  1. All I can say is, they must be REAL confident in getting these petitions done for February 18th, or they wouldn't be putting it all in writing. It's good to hear, I hope they deliver.

    I just hope the "notice" is a notice of approval, and not like the last notice many of us received in November, "Your case is now being processed at a USCIS office".

    That was a REALLY helpful notice. :rolleyes:

  2. I was going to say the same thing. Personally, I think it would be a disadvantage. I am 7 months into the process and am STILL at USCIS through no fault of my own. That means that once, when I do get approved, its going to be at least another 3-5 months for my interview.

    There are only about 5 instances that qualify for an expedite, and I know many people who did qualify for an expedite that have been waiting over 6 months for their applications to be approved.

    Good luck, maybe your journey will be faster than mine :)

  4. Yeah I think at this point there's nothing we can do to "fast-track". We've already been waiting for upwards of 7 months with at least 4 more months at NVC. It's really very depressing.

    I contacted my senators office again because we have to wait 60 days for a response after they initially contacted TSC, and those 60 days are fast approaching. I am hoping they can light a fire under TSC's bum, we'll see.

    Hmmmmm, sure let's up the USCIS count to 248 days, that sounds very fair.

  6. I am american and recently married a canadian. We didn't have a special wedding or anything, we were just married in the courthouse with our parents present. He came down to visit, we got married, he went back to Canada and we filed the I-130. It is cheaper than the fiance visa.

    We filed in July but were one of 36,000 that got transferred to TSC and are still waiting to be approved. Needless to say because of the time it's taking, he crosses back and fourth frequently and hasn't been hassled, yet. Once he's here permanently we will have a big wedding ceremony with all of our friends and family present.

  7. The site is down to scheduled maintenance which they posted on the site yesterday.

    You all need to start rattling some cages, don't rely on your elected officials to be of any assistance. Contact local and national media, take advantage of Twitter and Facebook. We have to be proactive since no one is looking out for us.

    Read my blog and make a comment about what you're experiencing with this process. The blog is getting quite a few hits from the Tweets, Facebook status and getting others I know to get the word out.

    I know the site is down, it was just wishful day-dreaming.

    I just drafted up a letter and am preparing to mass communicate it. Hopefully all of our media contacting will not fall on deaf ears and something will actually be done. :reading:

  8. Amazingly surprised by the inefficiency of this whole process!! It's sad to see people who petitoned after you go past waving goodbye & good luck! Nothing personal against them, just that the whole process is BS!

    Reaching my 7 months of waiting in 9 more days! I was so prepeared for a Dec/Jan interview :blink::blink:

    It is very irritating! Your NOA1 date is just a day after mine, and when I called in 2 weeks ago they said they were processing July 16th petitions. SURE they were. I have 20 more days before the 60 day grace period my local senate office has given them, but who knows if they'll even be able to help. I'm hoping the system is down tonight because they're giving mass TCS approvals and refunding the fees we paid as well.

    Here's to a new week and 36,000 TSC approvals :whistle:

    WOW this is supposed to be a helpful forum where we call all encourage each other and express our frustrations with the systems. If we didn't have this forum we wouldn't have anyone to lean on and offer advice during this process. You received your NOA2 in 173 days and many of us have been waiting a lot longer than that. If all you're going to do is berate the frustrated people on this forum, maybe you should just move on since this forum means nothing to you. Why don't you go on your broken english, psychotic rants in an NVC forum.

    This filing status is for unmarried individuals who provide a home for certain other persons. You are considered unmarried for this purpose if any of the following applies.

    You were legally separated according to your state law under a decree of divorce or separate maintenance at the end of 2010. But if, at the end of 2010, your divorce was not final (an interlocutory decree), you are considered married.

    You are married but lived apart from your spouse for the last 6 months of 2010 and you meet the other rules under Married persons who live apart on this page.

    You are married to a nonresident alien at any time during the year and you do not choose to treat him or her as a resident alien.

    Married persons who live apart. Even if you were not divorced or legally separated at the end of 2010, you are considered un married if all of the following apply.

