  1. Hello all,

    I just received a text message from uscis then checked my email -- card production 12/15/2010 for my GC!!! wooohhoooo

    FInally the long wait is over... but am sure my timeline was pretty quick.. submitted my AOS application 09/14/10 then GC 12/15/2010!

    I Thank GOD for everything for giving us strength while we go through this strenuous journey.

    I also thank everybody at VJ for all the insights and posting that really helped.

    Just have patience and positive attitude... everything will come in His time.

  2. He actually took our cards and papers and we left with nothing but verbal information that we had approval and Green Cards would be out in about two weeks.

    Maybe because we actually had the supervisor himself he was able to say approved. But no stamp, nothing else either, just his word he was taking everything else because Green Cards replace them.

    Are you feeling positive tsokonut? How was interview itself?

    I am feeling positive since he said i'll recommend for approval so that's one of the stuff am holding on to.

    the interview was quick, me and my hubby were very casual. When he asks questions we either answer he didn't specify who to answer.

    Hoping for the best!!

  3. We arrived at Phoenix office 45 minutes early and were told to come back at exactly scheduled appointment time as they were back logged with people. At 55 minutes after appointment time we were taken in for interview with Senior Inspector-Supervisor for the Phoenix office. He definitely had an intimidating presence and made it very clear that this was an important interview. I was glad that we had dressed professionally. After signing that we agreed to proceed without an attorney and swearing in he asked each of us basic questions with addresses. numbers, personal details, what we do for professions, how we met, etc. the list of clear questions regarding illegal activity etc., poe details as to what city and date, then requested photo album for a quick browse through with a few questions regarding who was in the photos with us on a couple of wedding shots. He asked no questions about when, why or how we decided to marry etc. in USA. Last request was for documents showing that we live together. We shared home insurance, bank statements, receipt for wedding ring, etc. that we had already duplicated. These were kept as part of his file. Zero questions about wedding plans, engagement, etc. and he wanted no photos as part of our file even though we offered. He asked my son how was life here in Phoenix, no other questions. Then he said he was stamping us approved and our green cards would be sent out within a few weeks and that we needed to know we would need to file again around 1 1/2 years and if all necessary documentation was in that file, with good proof, we wouldn't have to come back for another interview.

    We were glad we were so prepared, but our banker's box of documents wasn't even looked at.

    We are going to share a bottle of champagne tonight and be relaxed that the stress is over...and we can bring our things from Canada!!!!

    got my interview today too.. IO officer just said supervisor needs to review it but i will recommend approval, so mine is pending..

    Did they check your EAD card?

    He didn't give /handed me anything not even a stamp.. LOL I am just up here pending.

  4. my interview went well but i don't know if it was approved or NOT!

    We waited for at least 3 hours for our interview because we were 5 mins late..MY BAD.

    interview lasted for 30 minutes.

    the IO officer asked yes or no question first then preceded to how we met etc.

    he asked if we have any kids, I said on the way (found out yesterday I was prolly 5 weeks preggy)

    FInally after few major questions he said "before i can approve you, my supervisor needs to review your file. I'll recommend for approval"

    So I am not sure whether its a go or a no go.

    I showed him my EAD card and Social Security card and tried to give him a copy for file he just said "keep it, it's yours"

    Any insights?

  5. This may sound scary but i need facts...

    I have a friend who i usually talk about immigration stuff.. anyway she sounds like she know a lot but then it makes me feel pessimistic

    So here it goes...

    AOS - i filed for I 485, I 765, I 130

    I got my EAD, got my SS#, State ID, and on the 14th is our interview.

    I know there's a possibility of being denied but what will happen next? will they take the privileges back? will i reapply and do the same thing over

    We've been married for 29 months, got a joint account and a lease, some phone records from we were courting and PICtures to show and a CO SPonsor.

    will i be deported / sent home etc.?

    anyway what she's saying is that before they give you a green card the beneficiary will have to go out / or return to their country then they'll be petitioned from there and of course when you leave the country (USA) you'll have a 10 yr ban for illegally staying.

    is that how it goes?

    waaaa am so frantic again.. sometimes its better if you just wait and go with the flow...

  6. Yes, she can still get denied. Her EAD will not be valid anymore if she gets denied. Her SSN will still be hers but will not be valid for work because she won't have the work authorization (EAD). Try to stay positive; worrying won't help any. Good luck!

    Thanks., I am just thinking of possibilities.. for positive thinking no questions/doubts about it.. its all over me.

    So okay, after denial... like what you said... what's the next step? AOS again?? should we do the same process all over again

    I have Faith that we'll go through this smoothly, been through a lot... showing them the marriage is legit is hopefully not gonna be a problem. I HOPE :)

    i am adjusting my status from being out status to falling in love to getting married and so forth.

    wednesday i got my EAD card in mail

    thursday i applied for SS#

    Friday i got a copy of my SS# and receipt/temp state ID and permit for a DL.

    Watta a week for me.

    For all VJ members who helped us go through this with my annoying and kinda frantic questions.. THANK YOU SO MUCH.

    Can't wait to tackle the final bump on the 14th! our interview.. I hope everything goes well...

  8. You do not need an SSN to file taxes (and back taxes). My husband (USC) and I (3ish years overstay) were incorrectly told (by our previous tax person) that we could not file as Married Filling Jointly because I was not a USC. After some time on VJ, I called H&R Block and was told that a non-USC CAN file.

