Actually, a minor child under the custody of an LPR parent gains citizenship automatically by derivation (as opposed to naturalization) following the naturalization of the parent by operation of law. All the child needs to do following that is to obtain proof of citizenship, either by applying for a passport or by obtaining an N600 certificate.

I'd like to add that obtaining a US passport or certificate is entirely optional but practical.

what I meant was, is that the daughter cannot receive citizenship just by the mother filing the N400. If I misunderstood then I apologize. But the LPR mother must become a USC in order to naturalize her daughter, so we are on the same page.

under her meant not on the same N400 that she is filing, since she has to write down the name of her children, that doesn't mean that the daughter will be naturalized at the same time as the mother. I hope I made myself clear.

We received our 10 PR cards in March 09. He turned 14 in Aug. 09. Don't I find out recently that he now needs a new card cause he turned 14. I sent the I-90 in last month with the $80 biometric fee. It's rejected for wrong fees sent. I called and am told because we are out of the 30 day window of when he turned 14 that I now need to send $370 instead. What I'd ike an opinion on is....since his current PR card is good until he is 16 (from what I understand), should I apply for US Citizenship and spend $675 plus whatever other fees if there are any, knowing that he will naturalize under me or get him just renew his PR card. It seems like an easy answer but I think I'm hoping that his 10 year card is still good for 10 years and I can catch a break from paying anymore fees and it didn't occur to me that every 10 years we'd have to pay more fees.

US citizenship is not a problem, just procrastinating on more paperwork, fees and travelling 6 hours for the closest test.

In general, it is mandatory for the child who turns 14 to apply for a new card. By law, an LPR should carry valid proof of legal residency, meaning the green card should technically be unexpired. If you are going to naturalize anytime soon and have no travel plans, you can just wait for that and apply for a U.S. passport for your 14 year old after you get your naturalization certificate. If you plan on traveling, then it would be advisable to get the card renewed as it can cause problems at the border. There are accounts of children who failed to get a new card when they turned 14 having no problems at the border or POE. However, I would not risk having an invalid green card now that border screenings are getting tighter and tighter.

for part 11 i typed my full name so do you think that i should sign it with a pen ?

good point but should i still leave part 12 blank?

Yes. Sign with a pen in part 11 using the signature you use to sign legal documents or your personal checks and leave part 12 blank. In part 12, I actually filled the "Preparer's Printed Name" with "N/A", everything else blank with no problem.

Hi All,

I need your input/opinions on this matter. I realize you are not attorneys, but I'm interested in what you have to say. Here it is.

I have applied for citizenship and currently awaiting biometrics. When I filled out my N-400, I completely forgot about about an incident that occurred in 2002. A fight my friends started, that I was blamed for as I was the driver. Nothing came of it as the officer noted what happened and said they'll be in touch.

2 years later in 2004 I received a letter from the local court stating that an arrest warrant was issued. I hired an attorney and had the arrest warrant recalled and all charges dismissed. I was never arrested or even finger printed for that matter.

The omission on the N-400 was an unintentional mistake, as I honestly forgot about this silly incident. Last week, I contacted USCIS via 800 number in an effort to amend the N-400. I spoke 2 agents and took down both of their ID's. Both stated that I can change my N-400 at the time of the interview. I am going to disclose this at the interview, as I have nothing to hide.

My questions to you:

If I write a letter stating that I attempted to amend the N-400 due to an unintentional error and provide agent ID's with whom I spoke with and dates, do you think the interviewing office will give me hard time for not disclosing it?

Do you think the assault charge that was dismissed will have an impact on my naturalization, even if it was cleared and I have a certificate of disposition to show it was dismissed?

You don't need a letter, just make the changes during the interview. Since, the charges were dismissed you shouldn't worry about it but be prepared to furnish a copy of the disposition and perhaps, to be sure, write a brief statement regarding the incident. Your attempt to disclose this will be a plus because you will be viewed as forthcoming. You'll be fine with respect to this.

It's too late to register now and I don't think your husband will be deported for not doing so. You just need to give a good faith reason for not being able to register. If the interviewing officer determines that the failure is not willful then that will not be held against your husband.

Your husband should make a request for a Status Information Letter early in the process as it takes a long time (about 130+ days) to get one. The Status Information Letter will state that your husband was an LPR who lived in the United States between the ages of 18-26, was required to register, but did not register. More likely than not, the IO will focus on why he did not register so be prepared to attach a brief statement to the application form explaining why the failure was not willful.

In my situation, I requested for an SIL but the letter did not get here in time for the interview but I had a two paragraph statement that I had attached as to why I did not register. The IO skimmed through the letter and did not question me about it.

