    You can apply for their US passport the very day they arrive in the US. Make a copy of their immigrant visa and send with your original naturalization certificate or US passport if you have one. Sometimes post office has problems. I would make an appointment with a passport agency or your local county clerk to submit the application. 

  2. I think this is a common practice in Ghana which conflicts with how western cultures do their stuff.

    Locally, you can call your siblings' children as your own because it shows that you love them like your own and you treat them as such.

    Since this is a norm, we erroneously make such claims when it comes to dealing with US immigration.

    People have called gf/bf as wife/husband.. Wives call their husband's brothers "husband". example junior husband or senior husband but sisters of husbands are called rightly as sisters-in-law.

    That's just a little education.

    So, even though it might seem like a big lie with regards to calling those kids as your own, it isn't , from our cultural point of view.

    You will have to adopt them legally to be able to bring them to the US. So when you go to see a lawyer about responding to the NOIR, try and explain this cultural aspect so that he/she can effectively help you respond to that part.

    How long did it take for you to get the NOIR since the interview?

    It may be consistent with the culture or norms to call your siblings children "your own." However, there is nothing in the culture that indicates you can put the children on the immigration forms as "your own." This wasn't a mistake; it was purposeful and intentional to help the children get immigration benefit down the road by listing them now- something they aren't entitled to since they are neither his biological children nor adopted children. He didn't know this wasn't possible and was caught. I hope he finds a lawyer who is able to put him on the right path to overcome something that is likely a material representation.

Hello,i find my self in the same scenario because my wife and I got married in my country this August.she filled an I-130 for me in November and it got accepted.The problem is that she needs me to assist her with the kids and house duties since her new work schedule is demanding, this means I need to be with her as soon as possible.i am therefore wondering if there is a procedure for getting there before the I-130 is approved by the NVC ...So my question is WHICH VISA DO I FILE ? K1 , K3 OR CR-1. Any one with info on this should pls comment.

    If the waiting were your only problem you would be lucky. There is a mountain to climb at the U.S Embassy in Accra to even get the CR-1 visa for which petition has been filed on your behalf. I would be more concerned about that than the time waiting. As far as getting a visa visa at this time, your chances are virtually nil.

  4. I had the same experience in France in 2004. I flew into CDG and the immigration officer did not even open my passport. When I left through Germany, the immigration officer looked for a entry stamp, did not find it and asked when and where I had entered the EU. I told I had entered through Paris and he answered back: "the french".

    Lol. The first time I entered on a U.S passport from Amsterdam I thought it was a mistake. I also flew to CDG. I was stamped in Amsterdam in both ways. On the second trip, they didn't look at any ID again...that was when I realized it was the norm. I have no entry or exit stamps in my passport to show I have ever visited France. But I have been there twice.

    Seriously? So 35% of the lawyers you have spoken with believe they can magically turn a permanent ban into something productive for you? Well…obviously they’re blissfully blowing smoke up your skirt to keep the checks rolling in (and their pocket full). Some lawyers! But yea welcome to the 21st century where many people are willing to kiss their integrity goodbye as long as it keeps the checks rolling in

  6. i dont know what year was that but now every time you fly outside of the European Union there is an agent checking your passport for entry stamps and they have to give an exist stamp , if you never got en entry stamp chances are its not going to be pretty and probably got denied the next time you try to go to any shengen country.

    I think that if you enter from another Schengen state they don't check. I have been to France twice both from Amsterdam and was never asked to show anything at all. They just waived me through. But I did get my passport stamped in Amsterdam on both trips.

  7. There is no way to independently verify this story as the truth. All we can do is speculate assuming the poster is telling the truth. But it could also be an entirely different story. For example, the woman in question might have met with the poster and fell in love, doesn’t want to be with the original petitioner anymore, seeks how she could still live here with his new love after divorcing the original petitioner; one of the ways she can think about is to pull out the “abuse” card but then a second thought of additional “lies” to have an innocent man lose custody of his children is somewhat hitting on her already ‘guilty’ conscience for using him to get here, and now doesn’t really want to call the cops to report the supposed abuse which may not be true. For someone to get here in May and pull this out with a new “friend” ready to turn a “husband” raises some doubts. The green card “wheezy” – getting green card by any means necessary – has hurt a lot of Americans too. I have a friend who had been a victim of this “abuse” accusation when it was actually the woman who was abusing him, so I take these things with a grain of salt. Yes, there are real abuses, but unfortunately, none of us can independently verify how authentic some of these things are. I wish we could have the man’s side of the story. It’s good to stick to the poster’s claim and offer advice, but sometimes we need to be a little analytic so we don’t end up helping someone trying to beat the system.

