    I read a lot of stuff here which gave me hopes that me and my wife can survive this ongoing issue.

    AGAIN...

    I am USC married to an OUT of STATUS pinay for 2 years and 3 months to date. Currently, I am unemployed, my wife does part time stuff so we have something on the table. Both family sides are helping and assisting financially till i get back on my feet and work again or if ever she's able to work legally. (that's our status right now)

    Okay, so september 14, 2010 our lawyer submitted our paper works to USCIS; received notice of receipt 09/27/10; 10/08/10 received appointment for Biometrics for 10/29/10 so glad everything is coming in order....

    (We had a Co-Sponsor)

    Anyway, my concern now is I asked some of my friends and told them what's going on and they were saying my wife needs to go home so I could petition her!? reading some of the posts here : she's gonna be BANNED if ever she lives the country not fixing her status.

    what are the possibilities regarding this situation.

    I was reading some of the current post saying they just submitted their AOS and one post saying under investigation etc.

    Okay so for me I just submitted my AOS (09/14/10), my hubby not working, i got a affidavit of support and a lawyer who did everything for me.

    Anyway the question I didn't declare working since it was under the table and it's all over the place just like any call me if u need someone to clean, babysit, "all part-time",

    my hubby who is a USC (been married for more than 2 years) is not working but not in any unemployment nor getting anything from the Government. We're being help with both side of family, supporting until he works again or i get to work legally

    ... is that going to be an issue?

    I working under the table pretty much does 1/2 of everything.

  3. I believe GC stands for green card. I know that just waiting is not a very nice feeling but like the others said up there, waiting is a huge part of this process! Your lawyer should be able to tell you the normal wait periods, but I know you are probably anxious and I am in your position as well, having just submitted my AOS packet. Our current timeline is in my signature, if you want more details on timing.

    Judging by our very short experience, the two week period that everyone mentions above appears to be holding true in our case. Quick question though - will the notices go to you or your lawyer? We did everything ourselves, but your lawyer might also be handling all the return receipts/notices from the USCIS.

    The lawyer said we'll both receive it, so am so anxious with our mails too..

    It helps a lot when you guys share your timelines at least we have a baseline for ourselves.

  4. Hi guys,

    We mailed out our GC petitions last Tuesday (9/7/10) and the package arrived at USCIS lockbox in Chicago on Thursday. (9/9/10) It has been 7 days...yet we haven't heard anything from USCIS. Our checks still haven't cashed out, no NOA1 in our mailbox. I'm a bit worried now...

    Is it still a normal condition? Should I worry or I should just wait a little bit more time?!

    I also have another question...the checks...are they supposed to cash out first before the first NOA? Or it should be the opposite situation?!

    I think I am in the same dilemma as u are. Our lawyer just submitted our paperwork for AOS 9/14/10, I haven't heard anything yet since.

    just wondering how many days does it take for them to give a notification of receipt and how many weeks before we can get my wife EAD. thanks

    just have a question regarding my mom- in- law's case status. So she's got a sister here who is USC, the rest of the sibling where petition way back 1992/ or she applied to petition them. From then an all her 3 sisters were already married with kids. HOw does this work? and how long before she could actually have them here in the states. Thanks so much.. just wondering

    and also there is form (I forgot what its called) that they say if ever they visited here and overstayed is okay because there petition being process for them its just the visa numbers are still not available.. can someone clarify this.. thanks

    As to what i've posted before I am petitioning my wife she came here as a tourist = found someone to petition her for work but it didn't work because of bankruptcy before that we were dating already and I asked her to marry me but I didn't think of petitioning her that time due to financial difficulties. Now we're on our 2 years anniversary of marriage. Within that 2 years HONESTLY even if i say she's working for exchange of whatever she's still working ... correct ?? Now I fear that if I/ her put working history she might get in trouble. Help please

    This is the only thing hindering me from signing our papers.

    ** I still don't have a job due to medical issues pretty much she's the one taking care of the USC not the other way around. Some help from either side of family.

