  1. My then fiancé from Jamaica came to America on a K1 VISA. We were married, but never filed the change of status paperwork. He has technically been staying here on an expired VISA from my understanding. He left and went to New York to party. He was convinced that he could get a divorce from me and then marry another US citizen and stay in the country. We are now officially divorced, however he has met with an immigration lawyer, realized he was wrong and he is now asking me to sign a waiver to let him stay in the country? I am not sure what paper he is wanting me to sign, but as we are now divorced and he has not been honest with his intentions from the start, I do not wish to have any further contact with him. Do I need to report him to immigration to let them know we are no longer married and his VISA is expired? I don't necessarily want to make his life hell, I just do not want any further connection, ties, or responsibility for him. I am not even exactly sure where he is in New York, I have a possible address and phone number, but that is all. I am not sure if I am posting this in the right area, but as I started with a K1, I thought I would ask here :) Thanks for any information you can give me!!

  2. I just got married and we have not applied for AOS yet. So my husbands I-94 just expired...he went to stay with his cousin in Florida while I looked for a new house and while he was waiting to work we figured he could get some visiting done. Since he's been there he's changed...he goes out and partys he's mean to me on the phone and he's been nonstop txting a girl he met at a club (I know cuz he told me but he said he'd stop and hasn't) last night he said he wanted to be a free man meaning he wanted a divorce and he would stay in Florida...so here's my question people...because he's still in the country on an expired visa if we get divorced without filing AOS he needs to leave, right? Can I call immigration and give them the address and have him removed? Or I am going down to talk about it with him next week and I know he is now drinking and driving without a license often... CAn I take the license number and call him in that way? I'll be damned if he cets to use me to get here and then cheats on me and leaves....PLEASE ANY ADVICE WELCOME!

  3. I need a little advice...

    ...We were planning on already having my fiances AOS turned in however we realized when looking at all the papers needed that we need his stupid vaccination record and birth certificate (which was already in the K-1). While we wait for those to arrive by mail from Jamaica would it be ok to send the rest of the packet anyway, knowing we will get an RFE? My only reason for doing this is that we would like his EAD and APO at least so he can start working.....would they grant both of those and then give us the RFE or would this just delay all of it longer? Thanks everyone for you advice :)

  4. My friend and her fiance our about to set up their interview, here is the question. Throughout this process the beneficiarys father name has been listed as unkown for everthing (birth certificate, form etc..) However, they would only do the non-impediment if his name was listed, so the beneficiary got it from his mother. My question is, will it appear on the non-impediment and if so will this cause a problem since all his other forms have listed the father as unkown? Thanks

  5. your NOA1 will have a number on it and instructions on how to check your petition.

    If you are too anxious to wait for your NOA1,...and if you paid with a personal check, you can get your receipt number off there. Check your account online and view your cashed check, choose the back view of the check and it will have the receipt number that you need to register with USCIS. :)

  6. Thanks so much. Are the last 3 years tax returns completely necessary? My fiance is divorced and some of those old tax returns will have stuff like that on them, plus he doesnt work the same job as then so the income is pretty different than it is now.

    I read on the instruction guide that paystubs work as well as letters from your bank and employer. Will that be enough plus maybe this years w2?

    They say last 3 years to be safe, but if you could do tax returns for 2010/or W-2 and maybe 2009 tax returns, that would be good. A letter from the bank would help your case too, so good idea. I've seen people who have done that and they just state when the account was opened, how much money has been deposited into the account and current balance. I'd be afraid not to include any tax returns, so at least one years...However, just because he is divorced and both their income is on the tax returns from filing jointly: as long as his income alone is sufficient to meet poverty guidelines--that is all they need to see. Her income won't matter. For example, I used my mom as our Co-sponser and only had her sign the I-134, employer letter etc...Even though on their last 3 year tax returns my Dads income was on there too. But, it didnt' matter because they are only looking at the income of the Sponser. Hope I'm not confusing you...Let me know if you have any further questions.

