was my case, I added my wife, no questions asked, not even her SSN.

  10. Ken, you are making me really jealous. hahaha. I envy the time that you are now spending together; not in a bad way. Just a little tired of the waiting. Willdefinitely try to head out to LA in the late winter/early Spring. I hope that good adjustment experience is not limited to the California crowd.

Robert, whenever your honey needs her Colombian fix try bringing her to NY, head to Jackson Heights and you'll be all set

  11. We're finally in the US!

The POE was a little slow. It seemed like over 20 ppl skipped us at the JFK office. It took about 2 hours from the waiting and stuff. No questions asked, and the EAD was stamped without asking.

The interview was on a Monday and we received the visa on a Saturday at the Domesa office.

    Congrats! And welcome!

  12. CUAL TARDA MAS EN SALIR?

PERO AUN ASI CUAL SERIA LA MEJOR OPCION ?

COMO ESE EL PROCESO DE SOLICITAR LA RESIDENCIA Y AL DEMORARSE SOLICITAR LA K3? GRACIAS !!!

    Suerte

  15. He would argue that the marriage was entered in good faith and if I don't do what I have to to make approval happen, then I am being unfair.

There is some truth to that, but then there is the part about misrepresentation. Hmmmm. I don't know if asking him "do the ends justify the means?"

    would mean anything to him.

I am stuck living in the same house with him right now. He comes to me almost everyday and I get this constant barrage of 'help me help me, don't leave me alone in this.' And if the stress by itself isn't making him sick then he is making himself sick. I'm not an evil compassionless person that doesn't mind seeing someone upset, even though he hurt me. You know, it's all these conflicting pressures that make this so difficult. :bonk:

My two cents... Forget about the immigration process for a minute, can you work things out? I don't know the specifics of your problems, and we don't know your husband's side of the story either, but a divorce is something that I don't wish on anyone. If the answer is no then try to help him by going about it legally, I am sure he can still get his 10yrs GC even if divorced, others have done it by collecting all needed evidence. But as I was saying, you are married to this guy, this is not just about an immigration process, this is about putting an end to something neither one of you began thinking you will get divorced. Remember all the effort you put into bringing him here or adjusting his status? I am not trying to lecture you, but if you still have an ounce of energy to dedicate to this marriage, it will be well worth it. Talk to God, he knows your heart and is wiser than any of us here on VJ.

    Good luck

  16. Oooh I see, I hadn't seen that before. After I read it I checked other forums to see what other people did in your case and only found a whole bunch of people confused as well. I would say, do as they indicate and maybe print those instructions so they see why you sent all AOS fee bills with only one check, you never know.

You do have to pay separate IV bills for each however.

    Diana

As always, thanks a lot for your comments. I was sure sure I had to pay separate fees for each application until I read that somebody couldn't pay the fee for one of their applications after they paid the first one, that's when I was all confused and started doing some research. As far as the IV fee, yes, that I know has to be paid for each applicant (sure, the cheapest one is the one you only have to pay once...lol).
