  1. Today I had my interview. It was a breeze really. My husband was with me because of the I-751 not being approved yet. We never got a letter that he had to be there, but we thought better safe than sorry. My husband was never called in, he was in the waiting area the whole time. The officer went through my A-file and asked if we were happily married. I said yes and I told him that my husband is right outside if you want to meet him, but he said that wasn't necessary. Then he continued to ask the have you ever-questions. I wrote one sentence, and then he asked me 10 questions from the list. He did ask all 10. He never asked to see any of the documents I brought. He congratulated me to passing the test and being recommended for approval. He said to wait outside a few minutes to get the result receipt. When I got it I asked how long before the oath and he said it will be in mid July, they do it once per month in San Diego.

    I have my citizenship interview on June 17, so I will most likely never get the 10-year card. I think ives_damian has already passed her interview.

  3. I got the interview letter today!! :dance:

    The interview date is for June 17. That makes it almost exactly 5 months from filing to interview. My I-751 is still pending. It will be interesting to see if we get a second letter requesting my husband to be there.

I was wondering if they ever gave you the option to skip the big ceremony and take the oath at the Chula Vista office instead? It's supposed to be possible to take the oath there just a week or two after the interview. They started doing that sometime last year. I will have my interview at 880 Front Street too and I will ask them about that option.

    I have been looking for other N400 applicants with a similar experience to try to gauge when we might expect our Oath Ceremony Date Notification.

    My wife and I applied at the same time and were interviewed on the same day .

    FP December 20 2007

    Interview March 27 , 2008 ( 880 Front Street)

    Oath Date ( Letter ) ?????

    I know its been only a month sice we passed our interview, and just wondering how long it might take to receive our Oath Notification Letter. We know other people in SD who have been given their Oath Dates on the same day as their interview. Anyone else interviewed in March 08 and still waiting ? It's been a long journey and we are so looking forward attending the ceremony together.

  6. I called again today. Got a nice girl on the line, and after a bit of persuasion she transferred me to an IO. He was a bit reluctant at first so I told him how worried I am about my case being lost and if he could tell me if it has been transferred to CSC. He told me the case has been transferred to CSC and my N-400 interview is scheduled for June 17! I was chocked! I don't trust anything they say really, so I continued to ask him if he could see what time and which office (we have 2 here in San Diego) and he gave me the time and place for the interview. O boy I sure hope this is correct. I don't believe it until I get the letter in the mail, but right now I am happy :)

  7. Yes, we are still waiting. No emails or letters about the case being transfered to CSC and the online status is the same. No touch since February 2007. 2 weeks ago I sent more supporting documents; updated lease on our apartment, new insurance policy etc. I ordered tax transcrips for 2007 as soon as our return was accepted. Received that yesterday and mailed it to Nebraska today. I also mailed a copy to CSC to update the N-400. I don't know where my case is, or my A-file. I have called several times to try and find that out, but no luck. My congressman is helping, sort of. He forwards emails to me from his liason, but it's mostly nonsense. No specific information about my case, just general info. I suspect my file is at CSC already, because of the N-400, but that's just my guess.

    Ha, we are in the N-400 citizen processing now, as soon as we filed our application, all the field office dates moved back from June 30, 2007 to May 29, 2007. That's progress?

    Sending a letter to the CSC office with our latest IRS tax returns, dog registration, and color photographs of our family and dog sure helped us. It not only let somebody at CSC know we paid a bundle of taxes, but we are real people that love animals, not just names on a sheet of paper.

    All I got from our congressman is what can cause global warming, and to borrow a word from our teenage daughter, Ombudsman sucks.

  8. Congratulations to everyone getting that email!! Where is ours??? :crying: We filed before many of you guys getting notice of card production ordered. Right about now I'm thinking we'll be tagged for an interview. Not that it's a problem, we've been together since 2003, it's just the hassle and annoyance of the whole process. A day off from work and all that again. We sent plenty of evidence. I guess we're just one of the unlucky ones..... :(

    Your not alone, I haven't heard anything either. No transfer email, nothing. I called today to try to find out where my file is. I got the most unpleasant person on the line that absolutely refused to let me talk to an IO. Told me I should be patient. :wacko:

  9. Just FYI for the group, my wife checked her status online this morning and sure enough, her claim was transfered from Nebraska to God knows where. I assume California? We have yet to get an email or snail mail notification of this. Jenny, our claim is 12 months in, and we were about to contact the senator after the 27th. Since you are well beyond 12 months, you should consider talking to your senator.

    I already did. He's liason says that my case is already at CSC. This is probably true, due to my filing of the N-400 to CSC in January (I have lived in California since April -07). I have also filed 2 useless service requests. Now I'm waiting for the citizenship interview letter. I have more or less given up on the I-751.

  10. My congressman sent me this reply today from his contact at NSC. It confirms the transfer to CSC:

    "There is a process in place where the I-751's are being sent to CSC. It appears from service records that the A file is already at the CSC office (He refers to my case and the reason my A-file is already at CSC is probably because I filed the N400 there in January). I will inquiry with one of the adjudicators that still works a few I-751's and see if it can be sent soon. I'm sure NSC is doing everything they can to get these I-751's out to CSC."

    I called USCIS but they couldn't tell me anything new. The guy didn't know anything about the transfer, I never got to talk to an IO. He did file a new service request, my second for this case. He wrote down in the request that my congressman is involved. Hopefully that can put some pressure on it.

  11. I had my naturalization interview today. Everything went very well. My husband had to be there with me because my 1751 is still pending. The officer just asked some general questions on my application to make sure everything was still current. She asked to see some proof of joint resindency and of our life together. Then she asked 3 / 4 questions about our relationship and then we moved onto the test. I was asked 6 questions, I had read one of them and then I had to write a sentence.