While any other official documents would need to be translated into english, I think that as long as you can show on the emails that there were corresponding emails between the two of you they are fine. They say that you can black out any personal writings to each other anyway, so I don't think its really important what the emails say, just proof that you have a relationship and have been talking. Make sure though you show proof that it is your email and his email. Good Job on printing out the phone records that right there should be very good proof. Also, do you have any money transfers between the two of you? That would help as well. Good Luck with your Journey! :)

  8. Of course do what you are comfortable with, but the reason VJ tells you to do it this way is because that is how it will be put into a file at the Service Center. So it is appreciated because it saves them an extra step...two hole punching at the top does make it so you punch through some of the words on the top of documents, but it's eventually going to end up in a file like that anyway. I did it, with no RFE's and no problems. But again, do what you are comfortable with and binder clips work too (for me however, my stack was too big for any one clip to go over). I would however, do what Aya820 and VJ says and put tabs on the bottom, seperating out different sections (I placed the cover sheet and forms at the front and then put tabs for the rest that were labled: Proof of American citizentship, Proof of having met in person, and Proof of ongoing relationship). :)

Hey there--I can tell you that I have always flown either US Airways or Jet Blue from MBJ to PDX and as far as I remember...all the flights I have ever been on were 3+3, and one time it was 3+3+3. Most international flights end up being this way I think to accomodate for more people. But, like you said you can research the internet. The fastest way is to go to each airline that flys from MNL to PDX and act like you're booking your flight, because most airlines will then let you "pick your seat" (for each leg of your flight) and it will show you the layout of the aircrafts that your actual flights would be on. I know that's not much help....but it's all I got :)

  10. You are perfectly fine by abbreviating AOS...that is what it stands for on here :) You do not need to worry about the I-864 until you are petitioning for AOS. During the K1 process and for the purpose of the K1 interview, you need the I-134. Make sure you also submit (for you and also for your co-sponser, if you have one) your last three years tax returns, copies of most recent pay stubs, and a letter from your employer, along with the I-134. When you're just starting out, this can all feel a little intimidating, but with this site-you will have all the support you need! :)

    Note 6: In preparing your packet, please take note of the following:

    a. Do not use binders or folders that cannot be easily disassembled.

    b. Use ACCO fasteners to hold together thick or bulky applications or petitions. Two-hole punching the top of the material for easy placement in the file is appreciated.

    c. The use of tabs assist in locating items listed as attachments. The tabs should be placed on the bottom and not the side for ease in filing.

    d. Avoid using heavy-duty staples; instead use ACCO fasteners or heavy clips.

    e. Avoid submitting originals unless specifically required (Forms I-94, Labor certifications, etc). Avoid submitting oversized documentation when possible.

  12. I don't know for sure, but I think you are right....K-1 visa holders are on a temporary visa for 90 days unless you change status by getting married. So, when my fiance comes in December, I will be telling him to go through the visitors line....unless someone more knowledgable on here comes along and tells me different. ;)

  13. Unless Jamaica is different....Packet 3 only required the DS-230 Part I...so i emailed that in along with a scanned copy of the NOA2. Then for Packet 4 and all the papers that had to be with it....I combined all the I-134 papers (forms, tax records, pay stubs, employer letter) together and attached them like I did the I-129F (with two hole punch at the top of the page). I kept all the DS-156, DS-156k, and DS-157 all seperate (cuz they need easy access to them to staple the passport photos to) and only stapled the forms that had more than one page. I kept all the forms in a pile together (just not attached to each other), then I took my extra I-129F packet and front-loaded it with any of my new evidence of existing relationship. Anyway, basically I grouped the papers that were in the same "catagory" but other than that I tried to keep them somewhat seperate so we had easy access so we could pull out whatever paper they needed quckly and easily. I can't remember but I think I just left his medical exam, police cert. etc... seperate. Stick them in an open folder if you want so you're not carrying in a pile of loose papers, but you don't want to have to try and detach a certain paper if that's all they're asking for. Keep your stack organized but easily accessable! :)

  14. There are no forms to fill out with the NOA2. Your NOA2 looks much the same as your NOA1 it says I-797 at the top (instead of I-797C)...the main difference is below all the personal information instead of saying Receipt Notice, Processing Time etc....it will say: The above petition has been approved. It will also state that it has been sent to the NVC and that all furthur inquiries should be directed to the NVC. It states that you will be notified by mail when the NVC has sent your petition to the U.S. Embassy or Consulate. However, I recommend calling the NVC after you receive this letter (the NOA2) to see if they have received your petition yet, as the mail is SLOW. Keep calling and once they have received your petition not only can they tell you if it has been sent on to the Embassy but they will also give you your new case number that you will need when making inquiries to the consulate about your petition.

