  1. Hi!!

    Our I-129 F approved petition is on the way to Manila Embassy, I am now completing all the documents she need and our son for their interview. I'm about to finish the I-134 affidavit of support, and I am confused and don't know exactly what to put on

    QUESTION #8,The following persons are dependent upon me for support: (Check the box in the appropriate column to indicate whether the person named is wholly or partially dependent upon you for support.) My fiancee and I have a 1+year old son and I sent support for him monthly but I do not claim him as a dependent on my tax returned, since his not living here in the U.S and don't have a SSN. Should I put his name on the line? or does the question only pertains if I claimed someone on my tax return as having a dependent?

    That is a tricky one. I honestly don't know the answer and hopefully someone will come along that has a difinitve answer for you. I will give you an answer that I think is best. It is better to be safe than sorry. I would put that your son is dependent on you because you have sent him money. Since it will not show on your tax return they may or may not question you about it. Then you explain. Maybe include a note with it explaining. The thing is if you don't put it, they may assume you don't take care of your son, but if you do put it, I would think it wouldn't hurt anything. They may just end up being confused as to why he doesn't appear on you tax return.

    So to sum it up, I say put the info in there, it won't hurt anything.

    Also if you do decide to include the info, if you have any receipts from the money you have sent you may want to include them as well.

  2. I didn't get a slip. I just wanted to make sure that since they did not give me a slip it means that we are approved. Because when you're not, they do give you a slip, right ? That's what I had read.

    I'v heard different things. Pink slip means you are, blue means administrative processing, white more info needed. Who knows? Every consulate is different. I say without a slip I'm sure you are! I definatly wouldn't worry about it. Awesome! :thumbs:

  3. Well, as one very wise VJ member says, if you send WAY too much, you'll not have a chance to guide what they will read or see. Pick a few significant e-mails or chat transcripts from a month's period (tailor the amount to the length of your relationship -- the more months long, the fewer e-mails or chats), black out anything that's too personal, and include them. You may want to print a summary of the e-mails that were sent, rather than individual e-mails (such as date, time, and subject line, but no contents), and tally the number: "439 e-mails sent & received during the third quarter of 2009" or similar. Make it easy for them without causing their eyes to glaze over, si man.

    Great ideas!!!! I just didn't want to black stuff out and have them think we have something to hide.

    Geeeezzz, I was thinking of printing our entire chat log from day one! That would be like 300 pages!

    So you really think just bits and pieces from each month will do it?

  4. I had my K-1 interview in Paris France last Thursday.

    I was ready (a big and well organized binder !) but very stressed since it's something so important. Anyway, long story short, Madame Le Consul didn't want to see any proof of relationship and never said the words "you are approved". All she said was something like "the papers seem to be fine" and then "so we should be able to process the visa in 7 to 10 days". Things are, I don't like this "should" and I'm freaking out. I keep doubting myself about signing everything, about giving enough and I keep doubting them : what if they forgot something ? I remember they never asked me to sign any of the attached additional sheets I enclosed for the I-157 (the one that does not require a signature, but still, I'm worried). Of course, all this only came to my mind after I was out of the embassy. The process was so fast (I was out by 2:25) that I feel like it was an out of body experience and that I don't remember much. Do they systematically give you a color slip if you're not approved ? Why don't they say it, just to cover their butts in case they change their minds ? And I forgot to write down the envelope's tracking number so I'm back in the horrible waiting-and-watching the mailbox period. Please VJers, help me find some peace and sleep !

    What color was your slip? That is usually an indicator. I think different color slips have different meanings. Someone correct me if I am wrong.

    But I am with everyone else, it does sound like you got approved.

  5. I am in the early stages of gathering things for a K-1 visa. We want to have all paper work in order in hopes of going ahead with getting engaged in about a year. I am in love with a man from Algeria who has been living in Greece for 17 years on green cards.

    The BIG problem is our financial statues. I have money saved up but I have no W-2's for the last many years. He has a very limited funds as Greece's economy has crashed and so did his work. Now he is injured creating a big obstacle to work.

    Can we have a cosponsor? My parents are decently well-off can they sponsor me?? What about him? Does he need someone in Greece or Algeria to sponsor him too?

    Are there things I can start doing now that will make this process possible sooner than later? I know it will take time to build up financial stability but what are we looking at here??

    Concerning your W-2s, you can contact the IRS and request your tax transcripts from the previous years. This will be accepted and is your only options when your W-2s are not available.

    As far as a co-sponsor goes, co-sponsors from what I can tell are accepted at most consulates, but there are some that do not. If you know what embassy his case will get sent to, look their info up on this site and through their own website if one is available. Also try to find others that have gone through that embassy and see if they were successful using a co-sponsor. I am also fairly certain that most anyone can co-sponsor for you, family member, friend. They just want someone to take the wrap if your guy becomes a public charge.

    From what it sounds like, you to have not met yet. Am I right? If so, I have more advice for you :D

  6. My fiancée and I decided to get married immediately after my last visit, so she doesn't have her ring yet. Will this raise eyebrows at the interview? Maybe I can visit her before then.

    I honestly wouldn't see it being a problem. Yes it would be better, but what if the beneficiary doesn't have the money? What are they going to say, "Oh well your fiance is poor (even though the beneficiaries income isn't uneccessary), so you are denied based on that fact." I don't think that would happen. And if you just didn't have time you didn't have time. Mail one. I saw a post on here some time back where the beneficiary had actually sent money to the petitioners sister to go by a ring for him and I believe suprise her with it. I thought that was super sweet.

    I wouldn't worry about it.

