  1. We are in the NVC stage with my wife petitioning her father. She has no income so she will file i864 and I will file i864A.
     

    My question is regarding her i864, specifically on household size. For part 5, number 6 it asks if she has sponsored any other persons using an i864 that has become a lawful permit resident. She has not but I have. It doesn’t ask me on the i864a. I’m thinking to add that person on her i864. Would that be correct or should I not? Any help would be greatly appreciated.

  3. I should’ve added that I sponsor a green card holder since approximately 2 years ago as well. I wasn’t sure how he would be included in an i864a if submitted. Would I add him to my wife’s i864? Through my hours of reading I understood that an i864a would only be submitted if she had deficient  income to sponsor. She has none whatsoever. I just don’t want this kicked back and to deal with it all over again. I’m far from perfect but I definitely aim for perfection.

    I have been reading for hours now to no avail. My wife has petitioned her father and we are now at the NVC stage, specifically the AOS. My wife has no income so her and I will both complete the standard i864. An i864a will not be submitted by either of us to my understanding. We file taxes as married/joint so we will attach the w2 for each tax year transcript submitted. We will both also attach proof of citizenship. We are confused on household count. Do we both list each other and our two children on both i864s? Do we both list her father as a "person sponsored in this affidavit?" We will leave household income blank on hers and will only be included on mine?

     

    The DS260 and civil documents have been submitted and this is the finish line for us, hopefully. 

     

    Any help would be much appreciated. Thank you, kindly.

  5. I was just worried about the following:

    Maybe I'm understanding it incorrectly. USCIS says living in marital Union for 3 years AT LEAST BEFORE FILING. Do you have to physically live with them or is being married to them enough. What if one was married but lived separately for 3 years before filing. Sorry for being difficult, I'm really not meaning to.

  6. I was reading the below material from the USCIS website, jus wanting to make sure that it's okay to file and if anyone else had a problem filing early due to this reason.

    B. Living in ​Marital Union for Spouses Residing in the United States​

    The spouse of a ​U.S.​ citizen residing in the ​United States​ must have been living in marital union with his or her citizen spouse for at least three years ​immediately ​preceding​ ​the time of filing the naturalization application.​ ​This p​rovision requires that the spouse live in marital union with the citizen spouse during the entire period of three years ​before ​filing​.​

    However, the statute does not require living in marital union for the period between the date of filing the application and the date of naturalization (date applicant takes the Oath of Allegiance). The corresponding regulation conflicts with the statute in stating that the spouse must have been married with his or her citizen spouse for at least three years at the time of the examination on the application, and not at the time of filing.​

  7. Greetings all, I'm getting ready to submit an N400 for my wife. Wanting to make sure I meet all the requirements so I don't lose $$$. I've been a US citizen for over 3 years, we've been married since 6/25/2012 but haven't lived together until she arrived to the USA pending her American visa. She arrived here on 5/24/2013 and we've lived together ever since. I've read everywhere and unable to find a for sure answer. Do we meet the living in matrimonial Union status? We've now lived together for 2 years and 9 months, do I want til we've lived together for 3 full years? Thanks for all your help in advance.

  10. You also might want to sign a few pages (of the last page that only asks for a signature) of an i-864 and leave them for your spouse. This way you can fill out the i-864 and she can print out the pages you sent her and she will have the pages with a signature. Don't date the page let her do it when you send it over. This way you will not have to mail it to her, unless you need a joint sponsor.

  11. If you look below in my signature, NVC is flying through my file. They sent me an email letting me know that my IV bill is ready to be paid. I just paid my AOS bill and have not sent in my AOS package yet. What should I do first, or does it even matter? I thought I had to pay AOS bill and send in AOS package followed by paying IV bill then sending IV package. I am filing everything electronically as required by Amman consulate. Any help would be appreciated. Thanks.

  12. I just read my original post and it is not very clear. I received 2 emails from USCIS, one on the 13th and one on the 26th telling me my case was approved and sent to NVC. Is this normal? It has been almost 15 days since the 13th which the NVC says it takes to input the case into their system. I am trying to figure out if I have to wait up to 15 days again from the 26th? Has anyone else received 2 emails from USCIS telling them almost the same thing? Thanks.
