I would suggest the K1 visa - apply for it now, you should have it in 7-8 months. Bring your fiance to the US, get a civil wedding here, and then go back to India for the ceremony. if you go the CR1 route, you have to wait until you return from India, already married, then wait another 6-8 months to bring your spouse here.
Whatever you do, don't apply for the K1 and get married in India...cause then you will have to apply allover again for a different visa =)

Since he's still legal in the US for quite some time, he may want to start dating again, preferably US citizen chicks.

Guess what happen today. I called the USCIS #, and guess what they told me. They say that although my case is outside the 5 month mark. They can not even put a request on my case since (according to their computer, Vermont is currently working on July 10 application). So they told me to wait some more until Vermont work on July 13 cases then to call them back. Is that some B.S. or what. Boy i was mad.
So i ask, when can they put a request on my case. They told me they didn't know how long it will be that i just have to call back. they told me that the 5 month is just a estimated timeline not a deadline.
So i ask him who can i complain to or call about this. he told me if i would like to make a a complain to go to the USCIS web site. their are # and address on there for complains. But according to what i read on the website its mostly about employee misconduct. So what now? I guess it worth a shot. Let's get everyone to email them and call them tomorrow. Pick a time at let's keep the complains coming from 8:00 am to 5:00 pm. lets try to be heard tomorrow everyone.

once I have my interview date I will buy his ticket also - but i will make sure that I can change the date if need be. Its usually a $200 fine, but it's better than spending way more for a last minute ticket =)Good luck on the interview

That makes sense. Can I puruse the current K-3 (Fiancee) Visa?
I know you mentioned a fiance visa, which is the (K1)...not sure if that would be another possibility, since you are now engaged to be married again? Might be faster, as you don't have to travel-get married-travel back to the USA, and then file the i-130. Other posters are probably right, better check with a lawyer =) Best of luck

They're working on those damn Temp. Protective Status visas at the moment since they had a major backlog on them. So...hopefully once they finish or are almost finished doing those, they get back onto the K-1 Petitions.

Looks like they had 112,000 I-821 (TPS) petitions in September, 114,000 in August. Says on their site they have done 84,000 so far in September and 70,000 in August...hopefully they will be caught up enough within a week or so to get back to pumping out I-129Fs because they are behind on those now.
Btw, seems I-821s have a 'Finish/approval goal' of 3 months, which might be why they moved onto them.

we haven't had a NOA2 from VSC since 11/23.....this is getting ridiculous Its getting hard to even imagine that mine will come at all

You don't need to go to Lima for everything - My fiance is from Cuzco - and he is getting all his police records there. The medical exam and interview are the only things we are doing in Lima

no matter if its formal or not, yes you have to be engaged to be married before filing the K1 (fiance/e) visa

The cleanest and easiest way is for her to get the student visa first, then you marry during a time you are a US Citizen and when she can comfortably stay in the USA for at least three months after the marriage. Once a citizen and married, you follow the adjustment of status route. See the guide here.
This is the best and easiest way to do it. I waited to get my citizenship before applying for my fiance's visa, as it is very hard for a LPR to bring a spouse or relative to the US.
Yes I believe you can get married while she has a student visa, as long as she didn't get the student visa to come to the US and get married, since that would be fraud.

350 dollars for the visa plus 18 soles for the DHL. Look at the interview reviews, and you will find all your answers there

By definition the K1 is a fiance visa, so yes, being engaged is mandatory for this, as it says on all the application instructions

Day 96 here...My timeline on VJ is not even up anymore, due to lack of updates...thats how slow VSC is =( Hope this is our month

Sorry to hear about your situation. Try giving your senator/congressman a call. They usually help in these sort of situations. I'm not too familiar with the white slip, but you should be able to appeal the decision. It also might be beneficial to ask other VJ members that have interviewed at the same location and ask if it is important that you be there for the (hopefully soon) next interview. You might have to refile also...
Sorry I don't have a lot of information, but hopefully someone will =)

Most of us at VSC got that touch on the 3rd =) But they have been slow recently. Hopefully we will begin to see some activity soon!!