  7. California USCIS received our I-129F on Nov. 12th, 2010 and we have not heard a single word. It will be 6 months this week and no RFE or anything.

    Anybody else out there in this similar situation?

    Have you tried contacting them yet? I would at this point. And if they don't want to help you out, it might be time to get your congressman involved. At 6 months that becomes an option.

  8. This is mostly true, with some important qualifiers necessary. USCIS is supposed to forward to the consulate everything that you send them, and the consulate is supposed to acknowledge and respect the existence of any evidence that they know USCIS has seen. See various posts by Marc Ellis (member name "ellis-island"). This is one of the concepts behind "front-loading" (including not just the information that USCIS requires for the petition, but also evidence of bona fide relationship for the consular stage later). Posts have also been made about evidence having been brought to the interview, but not accepted. It doesn't happen often, but it's a risk.

    Wisely choosing what to include as front-loaded material is important. In stories from many VJ members, it's stated that "it appeared that the CO had his mind made up even before the interview" or similar. This is why I recommend some front-loading except for the very easiest embassies & consulates. Some countries (Vietnam & China, for just two) have consulate-specific requirements that need to be heeded; see those subforums and embassy reviews for advice.

    I never actually thought about that. If you include too much when you initially file your petition,then that does give the consulate a reason in some cases to make up their mind about your relationship before you even get there. Do you think they actually read through your entire chat logs and your texts that you supply? I would hope not. I am a little disturbed myself about having to supply such things to them.

    With the DS156 form I (the US Citizen) is to fill out this form correct??????? I read through some of the questions and got a bit confused lol. Anyway thanx for the help once again.

    No. I'm pretty sure that is your fiance's form. All the papers in the packets that need to be returned to the embassy are to be filled out by your fiance except the I-134 affidavit of support.

  10. My tax in 2010 was under the poverty 125%. But, started a job in that pays me 15 dollar an hour and using a GI bill, but i wont claim it this coming 2011 tax return just because its a VA rule. Lets just say i make 15 an hour. Should i file a petition now and get a employers letter and current pay stab that i will make this much annualy. or wait till next year.

    Can you get a co-sponsor? And I am assuming you're in the military, if I'm not mistaken I think military only has to make 100%. Someone correct me if I'm wrong, but I am pretty sure.

    I have read posts of people being put on AP in the Philippines. Try checking out the AP forum, you may be able to get some answers to some of your questions there.   12. I would LOVE to go to London and wait it out with him, but I share custody of my children with my ex husband and could not take them to London so..... It's a very sad situation for us right now! My kids love him as much as I do and they don't understand why this is taking so long and miss him so much.

    Im sorry that really sucks. One of friends is in a similar situation. Here fiance lives in the UK and she would like to move there to be with him but here ex won't let her keep the kids. She even offered the same agreement. They stay with her all year and visit with him over the summer but he just wont go for it.

    I have children myself it's tough.

    I had my interview last April 15, 2011 for my k1 visa.. im little bit worried because its almost 3 weeks now my visa is not yet arrived..my friends I've meet during my interview in Us embassy .. have there visa on hand already and then my fiance call the Us embassy bout our papers they just told us its under review.. Im confused :( my question is ? Is there a possibilities that i can't have my visa ?If anybody encounter like my problem please post a comment .. I really need your advice guyz ! im getting depressed already . hahayzz .. i just miss my babe so much ..can't wait to see him .. Hoping my visa will arrive any soon now ..

    Sounds like you're in administrative processing. What country is your embassy in?

  14. Hi, all :) I'm getting ready to send in my I-129F packet and I'm wondering how much info is "too much".

    We have cell phone bills going back 2 years showing lots of calls between my fiance and I. Should we submit ALL of them? Or maybe just a portion of them from a few months throughout the 2 years? I want to make a strong case :)

    Also, I read somewhere to highlight important info and use post-its to point things out. Is this a good idea or not? (E.G. - Should I highlight my calling card number on the bill, etc, or just black out the non-relevant data?)

    I personally did not include very much info of our ongoing relationship. I put in copies of my boarding passes, a copy of my passport showing the visa stamps, a couple hotel receipts, a few pictures and on the back of the picture I put who was in the pic, where we were and the date. I also highlighted the dates on my boarding passes as well as our names and the dates on the hotel receipts. I also included a few receipts from gas stations and restaurants and highlighted the dates as well. I tried to include pictures taken at landmarks like the Burj al Arab, and Burj Dubai these unmistakable. So anything like that I feel is good.

    The point of the intial petition is to establish the petitioner is a US citizen, you are both free to marry and that you have met in the last two years. Establishing an ongoing relationship is expected more at the interview.

    Who should go to the interview? Should it just be the beneficiary, or is it helpful for the petitioner to be there? I'm assuming the petitioner is not REQUIRED. FYI, my fiance is from Canada.

    It is helpful for the petitioner to go. But some embassies do not allow them to attend the interview and others do. Check with your embassy or maybe someone will come along that has experience with Canada. If you don't get an answer try reposting this and include Canada in your title.

  16. hello, its a little nerveracking but i have just one question, when she replies to the consulate to say that she is ready and has everything neccessary to setup the interview, what does she send CDJ?? just the ds156, ds156k, and both i134s? or just the letter they send her? do we have to do anything online because its giving me an option to file a ds260??

    I can tell you though, to just get your head on straight and get it done! :thumbs:

    This is a trying process for all and you have lots of people to help you with both aspects, emotional and paper work! The emotional takes more of a toll than the paperwork unfortunatly :( But we're all here to help!
