My case has mental and economical abuse, which is hard to prove for a man then a women.I did not had any physical abuse.

There are two prospective. One what is right or wrong and another What has to be done according to the law.
Of course many countries have same culture where children cannot disobay the parents, the reason he married. I don't think the same parents will back from their words and telling him to get divorce either? He bought here here, married and now when he get bored he is trying to send her back. Didn't that same culture teaches that the marriage is lofe long too? same perent teaches their children?

Ofcourse he can divorce. withdraw I 864. she will decide if she can file WAVA or not. He has all the advantage because he has his whole family in United states but She left everybody back home. One thing for sure.. She may or may not get WAVA but she will be completely breakdown emotionally. May be people like him grow without heart too. who knows.

Ice just follow the court order. ICE don't approve or deny the case. its EOIR where USCIS will be represented by attorney and Alien can either go pro se or hire and attorney. ICE only can detain the person if he/she is on flight risk. Hold then till Judge render his decision and then only they do the required steps to remove alien. Of course there will be removal officer assign when alien is detained. He will work side by side to aquire the travel document and permission from the country of origin so he can do his job to remove alien when time comes.

It is obvious that she is either going to file WAVA or she is going to filing good faith marriage waiver. Ig this is true what you have said, you should make copies and send it to immigration. these no Domestic dispute occured evidence will be attached in file and whenever she is going to go for immigration benifits this will pop up first. Officer will look into deeply to know if there was any violance occured for the claim as well as if she was entered into marriage in good faith or Just to aquire the immigration benifits?
