    The most current version of the bill says that the previously filed applications will be grandfathered in. However, you are right, the bill might change again.

    This is another post where a person has not taken the time to read our replies. If we were anti-immigration, why would be immigrating loved ones and contributing to an immigration board?

     

    Not only that, if you would have continued to read the thread, you would have seen that jaquelly (the person you quoted) later had a different insight on the points we were trying to make.

    Imagine a situation when your children will grow up and let's say move to another country for better professional opportunities. They might do very well there financially and create their own families. If they would be able to financially take care of you when you are older and bring you over there so you could see them regularly and interact with your grand kids, why is it bad? Why do you have to go through long-term visas for aging parents ? With visas you have to go back and forth and it's not always possible for an old person to travel on plain.

    I have similar questions as you had which I posted at the end of this thread.

     

    1) I am sending forms I130, I485, G1145, I131, I765, I864. 

    Do I need to send G325a and I130a also? Some say no need for g325a (biometrics) anymore but some say we still need it. Also not sure what the form I130a is for? Needed only for spouse or for parents also?

     

    2) For the I864- sponsorship document, can my husband be the primary sponsor? or he can only be co-sponsor? Reason being- I am still a student with no income but me and my husband file our income tax jointly so the household income still is above the poverty line.

     

    3) Form- 693 can be sent later, correct? The medical/immunization record? Or in the main package only?

     

    4) In form i130 - as a student, should I mention my employer name as my current university address and details or just mention unemployed?

     

    5) Wasn't sure if we need to write the Beneficiary's name and details in their native language in Part 4 of form I130 Q57-58? Just hand typed?

     

    6) Should I sign off and mention my name as the preparer of the forms if I am filing for my parents?

    I havent gotten their green cards yet, it takes awhile. With the new forms I dont think you need to send G325a, the new forms should be longer. I am not 100% sure i 864 but I think he can be the main sponsor. I 693 can indeed be sent later but I'd just send everything in one package. You can say unemployed for I 130 and comment that you are a student.  For beneficiary's name, just hand write in native language. If you are preparing all the forms then I believe you can sign off as a preparer. You should also google for sample filled out forms online, these might help too.

    one proposal is to invalidate all pending petitions at both USCIS and at NVC. That would mean even if we have our petition approved at USCIS but not the NVC we will be eliminated from the process.

    To keep up to date there is plenty of coverage online on any of the US News sites. 

     

    People have invested time and money to apply for their family members, it would be extremely unfair if they don't grandfather in the pending applications. I understand eliminating the lottery part, nobody cares about that one. I think it's also unfair to grant citizenship to people who are illegally and not give the right to citizenship to parents who are supported by their children and sign the sponsorship form to bring their parents.

    Any updates ? I don't see processing times listed for I 130 for NBC, but for work permit and travel document applications it shows they are processing cases from April.

    I wanted to look up the average processing times for concurrent filing of I-130 and I-485 for my parents and got confused. In their receipt notice for all 4 forms that I filed (I-130, I485, I131 and I 756) it shows National Service Center as service centre. Chicago office received their application on Aug 2nd and they were invited to do fingerprint on Aug 29th. How can I look up how much time it will take for my parents to receive green card ?

    Just because we sponsored our parents' green cards (I-864) it doesn't mean they have to be declared as our dependents in our tax returns. The two are completely separate. If they file taxes separately (this is really important) and they don't work / have any income, they are eligible for maximum healthcare tax subsidy. The law specifically states that healthcare subsidy does NOT constitute a public charge (quoting my very experienced healthcare navigator.)

    To be clear, this only applies to health insurance purchased on the open exchange. Federal programs (Medicare) and state programs (Medicaid) will apply the sponsor's income for any means tested benefits. The one exception is the state of California. Their Medicaid program (Medi-Cal) is very liberal and does not apply the sponsor's income when determining eligibility, even if you filled out an I-864. But I digress...

    Again, to make the most use of the healthcare subsidy, don't claim your parents as dependents on your taxes and you should be fine. You lose a bit in the form of tax deductions for dependents, but the payback in terms of health coverage is well worth it IMO...

    Thank you for a great post. I just filed for my parents green cards ( concurrent filing I 130 + I 485). Obviously they don't have SSN yet, earliest would be after the approval of their work permit. My parents are 70 and 64 years old. Do you think I can get them Medi-cal at this stage or I need to wait for their work permits to be approved ? My mom has a traveler's insurance, but as you mentioned, these don't cover much.

    What is I didnt use G325A form for my parents with old I130 (from 1/1/2017)? I guess I will get rfe, how long would this delay the process?

    Thats true, I filed a i 485 (previous version) from 01012017 and didnt use G325A. This is for concurrent filing with I130 for parents. 

     

    Can I just send G325 for parent  now? I filed two days ago

    The tax transcripts should suffice as it would cover all the bases. No harm including other available documents such as your paystubs if you want to or have available :)

    Sorry, wanted to clarify if I filed i 485 from 01/01/2017 revision, G 325 a is no longer needed?

     

    I also filed i 130 form with it

    Hi ! I filed for my parents I 130 along with I 485. My lawyer friend said that G 325 is no longer needed. I used the most recent I 130 form that expires on July 31st and i 485 1/1/2017 (not the most recent one). But now I am worried that I should have filed G 325 for my parents. She said that it is no longer required for concurrent filing and using the most recent I130. Please advise.
