  1. The employment verification letter is not required, just can be useful. What kind of documentation does she have? Tax returns/transcripts and recent pay stubs? I think that would be sufficient as long as she is over the income guidelines.

    Yup we have the tax returns and pay stubs....i am only missing that letter.... thank you for the advice i appreciate it!

  2. Hello everyone! First of all thank you for this great website. This is my first post. I am collecting all the documents I need to send the package for I-129F application. I am sending some pages with copy of MSN conversation between my fiance and I as proof of communication after we met. Since I can speak perfect Spanish and she does not speak any English at all, we always communicate in Spanish. My question is: Do I need to translate all the chatting? It is a lot!! I also want to know if somebody in this group have a sample copy of a Dominican birth of certificate already translated to English. My fiance sent me her BC but it really contains words that I haven't heard before and Spanish is my first language!!. It will be a great help if someone can help me in this matter. Thank you very much to all of you. I am very happy that I found this group.

    welcome to VJ!!! Well i am glad you are getting the hang of this process and I wish you luck throughout your journey!! Well as for the emails and chat conversations if you have the time to translate them go ahead but if not just select a few emails and translate them....you will need to send a letter of her describing how you met and that will be in her native language...as for the birth certificate, i dont have a Dominican BC sample but you can go to a place where they can translate it for you (notary office) I am not sure how much they'll charge you. I hired a lawyer which he did all that stuff but it is expensive....Good luck again!

  3. Are you applying for a K-1 or for Adjustment of Status based on a K-1? Either way your co-sponsor does not need to write a letter. For K-1 they will need to fill out an I-134 and for AOS they will need to fill out an I-864.

    Keep in mind that for either one YOU as the primary sponsor will also need to fill out one of those forms (even if you have no income...you are the sponsor, they are just the co-sponsor.)

    ok got it... I just have one more question, my co-sponsor sent a letter to her employer for employment verification and nothing? do i really need this? i might not be approve because of this missing requirement...:(

  4. So....I'm kind of worried and I wanted to see what you all thought about this...

    We sent in our I-129F on 6/5/2010 (It was a Saturday, right before they closed, I know they don't mail on Sunday...) So today is the 16th and I haven't seen anything or heard anything yet...but I see that other people on here are getting them in a few days...then there is us who have been waiting 11 days and nothing so far. I'm looking in my bank account everyday waiting for them to cash my check but it's been nothing so far. :( I'm starting to worry that something is wrong. I double checked the address for the VSC and I wrote the address down correctly. I also read that some other ppl got a text message on their phones, or a phone call. We are just wondering what the reasons could be as to why we haven't received any signs or anything yet.....

    Should I call and ask what is going on? Let it go for a few more days?

    well i would advice to wait a bit longer it took 2 months for me to hear from them...it all depends on how busy they are...but if you can't wait call them to see what's the deal...eventually they will sent it and let you know they got your petition.....Good Luck!!

  5. Can anyone tell me...for a K-1 Visa, Item number 11 on the I-134 affadavit asks If I intend or do not intend to make specific contributions to the support of persons named in Item 3.

    In the example form it marks neither and says N/A (K-1 Visa for Permanent resident) is this correct?

    or do I mark Intend and state specifics even thought this is for my fiance who is coming over to stay permanently?

    The sample is correct!!!

    Im trying to get a visa for my fiance and

    yesterday i received a letter from the juarez consulate saying that they have started to process our application and that my fiance has an open appointment and could attend any working day . I thought we had to schedule an appointment. Please advice if this has happened to you.......

    yes, this means you have to get all your documents together and go to C Juarez for your interview/// the letter tells you exactly what days you can or when they will not be helped. I am going next week with my fiance and I would advise for you to go with him because that makes the relationship more visible.....good luck!!

  7. How much income is needed to be able to prove you make enough for the Fiance visa?

    Do you just show them previous tax returns?

    Do you have to show them your mortgage or rental agreement?

    Actually for your fiance visa you need to prove you make more than 125% poverty income??? and also i believe it should be I-134 and not the I-864!!!!

  8. Hey thx to everyone for their replies.

    My American friend here in Norway works for Halliburton, the big oil company. He does have a base in the US, but he also has one here in Norway and pretty much splits his time evenly between the two countries.

    Also he recommended submitting the 09 Norwegian tax return because the income stated on there would be the same income stated on his US 09 tax return (which could then be sent to the embassy once it has been prepared ... but the fact that his half year residency in Norway may disqualify him sort of put a damper on that idea ... sigh.)

    It seems a number of our close relations have been quite lackadaisical(sp?) in filing their taxes. Some said that they've filed, but need to make adjustments because they either don't agree with what they have to pay back or what will be paid to them (By the way, in this case do you think I can still use these tax returns even while they're under appeal?). Its one thing or the other or maybe they're just lying to us that they haven't filed, but I don't think that is the case.