  7. hello again., so to my concerns before that she had a run away lawyer they contacted us again after 2 years asking us to update our paperwork with them. So i think thats one good thing not needing more money to pay for another lawyer plus the cost of the filing. Anyway I am still looking for a job - the paralegal who reconnected with us said i need an affidavit/ letter of the reason that I am not working right now (Diagnosed with IDDM still uncontrollable reached 900 BS when diagnosed but doing much better now) does it need to come from my doctor? or I can just reason out on the letter and then have it notarized or do I simply write them a letter? One more I also asked the paralegal about my wife work history... supposedly she's bound to be petition with an employer through this lawyer we got married blah blah blah.. and so on. then my wife found out that her employer can't petition anyone due to declaration of bankruptcy few yrs back so she left them and move on SO the LAwyer change the petition to through marriage. SHe doesn't have any numbers... ITIN or SSN the employers had her hanging. Right now she volunteers in exchange for a place to stay for us. We're pursuing the petition to be filed ASAP. To my situation can anyone enlighten me PLEASE.... Chances are!????

  8. perhaps his country of origin should be billed for all of his medical and residential expenses since entry, since his parents don't seem willing to pay the bill. a damn shame it has come out of my pocket, instead.

    kinda like "taking an unwanted puppy for a ride to the country". nice people.

    I feel for him, i don't think its his fault it just got out of hand. Anyway, so what he needs is a REAL GOOD LAWYER to start with... My question now is how much chance does he have? thanks

  9. Yes, I think thats what they have. I just spoke with him earlier today and he said that the agency who got them the permits and jobs before got shut down because of IRS related issues. That's why now there permits weren't renewed. Is there a way they could stay? Not overstaying though. An adjustment of some sort. THanks..

    I am an Immigrant (Green card holder) from the PI, I've been here for almost 3 years (I know to be eligible for becoming a USC i should have at least stayed here for 5 years). Currently, I have a boyfriend who became Out of status few months ago. We are living together and planning our future to be together in marriage. Can i petition him with my status or I have to wait till I get naturalized? Please enlighten us....

    Apology if am in the wrong room

    I just have a question regarding some of the people i know who's needing much of an info regarding their stat.

    They are bf and gf working here in a working visa they got they're permit in an agency in florida, few months before the due date of their visas they renew it and moved to california for a different opportunity. Recently, they got a reply to their application that its denied and they have 180 days to leave the country, is there something they could to do to stay?

    I have a friend whose got a Cerebral Palsy and currently he is staying in the US out of status.

    He's parents came here from a middle eastern country 90's when he was only couple of months old to seek medical attention. According to his relative who are USC his parents were immigrants who chose to go back to there hometown. The boy was then left here and was place in foster homes for care , until He turned 21 y/o he got cut off with medical privileges. They tried to petition him through his relative when he wasn't over age yet but no one follow-through. So now he's over 21 y/o with nowhere to go. Where should he and his relatives start? THANKS

  13. Thanks for giving info's about my situation, it made me feel better knowing we could do something about it.

    Another question please : Once I petition my wife, i heard that she's going to have a 2 year conditional visa. Is that correct? What if we're already married for almost 2 years now, would that still apply? we've been married for 18 months now and planning to settle everything (File) by the coming month - March. And also, they say just wait till the 2nd year anniversary so no more conditional visa.

    Can anyone clarify this please. thank you.

  14. You can probably do this by yourself, but it depends on a few factors:

    - How did she enter the USA, ie what kind of visa?

    - How long is her overstay/ when did her visa run out?

    - When did you meet/ did she intend to stay when she came to the USA or did you guys decide to get married later on the spur of the moment?

    The most important thing is for her not to leave the US until you have filed and received AOS (Adjustment of Status), IF you are elligible to file, so it';s good that you are here on VJ and hopefully get this sorted soon. Until you file she can technically be deported, but this is unlikely to happen unless she does something to come to the attention of ICE (crime, getting stopped at a road block near the border etc).

    she came here with a b1/b2 visa supposedly to be petition by a employer but things went down when the result for the employers petition says they can't afford her. Since we've been dating for few months i asked her to marry me. I married her after 10 months of having her I-94 due. Her visa will expire this year on november. so we've been married for 18 months now. I just don't know how I'm gonna protect her when it comes to worse. Thank you so much I hope you can give me more insight about this. Possibilities...

  15. I am a USC married to a non immigrant Asian we've been married for almost 2 years now but I didn't have the chance to petition her yet but we tried. (Through a lawyer but they're shut down now - can't refund even a penny). Currently, I don't hold a job due to medical reason. She overstayed already, family and friends tried helping financially for now. For a fact I need a affidavit of support for her or a co-sponsor. I don't want to go through a lawyer anymore because its too much money and for my own I really don't know where to start. Also, is there a possibility that she's going to be deported for overstaying even if we're married - I'm worried about that. Time flies by so quickly and I don't know what to do. PLEASE advice me where to start. THANKS
