my mother in law filed for her daughter under 21 unmarried on february 25, 2016. They had not received the green card at the time the application was filed. so only Alien# was written on I-130. should we wait for RFE from USCIS or send in the copy of green card anyways. we only have few more weeks to wait for decision
Please advise

i thought that uscis takes around 6 months and then the process starts right after arrival at NVC. i thougt that case processing for LPR filing for their spouses and minor children has been faster.
can we expedite the case simply becuase there is no one to take care of her and becuase of the situation in country is not so safe she's only 11, it's difficult to leave the child with someone.

My mother is applying for her minor child and i would like to know how long can this process take overall. i know that at USCIS stage there is a wait time for 6 months to get NOA2 but is there a wait time at NVC stage as well??
can the case be expedited at USCIS stage????

My husband is applying for his parents and to my knowledge he needs to fill out 2 seperate 1864 correct??...... we both work and file together but his individual income is sufficient to petition his parents. to make things less complicated, can he use his individual income alone from his W2's and file AOS?
-
It takes the same exact amount of time to petition a minor child as it would a spouse. The problem is that you aren't petitioning her as your minor child or your spouse, you are petitioning her as your sibling, the wait times for siblings are much longer and it has nothing to do with age or even marital status. That is why it's best to petition for one of your parents and then have that parent petition her as their daughter. It is an unfair policy, but the way that the INA is set up is, that family of immediate relatives cannot bring derivative beneficiaries.
hasn't the processing time to petition a spouse under LPR decreased to 5 months instead of 3 years???

what my confusion is that why would the processing time until interview would be longer if a child is petionted with the parent versus child petitioned alone?
i know that they have decreased the processing time for the spouse visa for LPR but not sure about the processing times for minor children (if filed seperately). I would like to know what the wait time is total in both cases up until interview.

is petitioning minor child under spouse visa(LPR) faster then applying for just the minor child alone ??? confused

Hi
My husband is US citizen and getting ready to apply for both of his parents. He also has a 10 year old sister. We are thinking of getting both of the parents here and then they can apply for their minor child. The other option we are considering is applying for one parent who can then later apply (under LPR) for their spouse and the minor child.
which option is better and how much time will it take if a parent applies for their minor child under 21???
Any suggestions?

Hi
My husband had to go through the same process and it took them more than 6 months to give him passport. here's the number u can call DOS-Department of State 202-663-1225. Press 1 then press 0 to speak to a visa specialist to ask the status for AP. i use to call them atleast once a week for updates.
don't worry ur wait will be over as well, u just have to be patient
GOOD LUCK!!!!!

considering my household size is 3, it should be $18,310 * 1.25=$22,887.50 ..... does this mean that my gross income should be more than this amount or my net income??? am i filing I-864A or I-864..???

hi
I am helping my brother (no income) meet the poverty guildeline for affidavit of support (I-864). we live in the same household but he is not dependent under my taxes. Our household size is 3 and my income is $42k gross. Is this sufficient to file the I-864 or we need additional support????
any help would be greatly appreciated
thanx

i'm ready to apply for i-751 for my husband. we were being so smart and tried sneaking in to subway station without payment and got a ticket for $100 each for transit violation "entered without payment" from transit adjudication bureau. we paid the fee and got a confirmation.
now i'm sending in i-751 and there's a question on part 3 question 7.
""""Have you ever been arrested, detained, charged, indicted, fined, or imprisoned for breaking or violating any law or ordinance (excluding traffic regulations), or committed any crime which you were not arrested in the United States or abroad?"""""
should i say YES or NO???

my husband was also placed in AP for 7 months. you should call the District of State (1-202-663-1225) and they'll ask for case# and name and give you update if pending AP or not. i use to call this # everyday until they gave me a good news that AP is over.

My fiancé had interview last week. Consular provided him a letter stating that case has been temporarily refused for further administrative processing. Any one please explain me what that means.. ?
yup it's very common. alot of guys around 95% of them are held back 'coz of this stupid AP.
look at me i've been waiting to get an answer for my husband for past 6 months and yet still waiting. the timing is different for everyone. i've seen ppl out of AP as little as 2 months but some have been waiting for more than 6 months and even a year. so GOOD LUCK!!!!!!!1
