  1. In my case, They used the ones I sent with my application to the National Visa Center NVC.

    They asked few more at the time of interview, but those were returned to me.

    The photos were in the brown envelope, and the officer at the POE completed some information and he mentioned the package was to be sent to the Prosessing centre in Texas. He also mention the GC could come in about 2 to 4 months.

    I got a GC two weeks after I enter the US.

    For those who sent their passport or any additional documentation to Montreal, I just want to share my timeline:

    I sent my passport and medical exam on February 10th 2011.

    On April 28th I got a call from Montreal. They apologize for the delay, said they are very busy, and that my visa was issued, and sent through express-post because I should use it ASAP (Medical Exam Expiring soon).

    I got it yesterday,

    Total waiting time since I sent my documents 11 Weeks.

    I think the waiting time can vary depending in the consulate load. The waiting time to open the mail could be from 4 to 8 weeks. At this time, your passport could be in queue under a pile of mail waiting to be opened. Therefore; you can't find anything anywhere until they touch your mail.

    I sent my passport in February 10th, and is not shown any information yet, I am still waiting. Some people that submitted theirs by the end of January got response at the beginning of March.

    Just be patient, and you will get it when less expected.

I don't know if rules have changed recently, but What I have seen,is that Illegal people can apply from inside the US, When their priority date gets current then their cases are sent to the closest US consulate in many cases is Ciudad Juarez. there,.. the illegal pay the $1000 fine (The Waiver), and if that is approved they receive the Green card. That is very common in illegal people. I am not sure in your case as you enter with visa, but became out of status.

    The only thing that I see here, either way, you could stay illegal in the US, but you can't work or do many things until you case is completed. Or you can go back to Mexico, but is going to be a long wait separate from your family.

    the I-94 can be extended if is not expired and could be extended for a maximum of six more months.

  6. Your priority date means - ppl who had applied in 92 / 93 their application are getting worked on now and they are getting approved, so even if you apply today you will have to wait until 2011 becomes current.

    You are illegally in the country when you overstay in the country, for overstaying your I-94 date they can punish you by not allowing you in the country next time you try to enter on the B1/B2.

    Depending length of your overstay you get 3/5/10 yr Ban

    depending on your age, the priority date could be as earliest as 01JUL06 (F2A) if you are minor, but if you reach the age of 21 before the priority date reach your case, then you will jump into the next category (F2B)15JUL92.

    I think I might know the answer to this question but I'd just like to see what everyone else has to say about it...

    I entered US legally with B1/B2 Visa and Permission to stay I-94. While here my mother LPR petitioned for me. And I-130 is still in process. But I-94 has expired. (Not B1/B2 Visa)

    Will this affect me? Lawyer said this shouldn't be a big problem but Im still worried.

    Here is my opinion:

    If you are from Mexico, and the petitioner is Permanent Resident, Your priority date is July 15th 1992.

    If your petitioner becomes Citizen, then you will go into the next category which up today has a priority date of February 15th 1993. This is assuming you are single. You need to wait approx. 18 years to complete your case.

    Now you are out of status. Therefore if you leave the country you will be bar for 3 or 10 years. If you wait in the country you are exposed to be deported and get banned for the same time.

    In summary, you have a very long journey full of uncertainty.

  8. I just received a letter along with my passport from the US consulate in Montreal. The good news is, they had my mail after all and my file is still open for at least 1 more year. The bad news is I have to undergo another medical exam as my last medical certificate has apparently expired. I had completed this on January 2010. I received another 221g but this time I need to send them a valid medical certificate along with my passport.

    Thats really good news for you and for everybody here. Looks like Montreal works fine. at the end only took 5 weeks to get your response, and next time for sure you will get it with your visa. (Medicals are only valid for 1 year).

  9. I have a question about the invitation letter that is supposed to help support the B-2 visa application. From all the examples that Ive seen of these invitation letters, they sound really cheesy and unrealistic. For example:

    "Mother, I would like to invite you come visit me on Jan 35th 2011 and stay with me until Feb 01st 2011..."

    To me it just doesnt natural and therefore unrealistic, and I dont understand how this is supposed to help if it seems "fake." Personally if I were to invite my mom, I would say something along the lines of:

    "Mom, I have some free time around January 2011 through the first week of Feb, would you like to come visit me?..."

    What are your takes on this? Should I go for more realistic, or more descriptive but fake sounding?

    Oh yeah, I do have one other question. Ive seen on a few threads a mention of an addition letter to the US embassy overseas, basically guaranteeing that the foreign visitor will be financially sound while visiting, and that he or she will return after their short visit. Is this necessary as well?

    oh oh, I forgot one more thing! With technology nowadays, it would also seem more realistic to send emails rather than snail mail. Do yall think that bringing an email printout of the invitation is a good idea? Thanks again.

    There are plenty of templates online, and you can pick the cheesy ones, or the ones that you prefer.

  10. I am sorry that her visa wasn't approved, but I wouldn't be devasted for that. You can give some time and give a new try. Most of these visas are luck, and approval depends on the mood and the impression the interviewing officer gets from you.

    As she is 65, I would recommend giving sometime. More than prepare additional paperwork, just prepare herself for the interview. (remmember they analyze the person.(she needs to be extremely confident, and give short answers). when she is ready then re-apply. If possible, somebody who speaks english go with her (Seniors can bring one person). with the information that you have and having a good interview you will get approved.

