    They Wanted Additional documents to prove relation with petitioner such as birth effidevit, school cert etc and told to do dna voluntary.. We just sent documents and didnt do DNA . now case was denied. What will they ask now any guess? if they ask dna its fine. or they will ask anything else or do we have to appeal or anything ?

    Ancestry DNA test is $49 and about 4 weeks results.

    I do think each embassy is different because the sealed envelope is the one my son was told to hand to the port of entry. Thanks for your response, it helps a lot.

    By the way, my wife when she arrived they did not even ask her about the X-Ray, although she had a CD with her.

    No, he said everything would be sent to the embassy. Did the immigration officer at the airport take the cd from your wife and the sealed envelope? Thanks!

    If not inside the sealed envelope, then after arriving to the US and if USCIS deemed it necessary to have X-Rays, specially in cases and countries with TB. USCIS will refer you to County or City public health services to do the tests. Public health employee might contact you to come in to do the tests or X-Rays. 

    Or, they might ask you to see USCIS CIVIL SURGEON to do the that. 

    I am sure the results are in the sealed envelope but on the State.gov website, it said to hand carry the X-rays while traveling. I am very confused. 

  6. My son came to US on a K 4 visa.My ex spouse I 130 petition for him was denied due to his background. I filed a I 130 for my son when I became permanent resident in February 2011. After I got married again to a US citizen a few months ago, he filed another I 130 for my son and we filed the I 485 for him. I got a letter from the NVC telling me that his case is ready to be processed two months ago but I did not reply since my spouse has filed another I 130 for him and he has a I 485 pending. Will the two I 130 affect his petition to adjust his status. Thanks.

  7. My new wife's and her son's K1/K2 and I-94 expired recently. AOS applications have already been submitted and received by USCIS. They received their I-797C letters for biometrics appointments which they attended. According to their I-94's they are authorized to stay in the US only until 8/23/12 which is now a week expired. We did not think this was going to be a problem since the AOS application was submitted more than a month ago. But my wife tried to obtain a driving permit and they refused it because her I-94 and K1 visa are expired. Now I am worried that they will be denied other benefits including air travel in the US. Do I need to file for an extension of the I-94? How do I prove that they are legally residing in the US?

    As soon as she gets her EAD, she can apply for a Driver's License. My son receives his EAD two weeks after his biometric. Or she can wait till she receives her green card. She is not considered out of status as long as she has filed for an AOS. In some states, they accept the AOS receipt from USCIS for temporary drivers license.

    If there is internet in the place where she is calling in Ghana, you could try Magic Jack. I left a magic jack with relatives in my country and it has a US phone number. For $ 30 a year, I can make unlimited calls and my family can call back too without paying a dime. Now they have a new magic jack which does not require internet. Check it out. It might work for you.

  9. I submitted a I-130 for my wife and stepson in March. I sent two checks($420), one for my wife and one for my stepson. One check cleared my bank and the other one was mailed back to me. Did I make a mistake? I thought there was a fee for each person. Can anyone help.

    I do not think you need to file a petition for your stepson if he is less than 18 as he is on the petition you filed for your wife and that's why you paid only for your wife 's petition.You can call USCIS for more information.

    do i have to wait until the NVC send me the I-864 affidavit of support or do i send it in now?? mom hasnt sent bac her choice of agent as yet, and ive read that she can do so via email so we'll do that tomorrow but what about the I-864 ?

    You need to wait till the NVC request the I 864 as they will send you an email with a bar code which you need to attach to your I864.

  12. We filed the I-130 with my wife using married name. So the NVC has her entered using married name, but my wife's passport is still in her maiden name. She lost her passport just before we got married last June and her application for a new one in Manila was pending while I was there for our wedding.

    Does she need to renew her passport showing married name before I can submit IV packet to NVC?

    It is better for your wife to have her passport with her married name.

  13. I'm sorry to say BUT since your son is now 21 your husband cannot petition for him because for it to work and your son receive the benefit the applicant should have been filed by your husband before be turned 21.

    ~~~ let me ask you so they cancelled his I-130 because of his background? I did not know they do such things ~~~

    ~~~~ If you were in the USA you did NOT have to go through consular processing since your daughter filed for you... you could have Adjust your Status here in the USA. ~~~~

    My youngest son is 17 years old and he was admitted on a k4 visa.

  14. Welcome here to this post. Let me ask you... you said you are currently married to a US Citizen he/she should have filed for your now 17 y/o (then 16 y/o) son. Why not...???

    My spouse approved I 130 was revoked because of his background. Our lawyer asked us to withdraw the appeal and to have my daughter petitioned for me instead. It was a bad mistake because when i went for the AOS interview, i learned that my spouse appeal would have been approved. I was forced to go through consular processing since I was admitted on a K3 visa. I wonder if my spouse could petition for my son even if I have filed an I 130 on his behalf.My son is still in US.

    If you will submit your application/s in December 2010 or January 2011 to bring your Family Member/s to America then lets all be in the process to help, educate and overcome any immigration obstacle/s with stong proof/s.

    We all have the green light so never stop preparing

    I filed for my son who is 17 in February and also for my eldest son who is 21 and received the NOA.I hope I will be able to become a USC in 3 years as I am married to a US citizen.

  16. Understandable that you're worried and will be until the visa is in hand but what you experienced was "soft denial". Your case had red flags and the officer pressed to address them and trip up the applicant. Apparently the interview was a success but they want a good current, clean police report.

    I got a 221g on my interview on January but they told me to come back a week later for another interview. Instead of another interview they issued my immigrant visa.Each case is different but I am sure you will end with your visa in hand once you have submitted whatever they request from you.

    Yes our visa journey is at a point where we need to set a date and buy the airline tickets!

    Any suggestions on the most economical way to do this. Do I purchase the tickets (paperless) here in California or must my Colombian fiancee pruchase the tickets in CO?

    The flight would be from Bogota and the POE is LAX. I have read that a round trip purchase would be best even though she will not use the return ticket. Anyone been down this path before that could lend their experience?
