  1. They have to write a letter and it's really no different then if you were applying for a mortgage at a bank or something. I did this for 3 years. They write a letter on letterhead stating who you are, what you do and that they will need you for exactly one year. Thats it. If they let you go, or you quit, they have nothing further to do with you and you have to leave the country or find another job asap with an employer who will write you another fancy letter :)

  2. I have an international custody agreement with my daughters father. I had it put in writing before we started our K1/K2 journey and I recommend you find a lawyer to get you a custody agreement put in place el pronto. She doesn't sound like she is particularly approachable and able to compromise and see what is best for her child. Our daughter spends the school year with me and the summer in Canada with her father. We 50/50 all travel costs. It's VERY important to have something in writing at all times as it stops any and all bullshyte from flying in the wind. Emotions get in the way of common sense every chance they can.

    So my thoughts to you... get a lawyer and protect your rights as a parent. Also, do not contact her. Let your husband do the contacting and you stay silent because it just makes things worse. I promise.

  3. You file k1 and k2 at the same time.

    We just did k1/k2 and when I was at the consulate in Vancouver, the agent that did our interview specifically asked for the custody document. You must present it again at the interview for AOS. It's a mandatory document to have.

  4. Well, after a lengthy and idiotic battle through the AOS process we had our interview today. We were VERY lucky.

    We showed up at the office in Atlanta at 7am. Our form said to be there at 7:15am. By the time we arrived there was a line snaking through the lobby and right to the doors so I thought we'd be waiting forever. The line went pretty fast, and we were processed and sent to our waiting room where we sat for about a half hour. It wasn't too bad because there was at least a TV in the waiting room. My little one played hop-scotch on the floor tiles and nobody seemed to mind.

    We were called in at 8am and our interviewer introduced himself, and reviewed the forms with us. He asked my husband about the birth dates of both my daughter and I, then he asked him my parents names. He asked me all the yes/no questions and he asked my daughter our address, the names of her biological parents and then he stamped the papers with approved. I did not ice that he tried to be all buddy buddy with us and even tried making it sound like transporting drugs over the border wasn't that big a deal. I guess he was trying to be tricky?

    We were only asked to present passports, drivers license, and my EAD card. That's it. He did not ask for proof, or to see any other documents.

    We were in there for 10 minutes and that was that.

    APPROVED.

  5. I'm missing this form : I-797 – NOA for K1 Visa Approval Notice

    I don't think we ever got one to be honest. When we applied for AOS I just copied my visa and my I-94 and that was all. When I got my passport from the consulate in Canada, it just had a notice in it telling me how long I had to get across the border and to give some envelopes to the border agent. Thats it.

    What should I do?

  6. Sorry for the confusion.

    I had one civil surgeon do my medical in Vancouver.

    Then in Chattanooga I had another civil surgeon do the immu records... and they won't sign "part 5" because they did not do the medical. The one in Chatt has been doing these forms for a long time and they said this is the first time they've had an issue. :wacko:

    I want to make sure this is an error... ATL has one day in July with appointments and my husband can't get time off that week due to holiday scheduling.. so we have to travel 5 hours to SC to see someone.....

    So far AOS has us so frustrated it's unreal. I'm going to skip everything to this point and just be very succinct. We received an RFE. It asks for us to submit "Form 1-693" because "Part 5 is blank".

    I had my medical in Vancouver in August. They took those forms at my POE. When I got down here to GA, I had a civil surgeon do the supplementary form for the immunizations. She signed them in part 6 or whatever that is (i'm not too sure if that was right but I'm looking at my copy of the I-693) So I called them and told them I received this notice blah blah blah and they said they will not sign in Part 5 because that is for the civil surgeon.

    Confused I called USCIS.

    They told me my RFE is an error and to make an Infopass appt.

    BEFORE I make my info pass appt... can anyone offer insight on anything here??

    K1 and K2 filing joint.

    The site says:

    "Filing Fee :

    $985. (Add $85 biometric fee for a total of $1070, where applicable. See the form instructions for payment details.)

    There are exceptions in which the applicant is not required to pay the entire $1070:

    For applicants under 14 years of age:

    Filing with the I-485 application of at least one parent have a fee total of $635;

    Not filing with the I-485 application of at least one parent have a fee total of $985."

    When I add this up I get $1705.00

    My check was for $1705.00

    What did I do wrong?

    Question #11 "Have you ever applied for work authorization from the USCIS before?"

    I previously held TN Status from 2006 - 2009. Two were POE issued and one was applied via Vermont Service Center.

    Therefore, given the above, do I reply YES and explain myself for all dates or are the ones I received at my POE's not counted for in this case? It further asks for documentation, but I have none! My documents were misplaced when my husband moved us into our current home. I have my old passport with my last TN issue on it that I can copy but that is all. So, will that be sufficient or is there a way to gather the previously issued information from the USCIS?

  10. I'm just wrapping up our I-864 and I want to be extra clear on the supporting documents I have.

    I have:

    1. Letter from Employer stating he's been there for 10 years and makes $xxK annually. (yes, 125% over poverty level)

    2. 2009 Tax Transcript

    3. Three months of pay stubs

    4. Statement of 401K (even though we don't need it I read it was better safe then sorry for assets)

    Do we need anything else?

  11. Well, I work in the Architecture industry and when the economy tanked, so did all of the projects we were working on with land developers. No job = no TN. Otherwise that was the plan but it all happened at the same time (the engagement and the job loss). It was just easier to come back to Canada and work there for way more $$ then it was to stick it out in the south plus my kid got to spend time with her dad. Win-win.
