  1. You would want, after all you have been through, to start over from the beginning? Can't you marry, borrow money, and wait a few months until he gets his AP to travel?

    the circumstances are difficult, not sure if I can borrow money. Not sure when he will have to leave either...its all really complicated - such is life :)

    What are you basing these assumptions on?

    My wife & I married at the end of Jan 2009, I filed for her CR-1 mid April 2009, she interviewed in November 2009 and there was no question about our marriage despite my not having returned to her country. We had a couple of joint accounts but that's it.

    Thanks for the reply - good to know that this is an option - I hadn't seen my fiance for 17 months during our K1 process and we didn't have a problem, its safe to assume that I would not need to visit during the cr1 process.

  2. If he leaves without Advanced Parole or GC, he will not be able to come back. If he absolutely has to go I recommend getting married and filing for CR1. This type of situations happen and I saw several exact same cases. This is exactly what they did. However, you will have to travel at least one time while CR1 is getting processed to show ongoing relationship. Good luck!

    It takes about 9 months for the CR1 right? So in that time I will have to make a trip there? Won't email and phone records be enough? What if I can't travel during this time?

    Some background info: I filed a k1, and my fiance arrived May 15th to the US. We had some problems, and I put off the wedding. We have decided to get married in a couple of weeks. I don't have the money to file his AOS yet, so we planned on waiting a bit for that while I save.

    Now, here is where it gets complicated...due to a family emergency he has to go back to Peru, I'm not sure when yet, but most likely it will be before I can file for AOS.

    Now to my questions:

    -If he stays without AOS, and leaves before I file, will he get a ban?

    -If we get married here, and he goes back I can file a CR1 - but I wont have any bills or anything with both our names on it - will that be a problem?

    It has been the hardest 3 months of my life dealing with so many issues. My fiance and I finally came to a compromise and I just want to make sure I'm doing everything correctly to ensure that he will be able to come back to me.

    **VENT**

    I have been calling USCIS everyday, asking for my service request, and still nothing. They say I have to be outside processing time, and since VSC is delayed 34 days, I have to wait until they are working on Aug 27 to be "outside processing times". I know people who have gotten service requests put it already, so I will keep calling everyday =)

    I have also contacted my senator again, and I have emailed VSC. So far nothing.

    I know people say that love is patient and all this #######, but I AM NOT PATIENT. I am sick of waiting. I am sick of arguing with my fiance who has been sitting there with his life on hold for close to 1 year now. Its not fair to make us all wait this long, and after that we still have MORE waiting to do. I know its a privilege to be able to bring our loved ones here - don't get me wrong, I'm grateful that America allows their citizens to do this. But VSC needs to get their act together, enough is enough.

    Hope you all are doing better than I am with this waiting =)

  5. I know what you mean! My fiance has been offered some work opportunities that he turned out, on the hopes that this visa was coming a couple of months ago... its hard to accept a new job when at any moment the NOA2 can arrive and he has to start going to another city for all the medical and interview things. Its really putting a strain on our relationship, as he is very stressed with not being able to do much over there, and all the drama this starts with his family.

    Now I'm starting a new job next week, which I hope wont mess things up as far as me being able to sponsor him. I have no one that can be a co-sponsor, but I'm hoping that my pay stubs from my previous employee and a letter and new stubs from my new work will be enough...praying to God that this process ends soon so I can just be with him again. I can handle anything as long as I get daily kisses and hugs =)

  6. If you call back in 1 week (about) you can get an idea of what petitions they are on now. The call center gets it's monotone "We are working on XXX" script around the 15th of every month.

    So on the 15th or close to it, we will have a realistic idea of where they are at the moment.

  7. You have to make over the 125% above poverty line for ur fiance/e - or have a cosponsor. I'm not sure how much u have to make in order to receive assistance from the state...so that will play a part in if you can still receive that or not.

    He will be able to get SSN almost immediately, and be able to work after AOS, which usually takes about 3 months, if I'm not mistaken.

  8. VJ no es SOLO para visas. Lots of people come here to meet other people going through the same things, and we can all help each other. We all want to know how to make America seem a little bit more like home, and food is definitely a big part of that.

  9. HELP!!!

    I started my first job out of college back in September. I was all set to be able to fill out the I-134. Now I am having problems at work, and will most likely be switching jobs in the next month or so. I am a K1 Aug filer, so I should be getting my NOA2 soon, and Peru schedules interviews in about 1 month. I have already started applying for new jobs, and will hopefully get something soon.

    My questions is - will a letter from my new job and recent pay stubs be enough for the i-134? or should I get a co-sponsor? There is no doubt that I will be making more than what is required, I just want to make sure I have enough evidence.

  10. On the phone with USCIS

    They are having ALL KINDS of technical problems.

    They said they were 64 days behind, but on the computer they were saying that it was showing that they were processing Feb 4, 2011 applications... NO WONDER THEY CANT GET STUFF DONE!!!

    So I got placed on hold to talk to someone else - finally talked to an officer, who told me that the processing time is 6 months (even though on the website it says 5), which is BS and we all know that. She said that I can only put in a service request at after 6 months 1 day, which is also NOT TRUE. The officer said that she could not tell me what date VSC was processing...when the first person clearly told me, and many others here have been told that too.

    Well...I'll be calling tomorrow - they are going to get SO sick of me

    Nice to see another Cusco person out here =) Good luck on your journey.

    It is VERY hard to get tourist visas in Peru, almost impossible unless you can prove strong ties to the country and intentions of returning. By the fact that you already filed a marriage visa, they will probably deny the tourist visa.

    You are looking at some months of waiting, but once it gets transferred to Lima, you will have your interview in less than 1 month =)