    She is recommending the approval and said that there is one more security check that needs to be done before she can approve my case. She said that I should get a letter in the mail in a couple of weeks and that the oath ceremony will probably be within 3 months.

    When I asked about the security check she said that it was local and that it should only take a couple of days and it should not delay anything.

    Hopefully everything will continue to go as good as it has so far.

    My I-751 is also pending. Did your interview letter say that your husband had to come with you, or did they send a separate letter about the pending I-751?

  12. My understanding is that, if you opt-out of F1, your son will stay in F2A. When his PD becomes curent, it will be determined if he is still eligible for that category (he did not aged out). If he did aged-out, he'll be put into F2B category... So, the question is if you can upgrade the petition to F1 after opting-out of it earlier ? I don't know...

    I don't know about that either, I doubt it. But the CSPA also states that: "The beneficiary may elect not to have the petition converted – or if already converted, to have the conversion revoked" and "the beneficiary's eligibility for family-based immigration will be determined as if his or her parent had never naturalized."

    I'm not going to opt-out until the PD becomes current, to have the conversion revoked then, because I filed when he was 20 years and 9 months. If they decide to approve the I-130, that only leaves 3 months and the CSPA won't apply. That's why I need to naturalize, who knows if they approve the petition early. F1 is a lot faster than F2B in my case. And if it will be determined 'as if I never naturalized', I am hoping that he will still be in F2A.

    I realize this is complicated and I will probably need to talk to a lawyer. I am hoping to find a previous case like this to refer to.

  13. I am getting the same every time I call too. Last time I called I got through to an immigration officer and she said that I-751 processing at NSC now takes 1 year and 30 days. One person on the NSC-list, Bertrand, fits into that timeframe. But no one has been approved after that as far as I know.

    Guess what …I called them today also and all I could get was "call back in 30 days" suggesting on the same time to keep checking on USCIS website like we don't know already how much ####### they post on their website . NOBODY KNOWS FOR SURE ..what's the processing time date for I-751 right now at least at Nebraska Service Center .

    I contacted again my Congressman today and one of their clerks told me that Nebraska replied back to their request (my case) saying that some cases will take a lot longer based on the applicant place of birth .Hmmmm…..I'm Canadian so I'm just wondering how long will take to process an application coming from an Iranian, Syrian, or any Arab nationality ?????? Let's admit this is another screw-up like we got accustomed to see coming from USCIS

    Their solution to my problem was " go and get a stamp on your passport " WELL…..I DON"T WANT THAT . I WANT MY GC not all kind of extensions .I hope someone from USCIS is checking on this website and maybe will make some notes!!!!!!!

  14. I can't really answer the question, but I am in the same situation. My son was 20 when I filed in April 2005, and will be at least 25 before a visa becomes available. Hopefully the petition will still be pending then so his age can be calculated using CSPA. I have applied for citizenship and will naturalize. The best thing might be for me not to naturalize and he will stay in F2A. However, if they process and approve the I-130, using CSPA won't help. He was only 3 months from turning 21 when I filed and F2B is a three years longer wait then F1.

    I will also opt out from the transfer to F1, but only if he can stay in F2A, not in F2B. I have read all I can find about this, and I can't find an answer. A real case where this has been tried would be really helpful. One would think there must have been cases like this before.

    So, does anyone know if an originally filed F2A beneficiary can stay in F2A after opting out of F1 conversion when parent naturalizes, or will he be in F2B after the opt-out?

    I was incorrect My step Son receipt date for I -130 is 12/5/07. He was 18 at the time of this receipt. Priority date in F2A is April 03 so he will be frozen at this age and we can opt not to transfer when his dad naturlizes correct? I have contacted a few attorney's and none seem to know too much about this law. You are a wealth of information.

    I have read some on this, my Husband a current LPR applied for his 18yr Son Receipe date is 12/15/07 at USCIS. The father will not Naturlize until the child is over 21. Does his age freeze now or when he gets the DS-230 from the NVC.

    You are correct that you have one year from date immigrant visa became available for your parents to file for CSPA benefit. You need to file DS-230 Part I and Part II within this 12 month time frame. Your age does not matter once DS-230 has been filed.

    As an example, today if you were 1 month away from turning 21 as per CSPA formula and your father got visa today, but were 3 months away from turning 21 when the visa became first available, you have 12 months from visa priority date becoming current. That means even by CSPA calculation your age may be over 21, but since you complied under CSPA by taking action and filed DS-230 Part I and Part II within the 12 month time, and have remained unmarried, you are eligible to get visa.

    Having said that, I would not delay the process on my end to immigrate just because CSPA act allows me to. If possible, immigrate before you turn 21. In traditional (non-CSPA) cases a few years back, I know two separate cases where children who left on the brink of 21st birthday have been sent back from US airports, if they turned 21 during transit or before entering port of entry.

    For anyone else reading this post, if you are over 21, CSPA does protect age out by reducing your age by the period of time the application was pending approval. In some cases, this period can be up to 5 years, thus allowing a 24-25 yr old unmarried child to immigrate with their parents under dependent derivative benefit. For immigration purpose, under CSPA act, the child is still 20-21 yr old only.

    But this is strange, since you have applied for citizenship you should not get the card at all. I called customer service last week to ask about my case, and I asked specifically about this. I was transferred to a real immigration officer and she assured me I would not get the 10-year card after sending the N-400. Both applications will be processed together at the naturalization interview she said.

    You're right, checked the mail. It was there! Biometrics appointment set for Feb 7th.

    By the way, when you put in your application # into the USCIS.gov's search box does it come up as invalid saying it has to be 13 characters long? Mine starts with WSC*0.... I don't think it should have the * in the application #.

    Mine comes up as invalid too, both with and without the *.
