  1. My fiancee is ready to go to her interview and medical exam in Juarez Mexico. She is bringing her 8 year old daughter on a K2 (already petitioned).

    Here is my question...

    My fiancee just had her daughters fathers Patria Potestad removed (he abandoned her 7 years ago) through the Mexican court. She has her certified court papers from Mexico stating that he has lost his Patria Potestad permanently. With these papers she got a Passport issued for her daughter.

    Is this all she needs to bring for her daughter? Her court papers, Passport, and of course birth certificate?

    Thanks... this is really stressful as the people in Juarez at the Consulate are not very helpful.

  2. Everything sounds correct....that she should be able to get the Passport.....she needs that first BEFORE any visa process can begin.

    Your K-2 option has come and went since it's been more than one year from when your wife's K-1 was issued.

    You'll need to petition her for a different visa.

    Thanks... she never got as far as the K1 Visa, so I think the K2 is still valid. We never went to the interview as we have been waiting for her daughters passport. I call Juarez every few months just to let them know that I have not abandoned my petition. They just tell me that whenever we are ready, schedule the interview. It seems that you can leave it "opened" until you are ready, unless of course me the petitioner closes it.

    My fiancee is in Mexico, she has an 8 year old daughter. I petitioned for her as my fiance over 2 years ago. Everything was approved no problem. She could not get a Passport for her daughter. She was never married to her father , but he was on the birth certificate. He could not be located, and has never been around or involved. We immediately started the excruciating process of her obtaining the Patria Potestad (or removing his, however you want to look at it). Her case just finished and she has certified copies from the court, now she can go get a Passport for her daughter and attend the interview in Juarez.

    My question is.... is this all she needs? all the info that I can find on the topic says yes. Her documents from court says that he has permanently lost all rights to his daughter due to abandoning her for 7 years. That he has lost Patria Potestad.

    I think that is it.. as she can freely get a Passport. I am just nervous as when we call Juarez "just to confirm" they are sooo flaky. I explain it and they just say "yes". Or, they say we really need to come there to the interview and see. Juarez is a long way from home, and I just want to be sure.

    Any comforting stories or advice?

  4. My fiancee and I just went through the same process... it took her 2 1/2 years to get the patria potestad. Her daughters father was "absent" and abandoned her. She was never married. Needless to say, this process was grueling and extremely difficult. We changed lawyers 3 times due to all of them being useless pieces of #######. The whole process cost less than $1000 dollars. my thoughts to you would be to spend more and get a lawyer that specializes in this type of case, was educated in the U.S., and speaks English. Be careful, as any lawyer that you talk to in Mexico, regardless of whether they can help you or not is going to tell you they can, that it is really easy, and that it will only take three months. Don't pay up front as we found they will just drag it on and on and on. We found one lawyer who gave us really good advice and said that lawyers in Mexico typically will charge a small fee per appearance and will just drag the case on and on in order to get this small fee - they don't care about completing the case. I found that you need to stay as close as possible to the process, study it, and understand exactly how every bit of it works to make sure you aren't getting screwed. Honestly, if the father is against her coming here you are better off just trying to convince him and paying him off if you have to. All he needs to do is sign on letter saying she can move here permanently and it is done. Mexico has a machismo culture and I think it will be difficult to convince a court that she can move away if he doesn't want her to, regardless of whether he pays child support or not. The only other way is to do what we did and prove that the father is "no where to be found" and has abandoned her. The court will require that you search for him and prove it. They will basically make you serve papers at all of his past addresses and any addresses that the Mexican government has for him. If he never shows up for court it can be considered that he abandoned his daughter. Convincing him that his daughter will have a better life in the U.S., and will love him for it, and paying him off is just sooo much easier... send me a private message if you like and I can share any further details with you.

  5. My fiance and I met on the internet and yada yada... filed the K1 in April 2010, approved for the interview in Juarez June 2010... quick!

    Background:

    Here is the issue, she has a 7 year-old daughter, she wasn't married with the man, and he has never been in the daughters life but his name is on the birth certificate. She tried to find him to sign a "permission letter" to no avail. She has since started a custody case to have full custody of her daughter. The first lawyer she worked with basically strung her along for about 6 months ultimately ripping her off. She got another, but it is public aid, while it is free and it will happen eventually it is slow.. realllly slow. June 2011 her interview "expired" or so they said it would. I called Juarez and they said it is still open and valid and it will be for an undetermined amount of time unles I close it (I am not going to).