    In my case, I help My father 70 YO, who doesn't have properties deeds or anything else.he was denied twice in my Country. I wrote a letter that my father signed explaining why he wasn't at risk of remaining in US (ties to Home country. I went with him to the interview. The officer didn't look any papers, only read the letter that I put on the top, and asked few questions through me. eventhough he was denied twice before, the officer approved him in a few seconds saying that he understand the case.

  12. Actually their parents are the ones that need to support them. They need to fill the DS-160 online, and need to compile all the support documents, such as letters from school (for the kids), bank statements, deed, car title, Business information, employment, etc.

    What you can provide is a letter of invitation where you compromise to pay for their expenses while in the US, and ensure you will send them back on time. (This is not very relevant, as the most important thing is to proof they have good ties to Chile, and they won’t stay in the US).

    Regarding to the trip, they can travel recommended with the airline. Be aware that many countries requires a letter from their parents authorizing them to leave the country (To prevent child abductions)

    i got my usa entry for 3 months... from 4th september to 4th december... so i stayed in usa for 90 days...... i was talking to my cuz on phone (she lives in usa) n she wants me to spend my christmas wit her n her family..... i booked my flight on 24dec to from dublin(ireland) to boston.. my question is will the officer at the airport give another entry to spend my christams wit my family???? im irish citzen.. livin ireland

    If you apply under ESTA, for a VWP then you will be ok, as you can re-enter the country multiple times for the validity of your ESTA (normally it is 2 years). each time you will be allowed to stay a maximum of 90 days (Short visit). They could question you for travelling few weeks from your previous trip, but you could explain it is for Christmas.

    If you didn't qualify under ESTA and applied for a visa, then you need to check if your visa is for a single entry (1) or multiple entries (M). that way; you will know if you will be allowed or not.

  14. I agree with ZEN DEN, mentioning your boyfriend will decrease your chances in getting your visa approved.

    The best thing could be pleasure, visiting your relatives, or going for some sort of seminar in your field.

    You need to show strong ties to your country, Like bank statements, properties, Title of your car, Etc.

  15. Another option, though it is a bit tougher these days in some States, is to apply for a student visa. You must be under a certain age, and it will be expensive tuition wise as a non-resident, but a much more viable option vs, a work visa.

    However, as International student you can stay in the US Legally while studying, but you are not allowed to work.

    my family is from south africa. they have plans to visit canada. during there stay in canada they asked me if at any point they could apply for USA tourist visa's while in canada in order to travel there if they wanted to? i told them that i dont think that is possible. i am not sure but isnt it that you have to go back to your own country to get a USA tourist visa? anybody who knows anything would be really helpful.

    For Visitors in Canada they Said:

    "Note to Visitors of Canada:

    If the applicant is not a resident of Canada, interviewing officers at the U.S. Consular Sections in Canada may not have experience in evaluating the circumstances in the applicant's country of residence. The applicant will, therefore, have greater difficulty establishing eligibility for a U.S. visa in Canada than would be experienced in the applicant's home country.

    A substantial percentage of visitors to Canada are denied visas under these circumstances. Consequently, visitors to Canada are strongly urged to apply for U.S. visas in their country of residence."

    FYI: My Dad was approved a B2 Visa, being a visitor in Canada.

    The worst that could happen is getting a "no", but you don't lose that much with trying (US$140).

  18. Thanks for the reply. I forget to say that way " My mother will be applying" . I am filling all the forms and everything on her be half that's why it came out like that.

    I would suggest starting with a visitors visa, then if she likes it, move to the green card application.

    Now as she is a senior I recommend adding on top of the normal requirements (Deeds, Bank Statements, etc) a copy of her health insurance and highlight how important is that for a senior person. Maybe add a letter from her doctor where he asks her to come back for a checkup.

    In the same way, as you are US citizen; you could write a letter in which you explain that she only wants to visit you, and she is not planning to stay in the US. if she would like to remain in the US, you could sponsor for a green card which she could get in a few months as a close relative, but you consider is no adequate for her as she only wants to visit and come back.

    I believe she has good chances in getting a visa, but all depends in how you present the information. Good luck

  19. What I could suggest for her, and depending in her career. She could find a seminar or short course in the US related to her career, register, and get a letter stating that she is going to assist to that seminar. With that and all the other requirements, such as Letter of employment, bank statements, car title, and if possible mortgage or deed, she could have really good chances in getting a B1/B2 visa.

    I am not sure about your status in the US, but If she only mention the purpose of her trip is to visit her sister, I see very low chances in getting approved; unless you already are a US citizen. But anyway good luck with the application.

    I also thought about open-ended tickets, but this doesn't seem like a good idea to me, that is, to arrive w/out a return date. I'm not sure immigration will like that. As far as her communication w/ the CBP officer, it will have to be through an interpreter anyway. Also, she will be showing proof of her ability to pay for her stay through us - just as she did at the interview. She cannot pay her own way as she has little money. We will be at the airport waiting for her.

    I think the best way to proceed may be to buy a RT ticket with a return date and simply change the date if necessary.

    Yea that sounds like the best option. Get your ticket with an specific date of return, and be sure that you can make any changes in your ticket without high penalty fees.

    In that case she has an specific date to tell to the CBP and support that with her ticket.