My question is.. My wife come to the US from Mexico when she was only 3 years old. Legally of course. But she has overstayed her welcome. We've been married 2 years in June and have just started our process to make her a resident/citizen. We hired a place in Canton, MS called Catholic Charities Immigration Clinic. They have done all the paperwork and got a lot of information from the both of us (Pictures, joint ownership documents, DRs Physical report[required by USCIS], pictures, proof that we live together like letters with both our names on it, a co-sponsor because i didn't make enough last year to sponsor her myself, tax returns, letter of employment, last 3 month check stubs from myself and my sponsor, etc.) and we are about to send everything to the USCIS. We had to pay 1010.00 for the I-485 and 355.00 for another form (i think the I-130) and we also had to pay 320.00 for the I-102 form which is just a request for her I-94 she didn't receive when she come to the US when she was 3. I was wondering if anyone knew of any problems we may face considering the information and money we have spent on this. The fee for the lady (I think she's some kind of attorney because she does this for a living.. Filling out paperwork for people and so on.) to fill all this out for us was 550.00 for the I-485 and I-130 and it was 75.00 for the filling of the I-102. Like i said she does this for a living and she just accomplished my wife's mothers residency status. She filled out all the paperwork for her and sent it in including the money and she got a response from USCIS within a few weeks for the meeting with them in Memphis TN. Is there anything anyone could suggest or let me know about that i may not know. PLEASE HELP ME. Thanks

First of all, congratulations in taking steps to legalize your wife's status. It looks like you have a fairly straightforward case and your wife, barring any circumstance that would allow her to adjust her status, should be able to get herself legalized.

I'm just a bit concerned about this "lady" you speak of especially since you are not sure about whether she is a licensed attorney or not- you must verify if in fact she is one. Fraud from so-called immigration consultants, specialists, or 'notarios' are quite common so make extra sure you are dealing with someone you can trust- or go after if they mess up. Make sure you have all the copies of what is sent to USCIS on your behalf as well as all copies of USCIS correspondence to you including receipts.

Should we add another column for Oath Letter, before Oath ceremony date?

I'm checking my mailbox every single day and don't know how long it will take for the Oath letter to come

I'm in the same boat. An OL column would be nice but I don't know if it will fit. Also, I don't see much benefit to a ChkCashd column and would rather see a priority date column. Not much help to us at this point but perhaps useful to future filers.

Yes, the I-751 needs to be processed first so that's very handy. it gets "fast-tracked" I suppose

An infopass certainly couldn't HURT but if it's something they're really worried about, and they are fine with travelling to the nearest infopass place then I probably would because it is very bizarre that it's still waiting... Perhaps at the infopass they could discuss their naturalisation and how it's about to be filed and see what they say about it... and also perhaps ask a few qns about whether their kids need the GC before they're able to get their naturalisation certificates (whether the pending application will do something "weird" with the inherited USC), and whether the pending application will affect their kids ROC and if it might speed it along.

Always better to be safe than sorry.

Agree. Some people actually file for naturalisation while the ROC is pending and it forces their ROC to be processed first, so the naturalisation can... I know this doesn't relate to you but seeing your kids are reliant on you PERHAPS (I'm not saying it will) it will force that one along. At the very least they'll be USC's when you are.

I'm not familiar with filing for naturalization while an I-751 is pending, but my understanding is that it is allowed and that the immigration officer would need to request the I-751 file and that has to be processed before oath. Is that correct? This way the OP can get an immigration officer to find out what went wrong with OP's son's case. At any rate, do you think that an Infopass before filing would be a waste of time? Just curious.

If you apply for naturalization and are approved, your children will obtain citizenship by operation of law so go ahead and file your application.

The expanded US-VISIT does not ask a LPR to go to the visitor's line, I just re-read the notice. It only states that they will undergo procedures as other visitors do (picture plus fingerprint).

Where did you get that information? The last time we traveled, at POE (IAD, ORD) there is still section for USC/LPRs and a separate one for visitors. Went through USC/LPR one and the only difference is that they take your picture and fingerprint you - this was in effect since January 2009. ALL stations are equipped with digital fingerprinting device and a camera.

Fingerprinting and picture-taking equipment at USC/LPR booths are designed for LPRs thus all stations will have it. I traveled with my family last summer, and as the only LPR in our group (the rest of my family are USCs), I was the only one subjected to biometrics.

As a general rule, LPRs who leave for brief trips are not considered to be seeking admission when they re-enter. Under certain circumstances, an LPR may be viewed as seeking admission such as when there is a break of continuous residence, trips of 180 days or more, the alien left while removal proceedings are pending, alien engaged in illegal activity after departure, etc.

Recently and as mentioned by Lansbury, US-VISIT regulations require the collection of biometrics information for international travel but USCs do not have to go through this process. Some POEs still do not have this functionality or have not fully-implemented this practice, so YMMV.

Yup generally speaking born in the U.S.A.= U.S. citizen. The only exception I know of is if both parents are accredited foreign diplomats/heads of state.