    Once you know the NVC has sent your petition on wait about a week and then start inquiring to the Embassy. Ours had to be done through email and they were usually very prompt in answering my questions, each time it took about 3-4 days to get a reply...which I thought was timely in this process ;) AS SOON as you know the embassy has your petition don't even wait for packet 3-- email to the Embassy the beneficiary's DS-230 Part I and a scanned copy of the NOA2...this keeps the process going much faster. (Make sure emailing it in is acceptable to your embassy)

    Don't know if you were looking for this detailed of a response, but I know when I was doing this every little detail was helpful and appreciated...so I'm just trying to pass on as much help as other VJers have given me! :)

  15. Hey thanks...yeah he has an iphone, So that's awesome news!!! I will tell him to make sure he has plenty of credit on it, and hope that works. My biggest concern is he's never flown before and hes flying into JFK, which can be completely intimidating for one who's never flown. I know he can just ask someone for help too! But, it's just nice to have a back up plan if he needs to call for ANY reason. So, if he puts credit on the phone its there just in case, but I will still try to take Nik+Heather advice and be patient cuz I do realize that if he's not having any major problems where he needs to call me, he might not have time for simple updtes. However, depending on immigration he has a 4 hour layover... :)

  16. Thanks Nic+Heather, you just made me smile and put me at ease. That sounds like something my fiance would do! I know he will be busy it's just hard not knowing...but you make some very good points. I will be a mess that day I'm sure, but you're right...no news will be good news...(However, my wondering crazy mind is great at thinking of all the What if's? that might be going wrong..lol). But, I will take your advice and try to have patience lol ;)

  17. Hey all...I was looking for some advice. I just thought about how when my fiance flys over, once he gets in American his Digicel phone won't work. He has a layover in NY before he gets to me in Portland, OR and we would like to make contact. Has anyone else had this problem and what did you do? I thought about sending him a prepaid cell phone, too little too late though because he will leave before the postal mail will ever reach him. I'm worried if he has any questions or something goes wrong at the POE he won't have a way to call me... It won't be the end of the world if he has no phone, but it would be a lot more convenient. Is there a place in Jamaica to by a prepaid phone that will work in America? Or what did anyone else do? Thanks All!! I'm just so glad he will be here soon (Dec. 2)!!!

  18. I posted this question awhile ago..but only got cynical answers. I'm still hoping someone can help me answer it...I have a friend who has been dating a guy in Jamaica for 2 years now. His mother is here in the U.S and had petitioned for him to come over, during that time my friend and he started dating. They have since decided that they want to be together but are unsure of the route to take...

    1)Can they apply for the Fiance Visa (and would it be faster for them) while the family based petition is processing?

    2)If he was to be denied for the family petition, would it have an affect on the Fiance Visa?

    He (the Fiance) insists that it will be a problem to do the K1 (and he would be denied) while his other petition is processing, so my friend would like to know if that is true and what is the best route for them to take at this point?

Hey there...I realize our interview was in Jamaica and you are Canada...but it should be the same idea...The passport photos that you have to take with you are for the forms (DS-156, DS-156k and DS-157). So when my fiance and I got to the embassy they took the passport photos and stapled them to the DS-156 for us. Also, they say they want the passport photos taken less than 6 months ago so that they look like your current self...so as long as there are no dates on the photos and you haven't had any drastic changes in your looks (hair cut or color change or drastic weight gain or loss) then you're fine if you have enough photos you don't need more...Hope this helps! :)