    Here is my question:

    Her public aid lawyer says she can get a permission letter from a judge to get a passport for her daughter and travel abroad, and that it only takes a month and $500 to get. We called Juarez and they said "well... you should have full custody or a permission letter from the father, but maybe the letter from the judge will work, just come in and find out, it is up to the interviewer".

    Jeez... Juarez is like 1500 miles from her house and with her daughter and all it is really expensive. She asked a few lawyers in Mexico and they all say it will work no problem... but I don't think they know what they are talking about... maybe it will, I don't know.

    Please help if you can, the public aid lawyer said her case is going to take 9 more months and it has been a long time already... bububub.

    My fiance and her daughter have an opened interview at Juarez until this June. My fiance has an opened custody case in Mexico for her daughter which needs to be resolved before her interview, unfortunately it will not be solved by this June.

    I am trying to extend the open interview but they are not very helpful when you call Juarez. All they tell me is that I can pay the $700 Visa Fee and request more time. The problem is that they won't tell me how much more time I can request, or if I can definitely get more time, all they say is I must pay the fee first. She won't have the custody case worked out until probably September. My though was to just let it go and file another I129-F but the USCIS says that this will definitely take longer the second time around so I should just pay the fee now and deal with the embassy in Juarez.

    Any ideas or has anyone dealt with anything like this?

  7. I cannot seem to get a straight answer from the help line. If my fiance goes to Juarez for her interview how long is the VISA good for to enter the U.S.? The problem is she is trying to get custody of her daughter and our opened interview is anytime before this June, she thinks she will have the custody case wrapped up by then, but maybe not until August or September.

    I thought they told me that it (the VISA) is good for one entry for 6 months, but now they say it could be valid for 1 day or 1 week, and that it is up to the officer. The idea was to get it in May, and return for her daughters while it is valid and have her added to it.

  8. thanks for the info, I hope all works well for you. All the info that I can find points that either a letter of permission or sole-custody, and that the Judicial Authorization is just for her to get a passport in times of emergency, but now her lawyer for saome reason thinks this is all she needs... I don't trust it, I think that it is either permission or sole-custody and that is it.

    Any other advice from anyone would be appreciated...

  9. I have a question. My fiance has an opened appointment in Juarez, until June 2011. She has a 7 year old daughter that is on the application. She was never married to her daughters father, he was never involved in her life, although his name is on her birth certificate. She is petitioning for sole-custody in Mexico, because his name is on the birth certificate. She doesn't even know where he is to try to get him to sign a "permission slip" to move with the daughter to the US. Her lawyer in Mexico just keeps jerking her around saying 3-6 months more... but the visa appointment is un in June, and heck I want her here now! She consulted with another lawyer that says she can get Judicial Authorization in Mexico for $500 in one month, but I am not sure this is acceptable, and it is near impossible to call someone in the Juarez Consulate, and their answers are shady at best. I am worried that the Mexican Lawyer may not know what he's talking about, but I am not sure... has anyone ever had any dealings with this type of issue? what should we do?

One of the names on the I-129F is wrong, it has been accepted and we have an opened interview, but I put my fiancees daughters name on there wrong, I added her fathers last name , and his name isn't even on her birth certificate. I feel so stupid, what can I do, I feel like this is going to look weird at the interview.

    Am I just freaking out? I tried to call Juarez but they are so rude and unhelpful, I feel like they are going to give us a hassle over this.

She needs to have a document signed and notarized by her minor child’s estranged father stating that she is permanently relocating the child to the U.S.; Do you know what this type of document is called? Does anyone have experience with this, specifically in Mexico, even better in Mexico City? Naucalpan?

    My fiancee has called many notary services in Mexico and they are giving her the run-around, some are even saying this will cost upwards of $500!

