  3. I agree, it sucks. Not even moving to CA helps, we lived in Oregon when we filed (Jan -07) but the petiton was not transferred.

Petition sent on April 2nd, check cashed April 5th. And no indication that there's been a transfer to CSC. That pisses me off that once again petitions that are filed after ours get transferred while our's sits around getting moldy.
  4. I don't think it matters for removal of conditions. I'm from Sweden too. See my timeline below.

    Lycka till!

Does it matter which country you are from?

Are some petitions approved faster if they belong to a citizen of a country sending a smaller number of immigrants every year?

Maybe citizens of some countries experience less background checking?

I'm not trying to say anything here, just curious. Personally I think my journey has been relatively fast and was thinking that it may have to do with the fact that not too many people come here from Sweden every year. Then again, I may just be lucky.

  5. Yes, this is how I understand it too. But what complicates it even more is that the CSPA deals with the time the petition is pending, not when a visa number becomes available. The delays in I-130 processing actually benefits children in cases like this, read about it here: http://www.murthy.com/news/n_delays.html

If you choose to use the CSPA after your mothers naturalizes your age will be locked in at your age at the time of her naturalization. As of now, the fastest route is to stay as F2A. Bit this can change so keep a close eye on the visa bulletin.

So after doing quite a bit of reading I believe I have figured this thing out...

Currently I am classified as a child of an LPR, category F2A. If my mother naturalizes I become F1, under the CSPA I can choose to opt out and stay in F2A. Because I am over 21 when she naturalizes I am ineligible for IR3.

Please correct me if I'm wrong...

  6. I could not agree with you more. You can live without your parents but to be separated from your child is so hard, no matter how old he is. I filed for my son in 2005, when he was 20. I am hoping that the CSPA will work as it’s supposed to and his age will be locked in at 20. The wait will still be about three more years....

    Jenny

Thanks Maggie..... its so hard when your 6' 2" 26 year old son is in tears at the airport saying "Mum I so wish I could just stay" He can not understand how my Mum and dad will get their Visa's within 12 months of my citizenship but he has to wait years.... I have no answers for him..

  7. There is a law called CSPA, Child Status Protection Act that would appy to you. It's a bit tricky because it deals with the time the petition is pending, not the time you have to wait for a visa to become available. At least that's how I understand it. It also deals with the effect of not upgrading the petition when your mother naturalizes. You might want to research it, here's a link to start with:

Hello, I am seeking clarification on my situation.

I am 22 years old, never married. My mother is a LPR, soon to be USC (filing in a couple of months). I have a I-130 at CSC sponsored by my mother with a priority date of December, 2005. At the time of the filing I was 20 years old. I am not in the country.

From doing a bit of reading, my understanding of the age situation is that I am classified as a child due to filing/the priority date being given out before I reached 21. - Correct?

My mother will be a USC - it is also my understanding that I can be moved up into the unlimited category. - Correct?

If the above is correct, my following questions are:

Will I see any issues with the age thing when moving categories?

If all looks good, what kind of processing time am I looking at?

Any and all advice is greatly appreciated - thank you in advance.

  8. Hi everyone,

I filed in January to Nebraska Service Center. On April 1 we moved from Oregon to California. I changed our address online, got the confirmation letter in the mail about a week later.

Does anyone know what happens to the actual petition? Does it get sent to California for processing or does it stay in Nebraska? When I check the case status online it still has the same LIN-number. I am wondering since CSC seems to be very fast compared to Nebraska.

    Thanks,

    Jenny

  9. I entered as a CR1 two years ago. I checked that box and waited patiently for three weeks. Then I went to the local SSA office to check if I was even in the system. I was not. They asked me how long I had been waiting, they told me I could not apply until 30 days had passed.

I went back after 30 days, applied and recieved the card in the mail a couple of weeks later.

So in my experience the answer is no, it does not work.

  10. Sent mine to Nebraska on Jan 13, checks were cashed on Jan 19. Nothing in the mail yet.

Update: Got the NOA today, Feb. 6. Also recieved biometrics appointment for Feb. 14 at Portland ASC.

Update 2: Had biometrics done today, Feb. 14. Very quick fingerprints, photo and signature in Portland. Had to drive over 500 miles to have it done. There's only one place for this in the whole state of Oregon

  11. We are getting divorced and I will be filing a waiver for I-751 (I entered into the marriage in good faith but the marriage was terminated through divorce/annulment.)

I have all I need to prove bona fide. My ex-husband will also write a letter to support me. He is ok with signing the petition, so now I'm wondering if he should do that, even if we are divorced? Or will that just be confusing?

    Thank you,

    Jenny