    The non-USC needs to request an ITIN. It's basically a tax number for non-usc who need to file taxes while in the US (just like your situation). Since we had been told, for the past 3 years, to file my husband as single (which was wrong), we had H&R Block do an Amendment of our taxes for the past 3 years. They wend from Single to Married Filing Jointly. This has the added bonus of being another proof of a bonafide relationship AND you get back the money you would have gotten back if you had filed as Married filing Jointly.

    Now, if you're worried about IRS telling USCIS about your wife, or about her overstay, or about any illegal work she's done. Well, don't worry. IRS and USCIS do NOT talk to each other (unless there is blatant fraud). IRS only cares about getting the axes owed. I had asked that question to the person doing our taxes and that was the answer I received.

    Oh thanks so much! i'll give H&R a call... probably just merely the fact i'll apply for a tin would workout!!

  9. I just read a post same situation as ours but we only filed AOS and just waiting for our interview next month. SInce my wife doesn't have SSN and not filing tax, probably the best thing to do is consult a CPA.

    We were on the phone with the lawyer the other day the only thing he could advise me us is "not to lie" especially with working... but of course we're concern about the employer who hired undocumented employees.

    Paying back taxes sound good but has to wait till AOS is successful.

    We're just really anxious.. of course the truth is always the best way to go.. just concerned about the "other people" who got involved like who had her work or something like that..

    and just wondering cause for the fact that some AOS applicants came from the same situation - like they overstayed and assuming they also worked under the table, if they could just share how they do it.. etc.

    If someone could help me with this... Our interview is coming up and i am so anxious.

    So my wife came here 2007 with a visiting visa, 2 weeks in the US, a friend of her aunt's calls her asking if she would want to work for her and will petition her for H1B visa. My wife came and met with them, volunteered in the facility while the her papers are taken care of. Couple of months came, her papers are still in the process of being put together and here i come inquiring to live in the facility where she's at. I was diagnosed with Diabetes, very new to me, got my sugar way up to 1000 first few weeks, my sister can't take care of me since she just had a baby. I moved in the facility, I see my wifey to be every now and then, became friends, hang out and so fort. Introduce her to my family as bf/gf's. After awhile she found out that the "friend" who's supposed to petition her - can't petition anyone. my wifey to be already paid the lawyer and did the nine whole yards. I proposed to her to get married because i am getting ready to stand on my feet again and i want to be with her. Although it's like she's taking care of me. Eloped, got married ate pizza and had beer. LOL. ANyway, she left to go take care of an old lady up north for couple of months. SHe visits at least twice a month. AFter that I left the facility and rented a room for us. Family and friends were helping/ lending a hand to take care of financial matters. We also have a co-sponsor for AOS. Now we've been married for 2 years and 5 months and our interview is coming up.

    I know I already asked this before.. is working for rent working? or working in exchange of something considered working? If we tell the IO that she's taking care of kids so we have rent and food but not paying taxes since she doesn't reach the QUota to pay taxes.. like we are super below poverty level. I JUST WANT TO HAVE AN IDEA OF WHAT CAN POSSIBLY HAPPEN WITH OUR CASE.. ANYONE WITH THE SAME EXPERIENCe.. PLEASE SHARE!! THANKS

    Is there any violations with what she did before we got married? I don't want to make any mistake during the interview since I know this would change everything for us... For the better i hope.

    I spoke with the lawyer earlier, He's asking if we have anything in joint. We only have a bank account.

    Proof of bonafide marriage... marriage certificate, letters from relatives, photos. call logs.

    Immigration Officers would ask if she worked.

    So my wife and i (Petitioner) applied for AOS, she's done with her Biometric Exam now comes the interview. We receive a mail for an "initiaL interview"... HOW MANY INTERVIEWS ARE THERE!?

    And also we have a lawyer (who we really not ask info to) who submitted all our stuff, so pretty much all we need on the interview are joint stuff. FOR THIS INITIAL INTERVIEW DOES THE LAWYER NEED TO COME WITH?

    AN IF YOU GET AN INTERVIEW BEFORE THE EAD APPROVAL COMES, DOES IT MEAN THAT THE EAD GOT APPROVE? or thats two different things?

  14. With all due respect to Penguin_ie, and other very knowledgeable members of this forum, I do wish people would stop saying that an overstay is "forgiven". This is not an accurate description of what happens. An accurate description is that the overstay is not relevant in adjudicating the AOS petition of an immediate relative of a US citizen. The requirement that an alien maintain their non-immigrant status in order to be eligible to adjust status does not apply to an immediate relative of a US citizen. USCIS does not "forgive" the overstay. They simply aren't allowed to consider it when adjudicating the AOS petition.

    What exactly do you mean by "asked to leave"? Was she in removal proceedings? Who asked her to leave? Was she ordered deported? Was she given a voluntary departure? Any of these are critical facts which should have been mentioned in your opening post. If she was ordered deported or given a voluntary departure and then failed to leave the US then she's a deportation absconder. She cannot adjust status unless you can successfully convince the US government to reopen her deportation case. If this can be done then you have a reasonable chance of getting the AOS adjudicated. In all likelihood, this would happen in an immigration court. If she is a deportation absconder, in addition to having overstayed her visa, and she leaves the US, then she'll be banned for the deportation and banned for the overstay. An I-601 waiver will be needed to overcome the overstay, and an I-212 waiver will be needed to overcome the deportation.

    I haven't received any of these notices its just confusing of what some of my friends were saying that NOW in order to petition your spouse who overstayed they have to go back home and do the petition from there. That they inquire with a very good lawyer and thats what they were advising them to do "GO HOME AND THEN THE SPOUSE CAN BE PETITIONED" . Then of course i read a post here saying that the spouse needed to go home but then i think thats a different issue because it was an illegal entry or no documentation.