    You lived apart from your spouse for the last 6 months of 2010. Temporary absences for special circumstances, such as for business, medical care, school, or military service, count as time lived in the home.

    You file a separate return from your spouse.

    You paid over half the cost of keeping up your home for 2010.

    Your home was the main home of your child, stepchild, or foster child for more than half of 2010 (if half or less, see Exception to time lived with you).

    You can claim this child as your de pendent or could claim the child except that the child's other parent can claim him or her under the rule for Children of divorced or separated parents.

    I am also a USC and my canadian husband has not lived with me at all in 2010, I pay ALL the housing expenses in the US, etc. According to the guidelines above, it seems like "Head of Household" accurately describes me. Am I wrong in thinking this?

  11. Ok so I think this may be a bit of a weird situation. My husband and I applied for out I-130 in July(!). Yah, we were part of the unfortunate bunch that got transferred to TSC and nothing has happened since, which has led me to my current predicament. When my husband and I applied, we thought it would only take 7 months max. During that time he was doing a seasonal job, then when the season turned cold he was laid off as he always was. We thought he would have time to get his visa and come live with me a find a job when he got here.

    BUT since it's taken WAY too long he has found a pretty good job in his city, and it is a good move for him. I am not sure what to do. Do we keep going forward with his Visa? Can he keep his USA visa if he keeps his job in Canada? Can I apply for my Canadian visa while he's applying for his american one?

    I wish it wasn't so stinking hard, we are only 6 hours away but the government makes it seem like a whole other world!!!

    To quote our letter received at the beginning of November:

    "Your petition has been transferred to the Texas Processing Center to speed up the process"

    It's a black hole alright. We WILL get out, but God alone knows when. I noticed no more approvals yesterday, or today on here.

    I get so irritated everytime I see my transfer notice.

    Yah right, I think they meant to say, " Speed up the process of EVERYONE else."

    I had essentially the same thing happen to me. Case was at CSC since July 17th then transferred to TSC because of a backlog on 11/01/10. I then got another email saying it was "being processed at a USCIS office". It's now been 177 days since my NOA1 date, which is just 3 days shy of 6 months. I think USCIS is just way too backlogged right now and weird things are happening.

    I emailed TSC last week and i heard nothing, then last MOnday i emailed the main office of USCIS and they were very fast, they forward my letter at TCS saying " FOR RESOLUTION PLEASE. THANK YOU." then TCS answered me back because of the USCIS main email.

    TCS told me that our petition is still pending and awaiting for final review. Don't if this is good or what. Last Nov TCS mailed that we are still on Initial review the last december my cousin's friend contacted a senator (which is their friend) from NY and inquire my case and we found out that our case " for further review". and now we are awaiting for final review. Oh God please enlighten me :)

    I am just wondering what email address you used to email TSC. My NOA1 date is just a few days before yours, so maybe I should try emailing them too. This is the one I found: tsc.ncscfollowup@dhs.gov, is it correct? Thank yoU!

  15. So my congressman contacted USCIS @ TSC and they said they are processing the petitions 30-160 days from when they received them. They told the congressman's representative that they received my file on 11/18, which is weird, because it was transferred on 11/03/10. This means they are counting the days from 11/18, which I think is unfair, because that's not the date of my transfer notice. The congressional rep has to abide by those wait rules, so I guess it'll be up to another 60 days before anything can be done. She said at the least it's good that she inquired on the case because sometimes it gets them moving faster.

    I sincerely hope that my application, along with ALL TSC filers are approved before their 60 day mark! :thumbs:

  16. I need you guys' opinions: My 5 months mark is on 12/24 and I am planning on mailing out a letter to a senator on the 27th. Is that a good idea or should I wait a bit? I'm assuming I won't get a response from his office until a few weeks into January, anyway...

    Thoughts?

    I emailed my senator 3 days before my 5 month mark and got a response from their office 2 days later. They have already contacted USCIS on my behalf and it takes 24-48 hours for USCIS to get back to them. I don't think it hurts contacting your senator now. Most have an online point of contact so it makes it very quick and easy. Good luck!