  8. He’s telling you he could have cut your head off (beheaded you) if you were in his country and you’re playing around stuff like that when you have kids? If you think you can use rational arguments to help a seemingly irrational man and a potential terrorist, you’re even fooling yourself more than he’s already done to you. Your only option is to stay as far away from his crazies as you can. And, it’s a good idea to inform the FBI so they can keep an eye on him from a distance before his crazies explode to other members of the American society. I am not reading meaning into anything; from his utterances, he’s a potential terrorist.

  9. The only thing you can do is gather all the relevant documents. You can check with the embassy in Nigeria to see some of the country-specific documents required. Generally-required documents can also be found on https://travel.state.gov/content/visas/en/immigrate/immigrant-process/documents/Supporting_documents.html. You're going to need police report from both countries. Other than that, NVC doesn't work on your timeline to speed up the process; they work on their timeline.

  10. Not really! They want to see the most recent (2015) but u can include previous ones. It won't hurt..but if u only have the recent one, you're good to go all the same

    Ghana requires transcripts for the last 3 years not just the most recent year. NVC requires only the most recent, but the U.S Embassy in Ghana requires the last 3 years.

  11. The one thing I've have learn over the years is when things are sweet- they are sweet my friend, but when they turn soar on you --WATCH OUT!!!!

    There are way too many variables in play here.... RUN for the hills and keep it moving they are no friends of yours and they only want to hurt you-not protect you!!!!

    Every reasonable person would have done the same: work on getting off the hook of being legally bound to financially sponsor someone who isn’t her “son-in-law” anymore. No reasonable person wants to live with the idea that they can be legally held financially responsible for someone who they do not relate to. It doesn’t make them “seeking to hurt him;” it’s a logical financial decision to avoid any future complications – including the possibility of draining their hard-earned money. This doesn’t mean their “fear” is true; it means they are concerned about being hooked financially to someone who isn’t a member of their family. If they were that bad seeking to “hurt” him, they wouldn’t have signed the affidavit of support form. If you take your time to read the information on the form, especially the guide, you would see how scary those choice of words and manner of expressions are; it takes a great courage – and much love – to sign after reading it. Give them some credit for their valid fear

  12. I don’t know but let me speak from personal experience. Dual Ghanaian-American citizenship is legal but very tricky. Unlike many countries, Ghanaian immigration has passport control when entering into Ghana and when departing from Ghana. When departing from the U.S you’ll show your U.S passport going through departure formalities because you can’t have a returned-ticket to the U.S when you don’t have a valid U.S visa in your Ghanaian passport that allows for you to return. Also, the U.S requires that U.S citizens depart from, and enter the U.S on U.S passport. However, entering into Ghana is what presents the most challenge. If you show your Ghanaian passport, they’ll put a stamp in it showing the date of arrival. Now, when departing from Ghana, they (the immigration) check the “date of arrival” and stamp you out (“departure date”). You can’t use your Ghanaian passport to go through departure formalities because the immigration people have to make sure you have a visa to the country of destination. In this case, you’ll have to use your U.S passport. The challenge is, the immigration people will want to see the date you entered Ghana shown in your U.S passport along with a visa to Ghana since you’re using a foreign passport. If you can’t show these (you practically can’t because you entered on a Ghanaian passport), you’re screwed. You have practically set yourself up to be a ‘meal-ticket’ and by that I mean you’ll really have to have a few hundred of dollars (it aint just a woo-fin) to be able to make it to your flight. The only safest bet is to ditch your Ghanaian passport and apply for Ghanaian visa when going to Ghana, and by that I mean you practically ditch your Ghanaian citizenship. The Ghanaian Embassy in Washington, DC will ask you to apply for “dual-citizenship” to have a Ghanaian certificate of citizenship, but I’ve got to tell you, getting out of Ghana with the “certificate of citizenship” along with your U.S passport presents the same challenge – a few hundred dollars is unavoidable.

  13. No you're not eligible until you have your green card. K1 isn't a green card. Once your green card is approved and you receive in the mail, you can file FAFSA. The financial aid office of the school is required by law to obtain a copy of your green card once the FAFSA has been processed...you can't provide a copy because you don't have it yet.

