    So this tells me that there are issues specifically just with Sally correct? I did submit the 864A so what they lost it? and what does hidden line mean? I hid something? The first page shows hidden  the second leaves hidden with no X .. so that's odd.

    Also I am confused on needing the 864 for Sally. The story is Dad submitted 864 as,  "I am the petitioner. I filed or am filing for the immigration of my relative" he didn't have income. His son submitted an 864 as " I am only joint sponsor" he's married so Sally submitted a 864A as HH member. So now they want Sally to also do the 864? What should she be:

     

    1. I am the only joint sponsor
    2. I am the FIRST joint sponsor or SECOND of joint sponsors
    3. or another option :(

    since you aren't combining income with your son, he can file an i864 and his wife the i864A, one for each child.

    Thank you! When my son fills out his 864 does he say he is the first of the joint sponsor and then his wife is the second of joint sponsor?

    I am the petitioner for my two children. I live in my adult son's house. I do not have an income. I believe I need to fill out my own 864 and say zero income? My adult son fills out a 864A or 864? and his wife also fills out 864A? Is my son then the first of joint sponsor and daughter in law is the second of joint sponsor? Also for my 864 my household size will or not include my adult son and his wife? I don't support them I live in their household. Since we at same residence are they technically "in my household". I don't know just confused. Thanks for the help!

    Thanks you two for your information! It goes back to a previous post about if it happened to Facebook it would have been fixed right now. I can't imagine something breaking on Facebook and that a week later their website would still be down. Is this an incorrect assumption?

    I just want to make sure these are the proper forms and boxes that need to be checked off.

     

    Petitioner (my father in law), is sponsoring (his two children), but income is low.

     

    My husband is going to use his income fill out the 864A form as they live in same residence. My father in law fills out the 864. The box my father in law checks on his 864 is I am the petitioner, I filed or am filing for the immigration of my relative. The box my husband checks off on his 864A is I am the only joint sponsor.

     

    Since husband income is enough do I need to do a 864A? We file taxes jointly. My mother in law doesn't work.. do we also need a 864A?

  6. My husband and I both sponsored his mother and father two years ago. As of two years they are both PR's. My father in law wants to sponsor his two children but does not meet the income guidelines. My husband wants to fill out the I864A and be a sponsor as well. I am thinking of getting a divorce. Thus I do not want to sponsor my two brother in laws. Is it required to use my income since we are married? He makes 3x the required min. his income is enough. If we don't use my income and I still responsible since that is my husband who sponsored? Also, my husband and I sponsored his father/mother two years ago if I get a divorce are the parents still my responsibility?

  7. Yes, the daughter is a USC. Ok, it makes sense how the sister in law was eligible. She must have been tagging along off of her husband who was the primary beneficiary.

    Does anyone know the process of the withdrawal of the current filing so that we can have the USC daughter apply?

    The form for the USC daughter to file for her parents would be the I130 I assume? and it's one for each parent and the documents required.

    Is the daughter a US citizen ? Then Yes.

    The spouse and children under 21 of the primary beneficiary tag along on the same petition. So in that way the sister in law also got eligible.

    The more likely scenario is that your uncle petitioned for his brother, and then his brother petitioned for his wife.

    It will generally be faster if their daughter petitions for them, as parents of a USC take priority over a sibling.

    If they want her to petition, they will probably have to withdraw their current petition.

  8. Hi Everyone!

    My aunt claims that her husband’s brother petitioned for him and for her. I have heard of a USC petitioning for their brother … but a USC can also petition their sister in law?

    They haven’t gotten anywhere with the current process through the brother and were thinking now that their daughter is 21 she can petition them. That they can some how switch who is petitioning for them and somehow speed up the process to have their USC daughter petition her parents. Does anyone have any information on this?

  9. I am sorry. My husband a US citizen is filing for his two parents who live in Mexico

    That makes my husband the petitioner. I am considered a household member because I am the wife. and I believe I am a joint sponsor because our income is tied together by us filing married filing jointly.

  10. We received our checklist today letting us know that the option we selected was incorrect.

    Husband and I are obviously married, and we filed joint tax returns and so we are using both of our income. I filled out a 864a along with hubbies 864.

    I am confused because I had called NVC on this and they told me to select that my husband was the first of the sponsors and to check off "I am the" and the "first" box. Now I am being told that the option should selected is incorrect and to update it.

    I have attached an image of what I selected. Does anyone know what I need to check off?

    Don't worry. You're fine submitting your birth certificate and your parents' marriage certificate.

    For additional proof: submit your baptismal certificate (if you're Catholic) and baby pictures of you with your dad.

    Your father's name on the birth certificate legitimized you for immigration purposes, so no worries.