    My fiance received her interview packet for her k2 visa interview in Juarez Mexico. Her 6 year old daughter will be coming with her to live in the U.S. (she is on the I129). The fathers name is on her daughters birth certificate, although he is not (nor has he been) active in her life. She (my fiancee) didn't want to attempt to find him so she started a case for sole custody of her daughter. Thanks to Mexico's great legal system the sole custody case is taking FOREVER. What is her other option for bringing her daughter in? Obviously she needs a Mexican Passport (which in order to get she needs the fathers signature if she doesn't have sole custody). Assuming she gets the Passport for her daughter, I know there is a letter of permission that the deadbeat dad signs stating that she can move permanently to the U.S.; does anyone have specifics on this process, or exactly what needs to be stated on this "permission slip"? Does it need to be notarized in Mexico?

  15. We arrived in CDJ Monday afternoon, spent 6:15 to 7:30 at the medical clinic Tuesday morning, got to the consulate at 9:15 Wednesday morning and were walking back to the hotel by noon. We left Thursday with visa in hand.

    thanks... but how long was the interview opened for? how long did they give you to come to Juarez, was it 1 month, 3 months? did they give you a date range in which you could come and interview?

  16. Congratulations on the fast approval of your petition! I can't answer the question about your fiancee's daughter, but I can tell you what to expect next.

    It will take Juarez a week or longer to get the letter in the mail. You should get one at your address in the States, and she'll get one also. I would be curious to see how long it takes. We called the consulate the middle of May because we had not received anything from them a month after getting the letter from NVC. I got my letter on May 19, post-marked in El Paso on May 17. She received hers a week later in GDL, postmarked the same. But, the letter was dated April 27. We're not sure what happened during all that time.

    At any rate, for the K-1, you will not get a fixed interview date. Your letter will say that you have an open appointment to come any day (except weekends, holidays and the last Friday of the month - administrative day the consulate closes every month), between 8 and 10 in the morning. Go here: http://ciudadjuarez.usconsulate.gov/fianceforms.html and start working your way through the bullet points and forms. If you click the link on the left of that page called Steps to Obtaining a K Visa, you can walk through that stuff, but ignore most of the information in step 5. It's wrong. Really wrong. The only thing of value on that page is the instruction to not open the sealed visa packet.

  17. First, congratulations on a quick I-129f approval. The approved 'petition' has a validity of 4 months but that does not mean your fiancee will necessarily have her interview within those 4 months. What often happens is that the next stage of the processing takes a little longer and if the 4 month period date is approaching, the Consulate will re-validate the petition so that it remains in effect until such time as there is an interview date. As well, once the interview takes place and the visa is granted, your fiancee has a full 6 months in which to use the visa so if she needs more time to complete the custody arrangements for her daughter. If you get a quick interview date and you don't have all of the paperwork needed by that date, you can request a later interview date, explaining that you are waiting for the last of the paperwork to take place. It may also happen that she has the interview and they hold off on making a decision until they have all of the paperwork available for her daughter as well.

    So, good luck on getting the custody papers approved quickly, but if there is a delay, you do have some options available.

  18. Got a complex scenario...

    I filed for my fiancee in April 2010 and Juarez Mexico already received the approval from the NVC, it's only June. She hasn't received the interview letter but it is coming any day now.

    My fiancee is bringing her 6 year old daughter with her and is getting custody of her (first of course) which will still take 3 months.

    So my question is... the second NOA from the CSC said that the app. was good from June 1 2010 - October 1 2010, is this the 4 month window during which she can interview? What if she can't the custody paper for her daughter by then?

Her mom thought she had to get sole custody of her daughter and got a lawyer in Mexico. He told her that she doesn't need to do anything! he never signed the birth certificate, and has never been involved in her life! so my question is... how do I change her name on the petition? will this add time to the process? do I just wait until the Visa stage as they will issue the Visa with the name on her birth certificate? The reason (if it is important) that I put her name with her fathers on the petition is because that is how it is on her Baptism certificate.

  20. Maybe I'm misunderstanding something, but wouldn't her daughter's name be whatever she uses as her legal name, regardless of whether or not her father signed her birth certificate or has been involved in her life?

    It is a little more complicated than that... he did sign a Birth Certificate like 6 months after she was born, that's why she retained an attorney to get custody (she assumed she would have to). The attorney told her that the Birth Certificate he signed isn't valid, why I don't know (I think it had something to do with herBaptism). The bottom line is that her Birth Certificate doesn't have his name on it, nor will her Passport. My issue now is that her name on the I-129 does not match her Birth Certificate, Passport, who, where, when do I address this, and does it add time to the process.
