  1. I sent in my first I-751 application in September and no check was cashed and an NOA1 was never received.

    I was advised to cancel this check and send another application. I sent it signed for delivery and even have Dan Renaud signature confirming delivery of the application.

    I waited the standard 30 days called back and basically got told that this application has not been received either and the check has not been cashed. (I have double checked with my bank and checked I made it payable to the correct name and the amount was correct)

    I also triple checked that my application was completed correctly.

    All I got from two different telephone representatives from USCIS is sympathy and that they cant do anything it is my responsibility to have the application delivered (which I already know it has been) and they gave me an email for Vermont to send my concerns to.

    I emailed and got a reply stating they will respond within 15 days. Which will be 2 weeks before my green card expires.

    So what should I do send another application? Cancel my second check and send another one or send a money order? Should I send it USPS signed for or a courier?

    I am about ready to drive over and hand the deliver the package.

    Any good advice will be much appreciated

  3. Glory, Glory Hallelujah! I got my NOA, date September 11, 2012. :dance: Please update the list.

    On a side note, the NOA says that "if you have not done so, provide supporting documents to assist USCIS in processing your petition and to establish eligibility to remove the conditional basis of your permanent residence", and then it lists the following items: Lease of joint tenancy or joint ownership of assets, joint mortgage agreement and/or property deed; tax returns, birth certificate(s) of any child(ren) born from marriage; joint policies of life, medical and/or car insurance.

    I assume that this is standard language, since we submitted plenty of evidence including some of the above items. Do your NOAs read the same?

    Another thing: the NOA lists my name (GC holder) as the petitioner: shouldn't that be my USC wife?

    Did they cash your check whilst you had been waiting for your NOA1?

    Please add me to the timeline we submitted the application to Vermont on 09/15/12 but still no check cashed or NOA1

  4. Hi, I have the same question! Please let me know what happened with your husband. I was just sent an RFE for proof of citizenship - I sent in a copy of my passport but it seems it wasn't enough. Was I supposed to send in a Report of Birth Abroad (don't have one). You were in my exact situation - please help! Thanks.

    We were never sent a RFE. I agree with the above questions JimVaPhuong just asked - Did you submit a copy of every page of your passport? Was your passport issued with a validity of at least five years?

  5. In answer to my own question:

    U.S.C.I.S. put up a notice of proposed rulemaking in August 2007 to force the replacement of cards issued between 1979 and 1989 without expiration dates. However, there was no final rule making, and so the cards remain valid. The last mention of the rulemaking as far as we can see came in the DHS semiannual regulatory agenda of May 2009 in which it was labeled an item for long term action.

    Would a permanent resident be able to choose to apply for naturalization instead of applying for a new card under the proposed rule?

  6. I am helping a friend file for citizenship and their green card was issued a long time ago over 30 years and they were never required to renew it every 10 years unlike today.

    Has anybody else gone through the US Citizenship process and they had a very old green card that never needed to be renewed every 10 years?

  7. I had all my vaccinations done at the military hopital on base and they were all free and accepted by the USCIS approved doctor doing my medical. Just ensure you get the list of latest vaccinations required for your state from your USCIS doctor - I had some complications and had to go back for another round of shots that I was not informed of by another USCIS doctor.

  8. Also ensure that you send back the Overseas Income Assessment form on time otherwise the default monthly payment is 249 GBP per month ($380 a month is a lot of money even when your earning a decent wage)

  9. I sent a letter and advised the Student Loans Company that I was moving to the USA and informed them of my US address. They then sent out a letter with an Overseas Income Assessment Form to me in the US. At the time I wasnt working so I filled in the form and returned it with a letter from my husband confirming that he was supporting me financially. They seemed happy and sent me a letter back confirming they would assess payments 12 months later. That was 12 months ago and last week I received another Overseas Income Assessment form so I completed this and returned it with my current pay slip but I still dont earn enough to be making any repayments. So I will go through this cycle until they confirm that I am earning over the threshold and I can then make monthly payments online through their website.

  10. That entire statement sounds untrue to me. They do not let you cease payments just because you've gone to work abroad. And I doubt they'd ever write off any debt. You won't find anything about that in the agreement you've signed or their website, etc (happy to be proven wrong on that!)

    Actually they do write off student loan debt

    If the first loan was taken out in or before the academic year 2005/06 (in England, Wales, Scotland or NI) the loan is written off when you reach 65.

    If the first loan was taken out in or after the academic year 2006/07 (in England, Wales or NI) loans are written off 25 years after they became eligible to be repaid - if it was in Scotland loans are written off 35 years after they became eligible to be repaid.

  11. My wife and I decided to have the same surname, nothing strange about that I hear, BUT I changed my name as well so we have both our surnames hyphenated. We have proof of name change, drivers license and SSN, but I have been told that I will need to send my U.K passport off to Washington DC. I was told that I would not be able to travel back to U.K and change it there next year when we visit as my name will be different from the airline tickets.

    How much of this is right, I have my A.O.S/E.A.D interview next month and was thinking of sending off my passport straight after as I won't need it for a while.

    This was my experience

    My passport is in my maiden name and my green card is in my married name.

    I therefore booked tickets back to the UK in my passport name (maiden name) as the name on the ticket has to match the name on the passport. So I agree that you shouldnt have your name change done on your passport in the UK after your flight as your return tickets will not match the name on your passport. Coming back through customs I showed my passport in my maiden name and my green card in my married name to the customs officer and I also showed him my wedding certificate (which I had taken as proof of name change) and there was no problems. I will now be sending off my passport to Washington DC to have it changed into my married name for future travel. I didnt have enough time before this journey and even though people assured me that taking my wedding certificate would be fine I was still a little nervous about not getting back into the USA :o

  12. The property is no longer black listed as it used to be in the past - this would only happen if the person named on the title to the property stopped paying bills as a charge can then be placed on the property by the loan/credit company.

    The family member still living at the property may still be harrassed though by the companies through letters, phone calls and home visits they would just need to advise them that you no longer live at the residence. Also your credit history in the UK would be badly damaged and if you intend on returning you may struggle for credit in the future. The future being the six years it takes for the debt to be wiped from your credit file.