    Regarding the lady who interviewed me ... yes I definitely agree that its an issue of misplaced personality. She did not appear as if she wanted to be there. She seemed tired (of dealing with us stupid visa seeking people) and all around fed up. I think its understable to be a bit annoyed when for each case the wrong paper work and what not has been submitted, but rolling your eyes at people and being sarcastic and condescending is a bit unprofessional in my humble opinion. And she wasn't just this way with me, but with everyone. Before it was my turn she interviewed several people for tourist visas and then there was me and a gentleman waiting to be interviewed for a fiance visa. He went first and she was really tough on him. After her interrogation of him, she gave him the pink slip and I heard him say he's gonna have to drive an hour home and a hour to come back. She shrugged and then the man left. All throughout his interview I was like please God don't let this lady be the one to interview me. Please let me be interviewed by the much more pleasant gentleman to her left ... haha no such luck.

    Based on the reviews on here the Oslo embassy does have a reputation of having pleasant staff and I must say I've dealt with them before when I've applied for tourist visas and those who interviewed me were all very polite. Not exactly friendly (which I don't think they're supposed to be anyway), but polite and professional. They didn't make you look and feel like an idiot. I think I just had bad luck that day or perhaps I'm too much of a sensitive soul. Maybe that's my problem. :)

    Thx once again to everyone. I do hope you're all right that once I submit the requested documents we'll be approved. Fingers crossed.

    I will be praying for you and I am really sorry to read that this CO was not professional... I advise you to talk to your fiance and let him know that finding a co-sponsor is very important to be able to get approve! you still have a chance, it seems your fiance's relatives don't want to help because it is pretty ridiculous to say they have not file their taxes...And believe me I am in the same situation when it come to the lawyer dilemma, my lawyer did the same thing to me, but thank God I notice it because I am constantly checking the forms he gives me....my fiance is having his interview next week and I want everything to go right!!! Eventually, this lawyers only rip us off and that's wrong, thats why we pay them!!!

  9. He is asked specifically if he ever violated any law related to controlled substances on the DS-230. The question is "violation of any law relating to a controlled substance", so it applies even if he was never arrested. He will also be asked during the medical exam if he's ever used drugs. Coincidentally, if he was never arrested then they will not know he experimented with drugs 12 years ago until he tells them about it. It will not be detected on any medical test.

    Both the DS-156 and the DS-230 ask if he's ever been arrested for any crime. If there is no record of the arrest then he should probably get a report from the police stating that there is no record.

    State your current annual income on the I-134. Provide recent paystubs to substantiate the increase in pay.

    No. I only know of one consulate that apparently asks for an I-864 for K1's, and it's not Naples.

    Transcripts are generally better than a 1040 because they are produced by the IRS, and confirm the actual numbers submitted on the tax return. No W2's are required when you submit tax transcripts.

  10. Well then you count yourself has a dependent of your sister among all the other dependents.

    Even if you didn't fill a tax return you MUST fill an affidavit of support (when the time comes) on Your name as YOU will be the primary sponsor in the eyes of USCIS.

  11. Did you send the I-134? or the I-864? If you sent the 864 what happened as we've already sent in documents and we sent the 864.

    no, we need to sent or show the I-134 that is what they ask for in a K1 visa, therefore, it would be better if you talk to your lawyer... you will need the I-864 but that is when you get married in the US. If you already sent them they might sent them back or tell you to send the correct one... I am not sure what they would do but I would advise to talk to your lawyer... that's why you are paying him!!!

  12. Here is a link on the poverty guidelines (please use caution because those are the 2009 guideline and they could change any time)

    so according to that and taking 125% of the number it looks like $46,000 is enough for 7 people. So if you add yourself and all your dependents your fiancé and all his dependents and your sister and all her dependents and it's less than 7 person you're fine. If it's more than 7 people then you'll have to see if the assets of your sister can help.

    Also I wanted to add your fiancé CAN NOT go to the interview with only your sister AOS. He'll need one filled by you as well, even if you put $0 on every line of the form you are and will remain the primary sponsor.

  13. My lawyer suggested we send the I-864 instead of the requested I134 affidavit of support as it is more stringent and will be required when we apply for the AOS. I am wondering if anyone else did this?

    My lawyer did the same thing to me and I was advise to do the I134 instead of the I864..... I guess our lawyers are ripping us off!!

My sister made 46,000 this past year.... i am not sure if that would be enough, plus he has 2 sons and she add my daughter and I in her income tax??? I appreciate your advice!!

  17. Hi there...

    If you are in K1 process like your profile says, then your lawyer is obviously ripping you off. I-134 is the Affidavit you need if you are in K1 process. The other one i.e. I-864 is for AOS or marriage based immigrants. Your joint sponsor or co-sponsor should fill in I-134 and provide all required documents (pay stubs, tax returns, bank statements and that is because he/she really needs to show that he/she is willing to help you and your fiance and be your co-sponsor again once you are married and file your AOS).

    Good luck and get rid of that lawyer of yours. You can find tons of info and advice here, you don't need a lawyer.

  18. Don't worry about the I-864, it is for immigrant visas and the K1 is technically not an immigrant visa even though it functions like one. If your were applying for a CR1 visa, like I am because we are married, you would use the I 864.

    Edit: I should have mentioned that I do believe that you will eventually have to fill out an I-864 later on as part of adjusting status once the marriage has taken place.

    oh god thank you for giving me this infomation, because I have the I-864 AOS which my lawyer give me to give it to my joint sponsor which means this is the wrong one to do right????