    Hello everyone thanks for your support so far but I have quite an uncommon question at the moment and I hope someone with knowledge or experience about this would be able to help me out.

    I came to the U.S on a K1 VISA and got married. we have already adjusted my status and sat in for an interview. we got everything Ok but unfortunately missed out my birth certificate and wife's W2 forms so 2 days after our interview we had a mail requesting those documents which we already submitted so right now we basically waiting for the greed card to hopefully come in.

    I recently enrolled in college and according to the information I had at the financial aid office, I would be eligible for a federal financial aid as an eligible non-U.S citizen if I didnt come on a F1 or F2 student visa, a J1 or J2 exchange visitor visa, a G series visa (pertaining to international organizations), because they are basically considered non-immigrant visas but if I was here on an immigrant visa then I am eligible.

    So my question is, is it advisable if I go ahead and put in my financial aid application as an eligile NON-US CITIZEN eventhough I dont have my green card yet? and I am a bit confused with the K1 VISA because at some point it is considered an immigrant visa and at some point its not so i just dont know what is what! And according to the visa categories on the FAFSA page I might be eligible but am a little bit confused about it all since I don't have my green card yet and I wouldn't want to do anything to wrongfully go against the law but at the same time I need to know the right thing to do for my education so I hope someone would be able to kindly help me out. thank you very much in advance!

  14. You don't need to sweat it; I was sworn in as a citizen on June 20 but my status still shows "placed in the oath scheduling queue."

    Updated with my oath date - got my oath letter. Strangely, yesterday I got an email saying I was placed in the oath scheduling queue, but the system hasn't been updated to show that I have been sent my interview letter. Not sweating it, I have the letter in my hands. September 17th it is!

  15. I have pending I130 F2A for my wife filed on October 2013 I was LPR. she became pregnant and gave birth on June 2014. The case is still pending has not been approved yet. Now that i became a U.S citizen in August 2014. I became U.S citizen just now but baby was born 2 months ago while my N400 was still pending.

    Does my newborn daughter also becomes U.S citizen automatically ? if so how could i apply for her?

    Or do i need to file another I130 for the baby again?

    Does the baby eligible for derivative visa ? how should i apply then ?

    No the baby isn't a citizen. He was born before you became a U.S citizen. You'll need to file i-130 for the baby because there is no derivative for immediate relatives. The good thing is, as soon as your baby arrives in the U.S as a permanent resident, he becomes a U.S citizen through you.

  16. Hello everyone,

    I would like anyone expert or someone who have been in this before to help me. I was admitted to the U.S on K-1 VISA. Got married and filled for I-485. I went for my figure print and later had my working card. We recieved a letter saying your case on waiver and we don't need for an sort of interview. Few months later we recieved another letter stating we should come to the local office which me and my spouse doesn't know we were going for an interview and as a matter of matter we didn't take an document with us. We were been interviewed separately and my spouse gave a different answer based to that of mine. We got a Notice of intent to deny 2 months after our interview based on the different answer given by us and was been asked to summit document and form I-693 within 30days. We did all that by the help of immigration attorney and I received a letter last night stating that my application is been deny and I am given 15 days from now to provisw evidence why my employment authorization shouldn't be terminated. It also state that I may not appeal for the decision but I can file a motion to reopen or a motion to reconsiderusing form I-290B.

    We are so confused now and would like some advise or help from anyone who knows much about this.

The motion must be based on factual grounds, such as the discovery of new evidence or changed circumstances, and “state the new facts to be provided in the reopened proceedings and be supported by affidavits or other documentary evidence.” See 8 CFR 103.5(a)(2).

    If the underlying application or petition was denied due to abandonment (e.g. failure to respond timely to a request for evidence or a notice of intent to deny), a motion to reopen may be filed if it can be shown that:

    • The requested evidence was not material,
    • The required initial evidence was submitted with the application or petition,
    • The request for appearance or additional evidence was complied with during the allotted period, or
    • The request for evidence or appearance was not sent to the address of record.

    Q. What is a motion to reconsider?

    A. A motion to reconsider is a request to the original decision maker to review a decision based on new or additional legal arguments. The motion must establish that the decision was incorrect based on the evidence of record at the time of that decision, and it must state the reasons for reconsideration. A motion to reconsider must be supported by “any pertinent precedent decisions to establish that the decision was based on an incorrect application of law or [uSCIS] policy.” See 8 CFR 103.5(a)(3). Unlike a motion to reopen, new evidence or changed circumstances cannot support the filing of a motion to reconsider.
